INTRODUCCIÓ</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.1. Consideracions prèvies</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El marc normatiu dels Plans Estratègics de Subvencions està conformat per l' article 8 de la Llei 38/2003, de 17 de novembre, general de subvencions, que estableix l'obligació de qualsevol Administració d'elaborar un Pla Estratègic de Subvencions en la concessió de subvencions i concretar en aquest Pla els objectius i efectes pretesos per aplicar-los, el termini necessari per a la consecució, els costos previsibles i les fonts de finançament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Així mateix resulten aplicables els articles 10 a 15 del Reglament general de la Llei de subvencions, aprovats pel Reial decret 887/2006, de 21 de juliol, que tracten respectivament dels principis directors, àmbit, contingut, competència per a la seva aprovació, seguiment i efectes del seu incompliment.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En virtut de la potestat de programació o planificació atribuïda a les entitats locals per l'article. 4.c) de la Llei 7/1985 RBRL, s'ha elaborat aquest Pla Estratègic, conjuntament amb totes les àrees, centres de gestió i unitats administratives responsables de la gestió de subvencions de l'Ajuntament de Sant Antoni de Portmany.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.2 Naturalesa jurídica</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El pla estratègic de subvencions es configura com un instrument de gestió de caràcter programàtic, de planificació, que no té caràcter normatiu i el seu contingut no crea drets ni obligacions, no suposa una incidència directa a l'esfera dels particulars, ni genera drets ni obligacions per l'administració.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El pla estratègic no suposa la generació de cap dret a favor dels potencials beneficiaris, que no poden exigir indemnització o compensació en cas que el Pla no es dugui a la pràctica. El Pla es presenta com una guia que, dins del marc normatiu preestablert, marca la pauta que cal seguir en la línia de foment d'activitats d'interès general.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'establiment de subvencions queda supeditat al compliment dels objectius d'estabilitat pressupostària, de manera que consignacions pressupostàries que s'aprovin i les bases reguladores de la concessió s'han d'acomodar a cada moment a aquests objectius.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.3. Competència</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'òrgan competent per a l'aprovació del present Pla Estratègic de Subvencions és el Ple Municipal, atès que es tracta d'un instrument de planificació estratègica de l'activitat subvencional o de foment i de gestió econòmica, d'acord amb el que preveu l'article 22.2.e ) de la Llei 7/1985, de 2 d'abril, de Bases de Règim Local.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'òrgan competent per concedir les subvencions serà la Junta de Govern Local, i si és el cas l'Alcalde, segons el que disposa el punt 3r B 3) Decret 2019-2034, de 12 de juliol de 2019, de designació dels membres de la Junta de Govern Local i delegació de competències.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">2. ASPECTES ESTRATÈGICS DEL PLA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2.1. El Pla estratègic de subvencions 2023</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquest Pla s'aprova per donar compliment als preceptes legals següents:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'article 8 de la Llei 38/2003 de 17 de novembre:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">«Article 8. Principis generals.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Els òrgans de les administracions públiques o qualssevol ens que proposin l'establiment de subvencions, amb caràcter previ, han de concretar en un pla estratègic de subvencions els objectius i els efectes que es pretenen amb la seva aplicació, el termini necessari per a la consecució, els costos. previsibles i les seves fonts de finançament, i en tot cas se supeditarà al compliment dels objectius d'estabilitat pressupostària.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Quan els objectius que es pretenen aconseguir afectin el mercat, la seva orientació s'ha d'adreçar a corregir errors clarament identificats i els seus efectes han de ser mínimament distorsionadors.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. La gestió de les subvencions a què es refereix aquesta llei es realitzarà d'acord amb els principis següents:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">a) Publicitat, transparència, concurrència, objectivitat, igualtat i no discriminació.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">b) Eficàcia en el compliment dels objectius fixats per l'Administració atorgant.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">c) Eficiència en l'assignació i la utilització dels recursos públics.»</span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Establir i normalitzar, per al conjunt de les diverses i diferents línies i programes de subvencions de l'Ajuntament de Sant Antoni de Portmany, un conjunt de principis i bases d'execució comuns a aquestes.