&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Mitjançant l'Acord del Consell d'Administració de Serveis Ferroviaris de Mallorca (d'ara endavant, SFM) de 20 de maig de 2022, es va aprovar l'oferta pública d'estabilització corresponent al personal laboral d'SFM, en el marc de la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat en l'ocupació pública (BOIB núm. 68, de 26 de maig de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Mitjançant l'Acord adoptat pel Consell d'Administració d'SFM de 14 de desembre de 2022, es va aprovar la convocatòria del procés excepcional d'estabilització per concurs extraordinari de mèrits per cobrir les places de personal laboral d'SFM (BOIB núm. 169, de 29 de desembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;D'acord amb la base 19.2 de l'annex 2 d'aquesta convocatòria sobre nomenament dels membres dels tribunals, l'òrgan que convoca el procés selectiu els ha de nomenar, tenen la consideració d'òrgans dependents de la seva autoritat i el nomenament s'ha de publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i la pàgina web &lt;span style="color:null"&gt;&lt;em&gt;https://trensfm.convoca.online&lt;/em&gt;, u&lt;/span&gt;n cop finalitzat el període de presentació d'instàncies.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A més d'això, d'acord amb la base 19.1.2 sobre la composició dels òrgans de selecció, els tribunals han d'estar constituïts, com a mínim, per tres membres titulars, amb el mateix nombre de suplents, i s'ha de constituir un tribunal per a cada grup dels que preveu l'article 29 del Conveni Col·lectiu d'SFM.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Tots els membres dels tribunals han de tenir una titulació acadèmica de nivell igual o superior a l'exigit als aspirants per a l'ingrés.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Així mateix, la base 19.1.3 estableix que la determinació de la composició dels tribunals s'ha de dur a terme d'acord amb les normes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a) &lt;/em&gt;Els òrgans de selecció de cada grup professional han d'estar constituïts per un president o presidenta, dos membres designats pel Consell d'Administració de Serveis Ferroviaris de Mallorca, i per dos treballadors fixos de Serveis Ferroviaris de Mallorca elegits per sorteig de la categoria professional igual o superior a la del lloc de treball de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el cas que no hi hagi treballadors suficients d'SFM d'algun grup professional, els ha de designar el Consell d'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b) &lt;/em&gt;L'òrgan que convoca el procés selectiu ha de designar lliurement el president.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c) &lt;/em&gt;Els vocals han de ser nomenats per sorteig entre el personal laboral que presta serveis a l'ens que pertanyi al grup de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d) &lt;/em&gt;El sorteig s'ha de fer amb la participació del Comitè d'Empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e) &lt;/em&gt;La secretaria correspon a la persona designada per votació del Tribunal entre les persones designades com a vocals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La composició dels òrgans de selecció s'ha d'ajustar, llevat de raons fonamentades i objectives, motivades degudament, al criteri de paritat entre homes i dones, amb capacitació, competència i preparació adequades. S'entén per representació equilibrada la presència de dones i homes de manera que cap sexe no superi el 60&amp;nbsp;% del conjunt de persones a què es refereix ni sigui inferior al 40&amp;nbsp;%.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. En data 13 de febrer de 2023 va finalitzar el període de presentació d'instàncies en aquest procés.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. A la reunió de Comitè d'Empresa de 14 de febrer de 2023 es va dur a terme el sorteig dels membres dels diferents tribunals qualificadors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot això&lt;span style="color:black"&gt;, en exercici de les facultats conferides a l'article 15.1.&lt;em&gt;c)&lt;/em&gt; dels Estatuts d'SFM, aprovats pel Decret 44/2015, de 22 de maig (BOIB núm. 77, de 23 de maig), dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Nomenar els membres de cada un dels tribunals qualificadors del procés selectiu del personal laboral d'SFM dels diferents grups professionals, en els termes que estableix l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Informar les persones nomenades de l'obligació d'abstenir-se d'intervenir en el procés selectiu si concorren alguna de les circumstàncies que preveu l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, i el punt 19.1.4 de les bases específiques de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Facultar el director i gerent de Serveis Ferroviaris de Mallorca per fer tots els tràmits necessaris per dur a terme el nomenament dels membres dels diferents tribunals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; i a la pàgina web &lt;span style="color:null"&gt;&lt;em&gt;https://trensfm.convoca.online.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Donar compte d'aquesta Resolució al Consell d'Administració en la propera sessió, a efectes de la ratificació d'acord amb l'article 15.1.&lt;em&gt;c)&lt;/em&gt; dels Estatuts d'SFM.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el Consell d'Administració de Serveis Ferroviaris de Mallorca en el termini d'un mes comptador des de l'endemà de la publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma, en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb el que disposen els articles 8.2.&lt;em&gt;a) &lt;/em&gt;i 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
