&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1.&lt;/strong&gt; En data de 27 de febrer de 2023 es va emetre per &lt;span style="color:#000000"&gt;la cap del Servei de Persones amb Discapacitat i Innovació Social, amb el vist-i-plau del director insular de Persones amb Discapacitat i Innovació Social informe justificatiu relatiu a la necessitat de concertar, per tres anualitats, un total de 257 places &lt;span style="background-color:#ffffff"&gt;del servei de funció tutelar per a persones amb discapacitat intel·lectual i/o del desenvolupament,&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;inclòs a la xarxa pública de serveis per a persones amb discapacitat de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;En &lt;/span&gt;&lt;span style="color:#000000"&gt;data de &lt;/span&gt;&lt;span style="color:#000000"&gt;27&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;febr&lt;/span&gt;&lt;span style="color:#000000"&gt;er de 2023&lt;/span&gt;&lt;span style="color:#000000"&gt; la presidenta de l'Institut Mallorquí d'Afers Socials (en endavant, IMAS) va ordenar l'inici de&lt;/span&gt;&lt;span style="color:#000000"&gt; l'expedient relatiu a la &lt;/span&gt;&lt;span style="color:#000000"&gt;concertació del &lt;span style="background-color:#ffffff"&gt;servei de funció tutelar per a persones amb discapacitat intel·lectual i/o del desenvolupament&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Mitjançant &lt;/span&gt;&lt;span style="color:#000000"&gt;Resolució de la presidenta de l'I&lt;/span&gt;&lt;span style="color:#000000"&gt;MAS&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;núm. 1324&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2&lt;/span&gt;&lt;span style="color:#000000"&gt;6 &lt;/span&gt;&lt;span style="color:#000000"&gt;de gener de &lt;/span&gt;&lt;span style="color:#000000"&gt;2023,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;'aprova la previsió dels serveis a concertar durant l'any 202&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; per la Direcció Insular de Persones amb Discapacitat i Innovació Social &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;16&lt;/span&gt;&lt;span style="color:#000000"&gt;, de &lt;/span&gt;&lt;span style="color:#000000"&gt;4 &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;febr&lt;/span&gt;&lt;span style="color:#000000"&gt;er de 2023),&lt;span style="color:#000000"&gt; &lt;/span&gt;entre els quals es troba el que és objecte d'aquesta concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;A més, a l'esmentada resolució s'aproven la Guia d'aplicació al model d'atenció als serveis socials per a persones amb discapacitat de Mallorca i el Model d'Avaluació de seguiment de l'acció concertada, aplicables a tots el serveis a concertar per la Direcció Insular de Persones amb Discapacitat i Innovació Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Consten a l'expedient els Plecs de prescripcions tècniques que han de regir &lt;/span&gt;&lt;span style="color:#000000"&gt;la&lt;/span&gt;&lt;span style="color:#000000"&gt; concert&lt;/span&gt;&lt;span style="color:#000000"&gt;ació, així com la proposta de convocatòria i els annexos corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; La despesa prevista per aquest expedient és d'&lt;strong&gt;1.443.029,30 €&lt;/strong&gt;&lt;strong&gt; &lt;/strong&gt;i el Servei de Comptabilitat i Pressuposts ha emès Informe d'autorització a la despesa pluriennal en data de 6 de març de 2023. Així mateix, consten a l'expedient els documents comptables a càrrec de l'aplicació pressupostària 40.23128.26000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. &lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;El Servei Juridicoadministratiu i la Intervenció delegada de l'IMAS han emès sengles informes favorables a la convocatòria de la concertació objecte d'aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Pel que fa a la competència,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; núm. 32 ext., d'1 de març de 2007; correcció d'errades &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt; núm. 29, de 28 de febrer de 2008), en concret l'article 70.4 relatiu a la competència pròpia dels consells insulars en matèria de serveis socials i assistència social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; L&lt;/span&gt;&lt;span style="color:#000000"&gt;a Llei 14/2001, de 29 d'octubre, d'atribució de competències als consells insulars en matèria de serveis socials i seguretat social, estableix a l'article 14 la potestat reglamentària normativa atribuïda als consells insulars en matèria de serveis socials, dins el marc de la regulació bàsica establerta pel Govern de les Illes Balears (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt; núm. 135, de 10 de novembre de 2001 i BOE núm. 284, de 27 de novembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt; La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; núm. 89 de 18 de juny de 2009 i BOE &lt;/span&gt;núm. 163 de 7 de juliol de 2009&lt;span style="color:#000000"&gt;) preveu a l'article 27 i a la disposició final quarta, que cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 66/2016, de 18 de novembre, pel qual s'estableixen principis generals per a les carteres insulars i locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; E&lt;/span&gt;&lt;span