</span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Millorar i racionalitzar la gestió municipal de les subvencions amb la valoració dels aspectes de transversalitat, eficàcia i eficiència en la gestió de les diferents línies de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Optimitzar l'accés dels ciutadans al fet subvencional amb garanties de transparència, uniformitat de criteri municipal i de lliure concurrència, i facilitar als ciutadans totes les dades, quanties, objectius, criteris i procediments per poder ser beneficiari de subvencions.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2.2. Principis del Pla estratègic.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Publicitat i lliure concurrència mitjançant convocatòria prèvia en la qual es garanteixi la concurrència i igualtat en la distribució de fons públics, sense perjudici de la possible concessió directa que, de conformitat amb allò que estableix la norma aplicable, haurà de comptar amb les degudes disponibilitats pressupostàries, amb caràcter previ.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Objectivitat en el procés d'assignació de fons públics. La subvenció es concedirà d'acord amb criteris objectius prèviament establerts a la convocatòria per garantir el coneixement previ d'aquests pels potencials beneficiaris.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Igualtat i no discriminació entre la ciutadania, entre els diferents sectors i entre els col·lectius.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Transparència en el procés d'assignació de recursos públics. Tant en el procés de concessió com en la publicació dels resultats.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Eficàcia en el compliment dels objectius, amb l'establiment d'un procediment de seguiment i control de les subvencions concedides.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Eficiència en l'assignació i la utilització dels recursos públics, amb la valoració de les subvencions i l'assignació als projectes més eficients.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">3. ÀMBIT SUBJECTIU</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquest Pla Estratègic de Subvencions per a l'any 2023 inclou les subvencions directes, les subvencions de concurrència no competitiva i les subvencions de concurrència competitiva que s'atorguen des de l'Ajuntament de Sant Antoni de Portmany.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">4. ÀMBIT TEMPORAL</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquest Pla Estratègic de Subvencions es proposa per a l'exercici 2023, i queda prorrogat fins a l'aprovació del Pla següent.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">5. LÍNIES BÀSIQUES DE LES BASES REGULADORES I CONVOCATÒRIES</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5.1. Objectiu</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'objectiu fonamental de l'activitat subvencional de l'Ajuntament de Sant Antoni de Portmany és impulsar, promoure i potenciar la participació de la societat en els diferents àmbits de gestió municipal d'interès concurrent, donant suport econòmic a la tasca i als projectes d'interès general desenvolupats pel teixit associatiu, així com propiciar la inclusió social dels individus mitjançant ajudes econòmiques a aquells ciutadans que es trobin en determinades situacions de vulnerabilitat social, tot això en defensa del principi d'igualtat d'oportunitats</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5.2. Principis generals</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La regulació jurídica en matèria de subvencions a l'àmbit de la Comunitat i de l'Estat estableix uns principis generals d'actuació, que són elements fonamentals del Pla Estratègic i que han de regir la gestió municipal en matèria de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Publicitat i lliure concurrència mitjançant convocatòria prèvia en la qual es garanteixi la concurrència i igualtat en la distribució de fons públics, sense perjudici de la possible concessió directa que, de conformitat amb allò que estableix la norma aplicable, haurà de comptar amb les degudes disponibilitats pressupostàries, amb caràcter previ.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Objectivitat en el procés d'assignació de fons públics. Objectius Generals del Pla Estratègic</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Són objectius generals del present Pla estratègic els següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Donar compliment al mandat legal recollit a l'art. 8.1 de la Llei 38/2003 de 17 de novembre, que obliga els ajuntaments a aprovar el corresponent Pla Estratègic, prèviament a la concessió de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Establir i normalitzar els principis i les bases d'execució comuns a totes les subvencions, incrementant els nivells d'eficàcia i eficiència en la gestió de la despesa pública subvencional.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Optimitzar l'accés dels ciutadans al fet subvencional amb garanties de transparència, uniformitat de criteri municipal i de lliure concurrència, i facilitar als ciutadans totes les dades, quanties, objectius, criteris i procediments per poder ser beneficiari de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Racionalitzar la gestió municipal de les subvencions amb la valoració dels aspectes de transversalitat, eficàcia i eficiència en la gestió de les diferents línies d'ajuts.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Impulsar la simplificació administrativa i la transparència.