    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 20&amp;nbsp;de febrer&amp;nbsp;de 2023, va signar la següent resolució,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de dia 10 de juliol de 2015, per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016, 26 de juny de 2018, 2 de març de 2020 i 6 de maig de 2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 11/05/2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;Els interessats assenyalats a l' Annex 1, han presentat una sol·licitud de desistiment de l'ajuda.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en la transformació i la comercialització de productes agrícoles.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució&amp;nbsp;de desistiment&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;prop&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;òs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Donar per desistid&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;les sol·licituds presentades pels interessats relacionats a l'Annex I, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;que són un total de 5 expedients i que comença amb SEBASTIAN GARÍ GALMÉS i acaba amb ECO AYREFLOR SL,&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;pels motius descrits a l'esmentat annex, de la línia d'ajudes &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;“&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;&lt;em&gt;Inversions a les explotacions agràries ”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar conclòs el procediment i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;procedir a l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;arxi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;u dels&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedients&amp;nbsp;relacionats a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;conseller d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e Medi Ambient, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;els &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;article&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;21 i 122 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de la Llei 39/2015, d'1 d'octubre, &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