style="color:#000000"&gt;ls Estatuts de l'Institut Mallorquí d'Afers Socials (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt; núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019, en especial l'establert a l'article 2 d'acord amb el qual l'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Drets Socials del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Decret de la Presidència del Consell de Mallorca, &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de dia 8 de juliol de 2019, modificat per el Decret de la Presidència de dia 28 de desembre de 2021, pel qual es creen els departaments que n'han d'estructurar el govern (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; núm. 92, de 9 de juliol de 2019, BOIB 180 de 30 de desembre de 2021), entre els quals es troba el Departament de Drets Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de dia 12 de novembre de 2021 (&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; núm. 158 de 16 de novembre de 2021) per el que es nomenada la Sra. Sofia Alonso Bigler consellera executiva de Drets Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article 7.2.28 dels Estatuts de l'IMAS (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB&lt;/em&gt; núm. 67, de 18 de maig de 2019). No obstant això, i d'acord amb l'article 8.2.1 les Vicepresidències de l'IMAS supliran a la Presidència i assumiran les seves atribucions en cas de vacant, absència, malaltia, impossibilitat física o una altre causa legal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Pel que fa al fons,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;L&lt;/span&gt;&lt;span style="color:#000000"&gt;a Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca &lt;/span&gt;&lt;span style="color:#000000"&gt;aprovada definitivament e&lt;/span&gt;&lt;span style="color:#000000"&gt;n Ple del Consell de Mallorca de 13 de juliol de 2017 (BOIB núm. 97, de 18 de juliol de 2017 i correcció d'errades materials publicada BOIB núm. 161, de 30 de desembre de 2017) &lt;/span&gt;&lt;span style="color:#000000"&gt;i prorrogada la seva vigència fins al 31 de desembre de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; per Acord&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; del Ple en sessi&lt;/span&gt;&lt;span style="color:#000000"&gt;ons&lt;/span&gt;&lt;span style="color:#000000"&gt; de 8 de juliol de 2021 &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB núm. 95, de 17 de juliol de 2021) &lt;/span&gt;&lt;span style="color:#000000"&gt;i de &lt;/span&gt;&lt;span style="color:#000000"&gt;15 de desembre de 2022 &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;168&lt;/span&gt;&lt;span style="color:#000000"&gt;, de &lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt;7 de &lt;/span&gt;&lt;span style="color:#000000"&gt;desembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 202&lt;/span&gt;&lt;span style="color:#000000"&gt;2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;E&lt;/span&gt;&lt;span style="color:#000000"&gt;l &lt;/span&gt;&lt;span style="color:#000000"&gt;R&lt;/span&gt;&lt;span style="color:#000000"&gt;eglament pel qual es regula el funcionament dels serveis socials per a persones amb discapacitat inclosos a la Cartera Insular de serveis socials i s'estableixen els requisits d'autorització i acreditació, &lt;/span&gt;&lt;span style="color:#000000"&gt;aprovat al &lt;/span&gt;&lt;span style="color:#000000"&gt;Ple &lt;/span&gt;&lt;span style="color:#000000"&gt;del Consell de Mallorca de data 8 de febrer de 2018&lt;/span&gt;&lt;span style="color:#000000"&gt; (BOIB núm. 21, de 15 de febrer de 2018)&lt;/span&gt;&lt;span style="color:#000000"&gt;. Aquesta normativa estableix, entre d'altres, les condicions tècniques i materials i els requisits de qualitat dels serveis de serveis socials per poder optar al règim de concert social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.&lt;/strong&gt; La Directiva 2014/24/UE del Parlament Europeu i del Consell, de 26 de febrer de 2014, sobre contractació pública &lt;/span&gt;&lt;span style="color:#000000"&gt;(DOUE núm. 94, de 28 de març de 2014).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears que regula el règim de concertació als articles 89 i següents&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;BOIB núm. 89 de 18 de &lt;/span&gt;&lt;span style="color:#000000"&gt;juny&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2009&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt; La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears (BOIB núm. 146 de 22 de novembre de 2018), regula al Capítol I el «Règim de col·laboració privada en la gestió de serveis socials per a les persones mitjançant l'acció concertada» (en endavant Llei 12/2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;. &lt;/strong&gt;El Decret 48/2017, de 27 d'octubre, (BOIB núm. 132, de 28 d'octubre de 2017) pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials (en endavant Decret 48/2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;. &lt;/strong&gt;La Llei 3/2018, de 29 de maig, del tercer sector d'acció social (BOIB núm. 67, de 31 de maig de 2018), regula als seus articles 3 i 4 les entitats que tenen la consideració d'entitats del tercer sector d'acció social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Resolució