&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. En data 22 de juliol de 2022, el president de l'Institut d'Indústries Culturals de les Illes Balears (ICIB) va dictar la Resolució per la qual s'aprova la convocatòria pública de subvencions per donar suport a les sales d'exhibició cinematogràfica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència (finançat per la Unió Europea – Next&amp;nbsp;Generation&amp;nbsp;EU) (BOIB núm. 98, de 28 de juliol de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Durant el termini de presentació de sol·licituds per optar a les subvencions esmentades, l'ICIB va rebre &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;set&lt;span style="color:#ce181e"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. La Comissió Avaluadora que preveu l'apartat 12 de la convocatòria es va reunir el dia 20 de desembre de 2022 per examinar les sol·licituds presentades i per emetre l'informe que va servir de base per a la Proposta de resolució de la directora de l'ICIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. En data 23 de gener de 2023 es va publicar a la Seu Electrònica de la CAIB la Proposta de resolució de la convocatòria, a fi que les persones interessades poguessin formular-hi al·legacions. Es varen rebre dues al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Dins el termini establert, es varen presentar les al·legacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.1. Al·legació en relació amb l'expedient SALESCINE 1/2022, en què se sol·licita que es modifiqui l'import concedit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.2. Al·legació en relació amb l'expedient SALESCINE 3/2022, en què&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;s'&lt;/span&gt;&lt;span style="color:#000000"&gt;expos&lt;/span&gt;&lt;span style="color:#000000"&gt;a que varen presentar la documentació sol·licitada i, per tant, sol·liciten ser admesos i que s'emeti una nova resolució de concessió a favor de Cinesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Pel que fa a les al·legacions a la Proposta de resolució de la convocatòria, es determina:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.1. Estimar l'al·legació presentada en relació amb l'expedient SALESCINE 1/2022: es rectifica l'import concedit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.2. Desestimar l'al·legació en relació amb l'expedient SALESCINE 3/2022, tenint en compte que, amb&lt;/span&gt;&lt;span style="color:#000000"&gt; la documentació &lt;/span&gt;&lt;span style="color:#000000"&gt;presentada durant el període de presentació de sol·licituds i posteriorment, com a resposta al requeriment &lt;/span&gt;&lt;span style="color:#000000"&gt;f&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;t per part de l'ICIB,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;es confirma que &lt;/span&gt;&lt;span style="color:#000000"&gt;el sol·licitant no compleix els requisits &lt;/span&gt;&lt;span style="color:#000000"&gt;que&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;estipul&lt;/span&gt;&lt;span style="color:#000000"&gt;en les bases de la convocatòria&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;l'apartat 4.2 &lt;/span&gt;&lt;span style="color:#000000"&gt;i que, tal com s'indica &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; l'apartat 4.5,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;«s'han de complir des del moment que es presenta la sol·licitud i s'han de mantenir fins a la finalització i la justificació de l'activitat objecte de la subvenció». A més, cal tenir en consideració que no és procedent acceptar l'aportació de la nova documentació presentada juntament amb l'escrit d'al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. El personal de l'ICIB ha comprovat que les entitats beneficiàries compleixen els requisits que la normativa estableix per poder rebre subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Ordre HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Ordre HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i el format de la informació que han de proporcionar les entitats del sector públic estatal, autonòmic i local per al seguiment del compliment de les fites i els objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Ordre de la consellera d'Educació i Cultura d'1 de juliol de 2009 per la qual s'estableixen les bases reguladores de les subvencions en matèria d'educació i cultura (BOIB núm. 100, d'11 de juliol de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Decret 11/2021, de 15 de febrer, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Decret 50/2018, de 21 de desembre, pel qual s'aproven els Estatuts de l'Institut d'Indústries Culturals de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;—&lt;/span&gt; Resolució del president de l'ICIB de 22 de juliol de 2022 per la qual es convoca la concessió de subvencions per donar suport a les sales d'exhibició &lt;span style="background-color:#ffffff"&gt;cinematogràfica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència (finançat per la Unió Europea - Next&amp;nbsp;Generation&amp;nbsp;EU) &lt;/span&gt;(BOIB núm. 98, de 28 de juliol de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. &lt;span style="color:#000000"&gt;Aprovar la concessió de subvencions per l'import total de&lt;span style="color:#000000"&gt; &lt;/span&gt;172.200,00&amp;nbsp;euros a favor dels beneficiaris i d'acord amb el concepte i l'import que consten en l'annex&amp;nbsp;1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Autoritzar i disposar la despesa indicada per a cadascun dels beneficiaris amb càrrec al capítol 7 del pressupost&lt;span style="color:#000000"&gt; de l'ICIB per a l'any 202&lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt; i provinent del &lt;span style="background-color:#ffffff"&gt;Pla de Recuperació, Transformació i Resiliència (finançat per la Unió Europea - Next&amp;nbsp;Generation&amp;nbsp;EU), &lt;/span&gt;amb els imports que es detallen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. Excloure de la concessió de subvencions les sol·licituds que s'indiquen en l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Establir que els beneficiaris estan obligats a complir el que disposa l'apartat 21 de la Resolució del president de l'ICIB de 22 de juliol de 2022&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Informar els beneficiaris que la subvenció s'ha de justificar i pagar d'acord amb el que disposen els apartats 18 i 19 de la Resolució del president de l'ICIB de 22 de juliol de 2022 per la qual es convoca &lt;span style="background-color:#ffffff"&gt;la concessió de subvencions per donar suport a les sales d'exhibició cinematogràfica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència (finançat per la Unió Europea - Next&amp;nbsp;Generation&amp;nbsp;EU) (BOIB núm. &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;98&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;, de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;28&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;juliol de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;6. Publicar aquesta Resolució en el&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;Contra aquesta Resolució, que no exhaureix la via administrativa, es pot interposar un recurs d'alçada davant el president de l'ICIB, en el termini d'un mes comptador a partir de l'endemà d'haver-se publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 58 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
