    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Consell Executiu del Consell Insular de Mallorca, reunit en sessió ordinària de dia 2 de març de 2023, ha adoptat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;“Per acord del Consell Executiu de dia 16 de novembre de 2022 (BOIB núm. 153, de 24 de novembre de 2022)&amp;nbsp; es varen delegar en els consellers executius i les conselleres executives les atribucions del Consell Executiu com òrgan de contractació i d'encàrrecs de gestió a mitjans propis personificats, l'aprovació de determinats projectes d'obra, l'aprovació de les convocatòries d'ajudes i subvencions de quantia inferior a dos-cents&amp;nbsp;cinquanta mil euros i la incoació i resolució&amp;nbsp; d'expedients disciplinaris per la comissió de faltes lleus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;L'acord de delegació preveia la necessitat d'obtenir l'autorització prèvia per part del Consell Executiu en determinats contractes i convocatòries d'ajudes i subvencions. L'aplicació pràctica d'aquest acord ha comportat que es faci necessària la seva modificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Per això, proposo al Consell Executiu que adopti l'acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Primer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Delegar en els consellers executius i les conselleres executives, competents per raó de la matèria, les competències d'òrgan de contractació en tot tipus de contractes sempre que el seu valor estimat sigui inferior a &amp;nbsp;vint milions d'euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Els contractes en què el seu valor estimat sigui igual o superior a cinquanta mil euros requeriran l'autorització prèvia del Consell Executiu abans d'aprovar l'expedient de contractació; a l'efecte d'obtenir aquesta autorització serà necessari incorporar a l'expedient els documents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Justificació sobre la necessitat i idoneïtat del contracte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Certificat d'existència de crèdit. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Plec de clàusules administratives particulars. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Informe del servei jurídic al plec.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Els contractes esmentats requeriran també l'autorització prèvia del Consell Executiu per aprovar les modificacions no previstes que representin un percentatge que aïllada o conjuntament superi el 10% del preu inicial del contracte , IVA exclòs, &lt;em&gt;sempre que l'import d'aquesta modificació sigui igual o superior a &lt;/em&gt;cinquanta mil euros&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Segon.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Delegar en els consellers executius i les conselleres executives, competents per raó de la matèria, l'aprovació dels projectes d'obra amb un pressupost base de licitació inferior cinquanta mil euros, excepte que comportin l'expropiació forçosa de béns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Tercer. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Delegar en els consellers executius i les conselleres executives, competents per raó de la matèria, els encàrrecs de gestió a mitjans propis personificats. Quan l'import de la despesa dels encàrrecs &amp;nbsp;sigui igual o superior a cinquanta mil euros requeriran l'autorització prèvia del Consell Executiu abans d'aprovar-se l'expedient; a l'efecte d'obtenir l'autorització del Consell Executiu serà necessari incorporar a l'expedient els documents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Justificació sobre la necessitat i idoneïtat del contracte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Certificat d'existència de crèdit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Quart.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp; Delegar en els consellers executius i les conselleres executives, competents per raó de la matèria, l'aprovació de les convocatòries d'ajudes i subvencions i aportacions de quantia inferior a dos-cents cinquanta mil euros. En tot cas, requeriran d'autorització prèvia del Consell Executiu per l'aprovació de la despesa de les convocatòries de quantia superior a &amp;nbsp;cinquanta mil euros; a l'efecte d'obtenir l'autorització del Consell Executiu pel que fa a la convocatòria d'ajudes i subvencions serà necessari incorporar a l'expedient els documents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:#fdfdfc"&gt;&lt;span style="line-height:115%"&gt;a) Memòria justificativa on haurà de constar la següent informació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Si es regula per l'Ordenança General de Subvencions o per les seves bases específiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Tipus de convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Finalitats i objecte de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Previsió al Pla Estratègic de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Si és ampliable o no el crèdit pressupostari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:#fdfdfc"&gt;&lt;span style="line-height:115%"&gt;b) Certificat d'existència de crèdit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="background-color:#fdfdfc"&gt;&lt;span style="line-height:115%"&gt;d) Informe jurídic sobre el contingut de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Cinquè. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Delegar en els consellers executius i les conselleres executives, competents per raó de la matèria, la incoació i resolució dels expedients disciplinaris per la comissió de faltes lleus respecte al personal adscrit al seu departament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Sisè.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Disposar que els actes administratius i resolucions que es dictin en l'exercici d'aquestes delegacions, han d'assenyalar expressament aquesta circumstància i es consideraran actes del Consell Executiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Setè.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Deixar sense efectes l'acord del Consell Executiu de dia 16 de novembre de 2022 (BOIB núm. 153, de 24 de novembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Vuitè.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Publicar aquest acord en el &lt;em&gt;Butlletí Oficial de les Illes Balears, &lt;/em&gt;que començarà a vigir el mateix dia en què s'hi publiqui.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