de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Presidència&lt;/span&gt;&lt;span style="color:#000000"&gt; de l'I&lt;/span&gt;&lt;span style="color:#000000"&gt;MAS&lt;/span&gt;&lt;span style="color:#000000"&gt; per la qual estableix els serveis socials per a persones amb discapacitat i per a persones majors, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social (BOIB &lt;/span&gt;&lt;span style="color:#000000"&gt;núm. 36, de 22 de març de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;Resolució de la Presidència de l'IMAS, núm. 21525 de 2 de desembre de 2022, d'actualització i fixació de preus dels serveis per a persones amb discapacitat, inclosos a la cartera insular de serveis socials, que &lt;span style="background-color:#ffffff"&gt;poden ser objecte de concertació social (BOIB núm. 158, de 6 de desembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;17&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Resolució de la presidenta de l'Institut Mallorquí d'Afers Socials, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;núm. 1324&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;26 de gener de 2023&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; d'aprovació de la previsió dels serveis a concertar durant l'any 202&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;3&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; per la Direcció Insular de Persones amb Discapacitat i Innovació Social &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;(BOIB núm. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;16&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;, de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;febrer&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Pel que fa al procediment,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;La Directiva 2014/24/UE del Parlament Europeu i del Consell, de 26 de febrer de 2014, sobre contractació pública &lt;/span&gt;&lt;span style="color:#000000"&gt;(DOUE núm. 94, de 28 de març de 2014),&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;preveu a l'article 75 la publicació dels anuncis &lt;/span&gt;&lt;span style="color:#000000"&gt;al DOUE&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;en compliment del principi de transparència, assegurant un grau de publicitat adequat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;La Llei 12/2018 &lt;/span&gt;&lt;span style="color:#000000"&gt;disposa a l'article 5 els «Requisits exigibles a les entitats gestores dels serveis concertats i a l'article 6 els «Procediments de concertació i criteris de preferència a favor d'entitats del tercer sector social».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;20. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;El Decret 48/2017 al Títol III, &lt;/span&gt;&lt;span style="color:#000000"&gt;estableix &lt;/span&gt;&lt;span style="color:#000000"&gt; els «&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Procediments de concertació&lt;/em&gt;» en tot el que no contradigui la Llei 12/2018 abans esmentada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;21&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;. &lt;/strong&gt;La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;22.&lt;/strong&gt; &lt;span style="color:#000000"&gt;L'article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l'acord d'aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l'expedient ha &lt;/span&gt;&lt;span style="color:#000000"&gt;estat sotmès a la Intervenció delegada de l'IMAS per a l'emissió del preceptiu informe de fiscalització prèvia ( BOE núm. 59 de 9 de març de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En virtut de la competència atribuïda legalment; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Les places a concertar, en el marc d'aquesta convocatòria són de 257. Aquest nombre té caràcter estimatiu i s'ha establert en funció de les necessitats actuals del Servei de Persones amb Discapacitat i Innovació social. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Vigència de l&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;a&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; concert&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ació&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La vigència d'aquesta&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; concert&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ació&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; serà de tres anys, des de la formalització o des de la data que expressament es determini a l'acord d'acció concertada subscrit entre &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;l'Institut Mallorquí d'Afers Socials&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;(en endavant &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;IMAS&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;) i les entitats que resultin adjudicatàries. El concert serà susceptible de renovació per igual termini.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;6. Requisits de les entitats&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Les entitats que vulguin optar a aquesta concertació social hauran de complir els requisits següents:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;a) Inscripció en el Cens d'Organitzacions del Tercer Sector Social de les Illes Balears, d'acord amb l'establert a la Llei 3/2018, de 29 de maig, del tercer sector social (BOIB núm. 67, de 31 de maig de 2018).