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5.4. Procediments de concessió</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Amb caràcter general, segons estableix l'article 22.1 de la Llei 38/2003, de 17 de novembre, general de subvencions, la concessió de les subvencions es tramitaran pel procediment de Concurrència Competitiva. No obstant això, es poden concedir subvencions directes, complint els requisits establerts a l'article 22.2 de la Llei esmentada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5.6. Termini d'execució</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Amb caràcter general, les subvencions municipals tendran un termini d'execució anual, sent el període elegible a efectes de justificació l'any natural. No obstant això, podran realitzar-se subvencions de caràcter pluriennal, si així s'aprova als pressupostos municipals, i atenent al que disposa la corresponent convocatòria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En els supòsits en què les circumstàncies facin convenient la fixació d'un termini d'execució superior a l'anual, o la modificació del període elegible, s'hauran de recollir a les convocatòries de subvencions corresponents.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5.7. Finançament</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'efectivitat de les línies d'ajudes i subvencions incloses en aquest pla quedaran condicionades a l'existència de crèdit adequat i suficient al corresponent pressupost anual.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Previ a la concessió de qualsevol tipus de subvenció es procedirà a la tramitació de l'autorització de la despesa corresponent.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Podran ser subvencionables fins al 100% del projecte o activitat subvencionada, segons s'estipuli a la corresponent convocatòria específica per a cada subvenció.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">6. CONTROL I SEGUIMENT DEL PLA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El control i el seguiment del present Pla Estratègic es realitzarà de forma anual, en dos aspectes. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Control economicofinancer de les subvencions concedides. Està encomanat a la Intervenció General de l'Ajuntament de Sant Antoni de Portmany, i es realitzarà en les condicions recollides a la legislació vigent. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Control i seguiment del Pla, s'encomana a la Junta de Govern Local, per a això, cadascuna de les Àrees, Centre de Gestió, Unitat Administrativa o Organisme dependent que gestionen les subvencions, remetrà al primer quadrimestre de cada exercici, memòria justificativa amb les següents especificacions: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Objecte, entitat beneficiària i import subvencionat. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Subvencions concedides, justificades, renunciades i reintegrades (o en procediment de reintegrament).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- El grau de compliment dels seus objectius específics, del termini de consecució, concretant el nombre de ciutadans als quals ha assolit l'acció subvencionada.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Els costos efectius en relació amb els previsibles. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Conclusions o valoració global en la qual consti la valoració quant als objectius perseguits i la procedència del manteniment o supressió del programa.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">- Suggeriments per a l'elaboració del següent Pla Estratègic de Subvencions.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">7. TÍTOLS COMPETENCIALS</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Els títols competencials que consten en aquest Pla s'han d'entendre condicionats en tot cas, per l'habilitació que estableixi finalment el desenvolupament reglamentari de la Llei 27/2013, de 27 de desembre, de racionalització i sostenibilitat de l'Administració local, així com de la legislació autonòmica de desenvolupament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">A aquest efecte, cal tenir en compte el que estableix la Llei 7/1985 RBRL.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">8. TRANSPARÈNCIA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Totes les subvencions concedides per l'Ajuntament, seran publicades anualment al Portal de Transparència de la Seu Electrònica municipal, indicant l'entitat receptora, quantia de la mateixa, projecte o acció a què va destinada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En el termini màxim d'un mes, una vegada concedides les subvencions per l'Ajuntament de Sant Antoni de Portmany, es procedirà a la publicació, havent de en tot cas de constar-hi la subvenció a final dany.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">9. REFORMULACIÓ DE SOL·LICITUDS</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Quan la subvenció tengui per objecte el finançament d'activitats a desenvolupar pel sol·licitant i l'import a concedir sigui inferior a l'import sol·licitat, es podrà instar el sol·licitant, si així s'ha previst a la convocatòria, a reformular la seva petició per ajustar els compromisos i condicions a la subvenció atorgable.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En tot cas, la reformulació de sol·licituds haurà de respectar l'objecte, les condicions i la finalitat de la subvenció, així com els criteris de valoració establerts.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
