    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Es publica la resolució del conseller executiu d'Hisenda i Funció Pública, per delegació del Consell Executiu, segons l'acord de 28 de setembre de 2022, BOIB núm. 128, d'1 d'octubre de 2022, de conformitat amb el que disposa l'article 45.1 b) de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;«Antecedents&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.Mitjançant l'acord del Consell Executiu del Consell Insular de Mallorca de 18 de maig de 2022 (BOIB núm. 66, de 21 de maig de 2022), rectificat per l'acord del Consell Executiu del Consell Insular de Mallorca de 24 d'agost de 2022 (BOIB núm. 113, de 27 d'agost de 2022), i que també ha resultat modificat per l'Acord de la Comissió de Govern de 28 de juliol de 2022, de resolució de recurs d'alçada (BOIB núm. 107, de 13 d'agost de 2022), es va aprovar l'oferta d'ocupació pública del Consell Insular de Mallorca i de l'Agència de Defensa del Territori derivada de la taxa addicional per a l'estabilització de l'ocupació temporal de l'article 2 i les disposicions addicionals sisena i vuitena de la Llei 20/2021 de 28 de desembre, de mesures urgents per a la reducció de la temporalitat en l'ocupació pública. S'incorporen a aquesta oferta d'ocupació pública les places corresponents a la taxa addicional per a l'estabilització de l'ocupació temporal incloses a les ofertes d'ocupació pública del Consell Insular de Mallorca i de l'Agència de Defensa del Territori dels anys 2017 i 2019 aprovades pels acords del Consell Executiu de 29 de novembre de 2017 i de 18 de desembre de 2019, les quals no han estat objecte de convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Mitjançant la Resolució del conseller executiu d'Hisenda i Funció Pública, de 27 d'octubre de 2022, es va aprovar la convocatòria del procés selectiu d'estabilització pel sistema de concurs oposició per cobrir les places de personal funcionari de les escales, subescales, classes i categories (o especialitats) d'administració general i especial dels subgrups A1, A2 i grup B derivada de l'oferta d'ocupació pública extraordinària del Consell de Mallorca i de l'Agència de Defensa del Territori per a l'any 2022 i acumulades de 2017 i de 2019 (BOIB núm. 140, de 29 d'octubre de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. D'acord amb la Base 6, Òrgans de selecció, de l'Annex II, Bases específiques, de la convocatòria, el conseller executiu d'Hisenda i Funció Pública ha de nomenar els tribunals encarregats de la selecció, els quals tenen la consideració d'òrgans dependents de la seva autoritat.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Conformement amb l'esmentada Base 6, s'ha de designar un tribunal qualificador per a les places de cada subgrup o grup de titulació d'administració general i un tribunal qualificador per a les places de cada subgrup o grup de titulació d'administració especial, d'acord amb els criteris següents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Han d'estar constituïts, com a mínim, per cinc membres titulars, i el mateix nombre de suplents. En el cas que resulti impossible la constitució dels tribunals qualificadors amb cinc membres titulars i cinc suplents per la manca de funcionaris de carrera, es podran constituir amb un president i dos vocals, un dels quals ha de fer les funcions de secretari, i el mateix nombre de suplents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El president o presidenta, i els vocals, un dels quals actuarà com a secretari o secretària, han de ser nomenats pel conseller executiu d'Hisenda i Funció Pública entre el personal funcionari de carrera del Consell de Mallorca o dels seus organismes autònoms.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- La composició s'ha d'ajustar, llevat de raons fundades i objectives, degudament motivades, al criteri de paritat entre homes i dones, amb capacitació, competència i preparació adequades. Es considera que hi ha una representació equilibrada quan en els òrgans de més de quatre membres cada sexe està representat almenys en un 40 %; en la resta, quan els dos sexes estiguin representats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Tots els membres dels tribunals han de posseir una titulació acadèmica d'igual o superior nivell que l'exigit als aspirants per a l'ingrés. Per als tribunals qualificadors d'administració especial al manco un dels membres ha de posseir una titulació corresponent a alguna de les àrees de coneixement de les especialitats que es convoquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. De conformitat amb l'apartat 1 de l'article 13 del Decret 27/1994, el nomenament dels membres dels tribunals s'ha de publicar en el Butlletí Oficial de les Illes Balears i en la Seu Electrònica del Consell de Mallorca un cop finalitzat el termini de presentació d'instàncies.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Nomenar els Tribunals Qualificadors del procés selectiu d'estabilització pel sistema de concurs oposició per cobrir les places de personal funcionari de les escales, subescales, classes i categories (o especialitats) d'administració general i especial dels subgrups A1, A2 i grup B derivada de l'oferta d'ocupació pública extraordinària del Consell de Mallorca i de l'Agència de Defensa del Territori per a l'any 2022 i acumulades de 2017 i de 2019, els quals estan constituïts pels membres que figuren en l'annex d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears, a la Seu Electrònica i en el tauler d'edictes electrònic del Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Notificar aquesta Resolució a les persones nomenades, fent-los saber que la condició de membre del Tribunal Qualificador i la consegüent obligació d'assistència a les sessions constitueix un deure del personal funcionari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra aquest acte de tràmit, no hi escau cap recurs administratiu, tot i que la persona interessada pot al·legar la seva oposició per a la seva consideració en la resolució que posi fi al procediment. No obstant això, si s'estima que concorre alguna de les circumstàncies assenyalades a l'article 112.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, cap interposar el recurs administratiu que procedeixi, fonamentat en qualsevol dels motius de nul·litat o anul·labilitat previstos legalment&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