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;b) Complir els requisits mínims que s'estableixen en el títol VII de la Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, en endavant Llei 4/2009 (BOIB núm. 89, de 18 de juny de 2009).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)Tenir el servei objecte d'aquesta convocatòria legalment constituït i &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;acreditat per l'IMAS en el moment de l'adjudicació, així com tenir el servei inscrit en el Registre Unificat de Serveis Socials. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;d) Acreditar una experiència mínima d'un any en la prestació del servei i perfil de les persones usuàries objecte d'aquesta&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; concert&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ació. L'experiència ha de ser acreditada d'acord amb el punt 7.2 d'aquesta convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e) Acreditar solvència financera i tècnica&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; per prestar el servei objecte de l&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; concert&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ació&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; d'acord &lt;span style="background-color:#ffffff"&gt;amb el punt 7.2 d'aquesta convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) Estar al corrent en el compliment de les obligacions econòmiques amb el Consell de Mallorca i amb l'IMAS, així com amb les obligacions tributàries i amb la Seguretat Social que venguin imposades per la normativa vigent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g) Que l'entitat no hagi estat objecte, respecte d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;el servei a concertar, d'una resolució &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d'expedient sancionador en matèria de serveis socials, causes que consten als articles 127 a 129 de la &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 4/2009 durant els 24 mesos anteriors al concert, a excepció que, amb carà&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;cter previ a la presentació de la sol·licitud, l'entitat hagi satisfet el pagament íntegre de la totalitat de l'import de la sanció i hagi acreditat davant l'òrgan sancionador que s'han corregit les causes que motivaren la sanció. Aquests fets s'acreditaran necessàriament mitjançant la verificació i el corresponent informe per part de l'òrgan administratiu competent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h) No estar afectades per cap prohibició de contractar amb l'Administració, d'acord amb l'article 71 de la Llei 9/2007, de 8 de novembre, de contractes del sector públic, ni estar inclosa en cap dels supòsits prevists a l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions, ni la Llei 58/2003, de 17 de desembre, general tributària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i) No haver estat sancionat en els darrers quatre anys mitjançant resolució ferma per la comissió d'infraccions greus o molt greus en matèria de relacions laborals, ocupació, empreses usuàries d'empreses de treball temporal, seguretat social, emigració, moviments migratoris i treball d'estrangers.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j) Acreditar la titularitat del centre, o la disponibilitat de l'espai físic necessari per desenvolupar el servei, mitjançant qualsevol títol jurídic vàlid per un període no inferior al de la vigència del concert. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;7&lt;/strong&gt;. &lt;strong&gt;Presentació de sol·licituds&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;7.1. Lloc i termini de presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El termini per presentar les sol·licituds és de&lt;span style="background-color:#ffffff"&gt; 10 dies h&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;àbils comptadors des de l'endemà que s'hagi publicat aquesta convocatòria en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Les entitats interessades &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;han de presentar l&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; sol·licitud d'acord amb el model normalitzat que figura a la seu electrònica del Consell de Mallorca i al Tauler d'Anuncis de l'IMAS, i que s'aprova amb aquesta convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El m&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;odel &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de sol·licitud (MOD-1), ha d'&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;anar&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; signa&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;t per la persona representant legal de l'entitat, indicant expressament el nombre de places que sol·licita concertar amb l'IMAS en el marc d'aquesta convocatòria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Aquesta sol·licitud s'ha d'acompanyar dels documents que es detallen a continuació:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) Una fotocòpia del document nacional d'identitat, per acreditar la identitat de la persona que legalment representi a l'entitat, així com l'acreditació de la seva representació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Certificat de la inscripció al Cens Públic d'Organitzacions del Tercer Sector Social de les Illes Balears, amb menys de 6 mesos de vigència.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c) Certificat de la inscripció al Registre de Serveis Socials, amb menys de 6 mesos de vigència.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d) Còpia de la resolució d'acreditació vigent del servei a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; concertar &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;o &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;còpia de la &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;sol·licitu&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d de l'acreditació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e) Documentació acreditativa de la solvència tècnica. En el cas de &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;que &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;la solvència tècnica s'acrediti mitjançant Resolució de serveis prèviament contractats o concertats amb l'IMAS, no és preceptiu presentar la documentació acreditativa. Si bé, en tot cas, s'ha d'indicar al MOD-1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) Documentació acreditativa relativa a la solvència financera assenyalada en el MOD- 1 de sol·licitud.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g) Justificant de disposició de pòlissa d'assegurança de responsabilitat civil que cobreixi la indemnització per riscos (&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; professionals, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d'atenció a les persones o d'altres)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; per a tot el període de durada del concert, per un import igual o superior a l'exigit als plecs de prescripcions tècniques d'aquesta concertació social, en funció del número de places sol·licitades. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;h) Documentació acreditativa de la titularitat o de disponibilitat de l'espai físic en el que es desenvoluparà el servei, per qualsevol títol jurídic vàlid, per un període no inferior al de la vigència del concert. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;En relació a la documentació referenciada a les lletres a), b), c), d) i e) del punt 1, de conformitat a l'establert a l'article 28 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (en endavant Llei 39/2015), no serà necessària la presentació d'aquella documentació que ja hagi estat prèviament aportada, havent d'indicar-lo l'entitat, emplenant a aquest efecte la informació continguda, sempre que estigui en vigor i no hagi sofert modificacions. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;La presentació de la sol·licitud implica que l'entitat autoritza a l'IMAS per a què pugui consultar o demanar a qualsevol administració la documentació, les dades i els informes que considerin necessaris per tramitar l'expedient, i que l'entitat s'obliga a complir amb el plec de prescripcions tècniques d'aquesta convocatòria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;7.3. Esmena de deficiències&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Si la sol·licitud no reuneix els requisits legals i els que es deriven d'aquesta convocatòria s'ha de requerir a &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;l'entitat sol·licitant, d'acord amb el que estableix l'article 68 de la Llei 39/2015, perquè, en un termini &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;deu dies hàbils, esmeni la falta o acompanyi els documents preceptius, amb la indicació que, si no &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ho fa, es tindrà per desistida de la seva petició, prèvia resolució expressa en els termes que estableix l'article 21 de la Llei esmentada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;8. Instrucció del procediment&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.1. Òrgan competent per a la instrucció&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;L'òrgan competent per instruir el procediment és la Direcció Insular de Persones amb Discapacitat i Innovació Social de l'IMAS, que tindrà la prerrogativa d'interpretar-lo i resoldre'n els dubtes que sorgeixin durant el compliment. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Els serveis tècnics de la Direcció Insular de Persones amb Discapacitat i Innovació Social de l'IMAS han d'examinar les sol·licituds i si escau tramitar els requeriments d'esmena que siguin necessaris, emetent-se informe al respecte.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;8.2&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;. &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Criteris de tramitació &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- Si el còmput total de places que ofereixen les entitats que compleixin amb els requisits establerts al punt 6 d'aquesta convocatòria no supera el nombre total de places&lt;/span&gt; a concertar,&lt;span style="background-color:#ffffff"&gt; l'informe proposarà que s'adjudiquin directament a les entitats sol·licitants.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;- Si el còmput total de places que ofereixen les entitats que compleixin amb els requisits establerts al punt 6 d'aquesta convocatòria supera el nombre total de places a concertar, s'actuarà segons els criteris de preferència establerts al punt 8.4 d'aquesta convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- A &lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;petició de l'òrgan instructor, &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;n cas que hi hagi dificultats en la interpretació de les ofertes presentades o dubtes en el procediment d'adjudicació, o així ho consideri l'òrgan instructor es convocarà una comissió avaluadora, amb la composició i funcions que s'estableixen al punt 8.3 d'aquesta convocatòria. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.3. De la Comissió Avaluadora&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La Comissió Avaluadora actuarà de conformitat amb l'article 15 relatiu al «Comitè tècnic d'assessorament» del Decret 48/2017 i, conseqüentment tindrà els mateixos efectes que l'esmentat Comitè Tècnic d'Assessorament.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i. Composició&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La comissió avaluadora estarà integrada pels membres següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- President: El director insular de Persones amb Discapacitat i Innovació Social o persona que el substitueixi.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- Vocals&lt;/span&gt;:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ii. Règim de funcionament&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Aquesta comissió ha d'analitzar i interpretar les incidències o dificultats &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;detectades i ha d'emetre &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;informe &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;al respecte&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;,&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;el qual s'ha de tenir en compte per l'òrgan instructor alhora d'elaborar la proposta de resolució&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;Només serà convocat per l'òrgan instructor en cas que, per existir dificultats o dubtes aquest òrgan ho consideri necessari. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La Comissió Avaluadora queda vàlidament constituïda amb l'assistència, com a mínim, dels membres següents: la presidència o persona suplent, la secretària o persona suplent i dos vocals.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.4. Criteris de preferència&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;D'acord amb l'article 6 de la Llei 12/2018, els criteris per a resoldre la concertació social objecte d'aquesta convocatòria són: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;a) L'arrelament de la persona en l'entorn d'atenció i les condicions d'atenció que requereix la persona. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b) La implantació de l'entitat a la localitat on s'hagi de prestar el servei. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;c) La lliure elecció i la llista d'espera pública d'accés als serveis.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;8.5. Continuació del procediment&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Una vegada comprovats tots els requisits, &lt;/span&gt;l'òrgan instructor &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;emetrà informe proposta d'adjudicació de les places a concertar del servei objecte d'aquesta convocatòria, que inclourà la designació d'un responsable del seguiment del concert i si n'és el cas, l'exclusió &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;motivada de les entitats que no compleixin amb els requisits establerts, així com qualsevol altra informació que resulti necessària per a la resolució de l'expedient. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;strong&gt;9&lt;/strong&gt;. &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Resolució i notificació&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.1. Òrgan competent per a la resolució&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article 7.2.28 dels Estatuts de l'IMAS (BOIB núm. 67, de 18 de maig de 2019).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.2. Termini&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El termini màxim per dictar i notificar la resolució d'aquesta concertació és de tres mesos comptadors de l'endemà que acabi el termini de presentació de sol·licituds. S'han de considerar desestimades les sol·licituds no resoltes en el termini indicat anteriorment. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.3. N&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;otificació i publicació&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La resolució de la&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; concert&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ació social objecte d'aquesta convocatòria, s'ha de notificar individualment a les entitats interessades, d'acord amb el previst a l'article 42 de la Llei 39/2015, han de ser expresses, motivades i han de fixar la quantia individual del concert. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;A més, aquesta resolució es publicarà al BOIB i al &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;DOUE,&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; així com&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; al Tauler d'Anuncis de l'IMAS (&lt;/em&gt;&lt;/span&gt;&lt;em&gt;https://imas.sedipualba.es/tablondeanuncios/&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; a la Seu electrònica del Consell de Mallorca. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.4. Modificació resolució&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Qualsevol alteració de les condicions exigides per concedir el concert, pot donar lloc a la modificació de la resolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.5. Dels Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Contra les resolucions que adopta la Presidència de l'IMAS es pot interposar recurs d'alçada davant el Consell Executiu del Consell de Mallorca en el termini i amb els efectes de l'article 112 de la Llei 39/2015, de l'1 d'octubre, de procediment comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;10. Formalització dels concerts&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La concertació social &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;que s'estableix a l'empara d'aquesta convocatòria &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;s'ha de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; formalitza&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;r&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; mitjançant un document administratiu anomenat «acord d'acció concertada» , el model del qual s'haurà d'aprovar per resolució de la Presidència de l'IMAS. En aquest acord d'acció concertada s'ha&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;n&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; de fer constar els continguts mínims previstos a l'article 8 de la Llei 12/2018 així com, segons l'establert a l'article 7 del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;D&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;ecret 48/2017, els drets i les obligacions recíprocs, les característiques concretes del servei, altres circumstàncies derivades de la Llei 4/2009 i dels decrets de desplegament, i del plec de condicions tècniques d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;aquesta&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; concertació. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;11. Cessió&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;D'acord amb el previst a l'article 7.4 de la Llei 12/2018 queda prohibida la cessió, total o parcial, del servei objecte de l'acord d'acció concertada. No obstant això, quan l'entitat concertada sigui declarada en concurs de creditors, l'administració pública competent podrà autoritzar la cessió amb l'adopció de les mesures necessàries per garantir la continuïtat i la qualitat del servei.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;12. Condicions tècniques d'execució&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Les condicions tècniques d'execució s'han d'ajustar al Decret 10/2013, de 28 de febrer, pel qual es fixen els principis generals del Registre Unificat de Serveis Socials de les Illes Balears i dels procediments per a l'autorització i l'acreditació de serveis socials, i es regulen la secció suprainsular del Registre i els procediments per autoritzar i acreditar serveis socials d'àmbit suprainsular, i els reglaments de desplegament vigents en el seu àmbit territorial d'actuació, així com també s'han d'ajustar a la Llei 12/2018 i al Decret 48/2017.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per altre banda, l'execució del concert social objecte d'aquesta&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; convocatòria s'ha regir pel contingut del plec de prescripcions tècniques aplicables en aquesta concertació i que s'aproven conjuntament amb &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;l&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a convocatòria. Concretament, els plecs, de conformitat amb el previst a l'article 8 del Decret 48/2017 detalla: l'objecte, la definició del servei, el calendari i horari, els serveis que s'han de prestar, els requisits dels serveis a concertar, el model d'atenció, els criteris d'intervenció amb les persones usuàries, el règim d'utilització de places i el règim econòmic, les assegurances, el nombre de places, els mitjans materials i humans que ha d'aportar l'entitat concertada, les obligacions de l'entitat concertada, el finançament del concert, la justificació, la coordinació, control i supervisió, la protecció de dades de caràcter personal i la regulació dels incompliments per part de les entitats i les penalit&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ats, així com el termini del concert.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Al respecte, l'article 9.3&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; del Decret 48/2017, de 27 &lt;span style="background-color:#ffffff"&gt;d'octubre estableix les obligacions de les entitats i determina que mitjançant el concert social, l'entitat titular del servei s'obliga a complir els plecs tècnics, així com les normes establertes en el títol VII de la Llei 4/2009 i en els corresponents decrets de desplegament i d'aplicació d'aquesta Llei.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;13. Seguiment i criteris d'accés de les persones usuàries&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Des de la D&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;irecció &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;I&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;nsular de Persones amb Discapacitat i Innovació Social es farà el seguiment tècnic del servei concertat objecte d'&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;aquesta convocatòria, de conformitat amb l'esmentat a l'article 10 de la Llei 12/2018 i a l'article 27 del Decret 48/2017 i amb els plecs tècnics.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;L'entitat concertada ha de facilitar les actuacions de seguiment i comprovació que dugui a terme la Direcció Insular de Persones amb Discapacitat i Innovació Social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;L'IMAS, a través del Servei de Persones amb Discapacitat i Innovació Social, ha de gestionar directament l'accés als serveis.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;14. Penalitats&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;L'incompliment de les condicions previstes per a la prestació del servei s'ha de penalitzar, d'acord amb el Plec de prescripcions tècniques d'aquest concert social, i amb la normativa d'aplicació.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;15. Causes d'extinció&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Els acords d'acció concertada s'extingeixen, d'acord amb el previst a l'article 9 de la Llei 12/2018, pel compliment i venciment del termini, sempre que no s'hagin renovat, o per resolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Són causes de resolució dels acords d'acció concertada les següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;a) Acord mutu de les parts, manifestat amb l'antelació de dos mesos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;b) Renúncia de l'entitat concertada, manifestada amb una antelació mínima de dos mesos per garantir la continuïtat del servei.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;c) Incompliment de les normes de caràcter obligatori a què s'han de sotmetre el servei objecte de la present concertació i de les obligacions en matèria de seguretat i instal·lacions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;d) Incompliment dels objectius qualitatius i quantitatius establerts, sempre que l'incompliment sigui imputable a l'entitat concertada, així com de les estipulacions essencials de l'acord i dels plecs de prescripcions tècniques aplicables.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;e) Prestació defectuosa de les obligacions acordades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;f) La negació a atendre les persones usuàries derivades per l'IMAS.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;g) Infracció amb caràcter greu de la legislació fiscal, laboral, de la Seguretat Social, d'integració social de persones amb discapacitat i de prevenció de risc.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;h) Pèrdua sobrevinguda dels requisits de participació a aquesta convocatòria o de les condicions tècniques, econòmiques i financeres que hagin habilitat l'acord d'acció concertada, així com la revocació o la caducitat de l'autorització d'obertura i funcionament i/o de l'acreditació del servei.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;i) Mort de la persona física titular del servei o l'extinció de la persona jurídica a la qual correspon la titularitat, excepte el que preveu l'article 29 del Decret 48/2017.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;j) Declaració de concurs de creditors de l'entitat titular del servei, a excepció del previst a l'article 7.4 de la Llei 12/2018.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;k) Modificació de les condicions tècniques o de les condicions econòmiques per part de l'Administració, sempre que l'entitat d'iniciativa privada no hi hagi donat la conformitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;l) No disponibilitat sobrevinguda del títol jurídic que acredita la titularitat del servei durant la vigència de l'acord.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#231f20"&gt;&lt;em&gt;m) Les clàusules de revocació previstes en els plecs tècnics objecte d'aquest servei.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;16. Modificació i/o ampliació de l'acord d'acció concertada&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El procediment d'ampliació de places concertades del servei objecte d'aquesta convocatòria, així com de modificació de l'esmentat concert, es duran a terme de conformitat amb l'establert als plecs de prescripcions tècniques. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;17. Jurisdicció competent&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;La jurisdicció contenciosa administrativa és la competent per resoldre les qüestions litigioses relatives a la formalització d'aquest concert i també les sorgides entre les parts sobre la interpretació, la modificació, el compliment, els efectes i l'extinció.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
