&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Per la present, i en exercici de la competència pròpia de desenvolupament econòmic local que té encomanada l'Ajuntament de Deià, d'acord amb allò que disposa l'article 29.2 t de la Llei 20/2006,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Convocar les Ajudes de l'Ajuntament de Deià destinades a autònoms i PIMEs per a promoure la desestacionalització i la diversificació econòmica, a més de la promoció de la seva digitalització, amb la seva publicació al Butlletí Oficial de les Illes Balears, a més del taulell d'anuncis, la pàgina web i les xarxes socials de l'Ajuntament de Deià. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Convocatòria de 2023&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PRIMERA.- OBJECTE DE LA SUBVENCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Amb aquesta subvenció es pretén atorgar ajuda a les empreses i autònoms de Deià per a promoure la desestacionalització i diversificació econòmica, a més de la promoció de la seva digitalització.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;S&lt;span style="color:black"&gt;EGONA.- RÈGIM JURÍDIC&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;L'Ajuntament de Deià té, com a competència pròpia, la de desenvolupament econòmic local, d'acord amb allò que disposa l'article 29.2 t de la Llei 20/2006.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La concessió de la present subvenció està sotmesa a allò disposat al Reglament municipal regulador de Subvencions, adoptat en sessió plenària del dia 10 de novembre de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Així mateix, serà aplicable la Llei 38/2003, de 17 de novembre, General de Subvencions; el Reglament de la Llei 38/2003, de 17 de novembre, General de Subvencions, els arts. 25&amp;nbsp; i 72 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local i el Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions de la CAIB. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;TERCERA.- CRÈDITS PRESSUPOSTARIS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Aquesta convocatòria de subvencions compta amb el pressupost màxim següent: &lt;strong&gt;8.000 euros.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Les obligacions econòmiques derivades de la concessió de subvencions d'aquesta convocatòria van a càrrec de l'aplicació pressupostària 479.00/430 &lt;em&gt;Ajudes dinamització, desestacionalització i diversificació econòmiques &lt;/em&gt;del pressupost d'aquest Ajuntament per a l'any 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;QUARTA.- LÍNIES D'AJUTS I QUANTIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A) AJUDES A LA DESESTACIONALITZACIÓ&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Hi poden optar aquells autònoms o empreses que hagin desenvolupat o desenvolupin la seva activitat durant els mesos de gener, febrer i març de 2023 rebran 150€ per cadascun d'aquests mesos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Per a considerar que s'ha tengut activitat durant aquests mesos, s'haurà de demostrar&amp;nbsp; que almenys ha existit durant el 60% dels dies laborables (o de la seva proporció), quedant-ne excepcionats els períodes de baixa mèdica en cas d'autònoms.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La quantitat màxima a atorgar per aquesta línia serà de 5.000€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B) AJUDES A LA DIVERSIFICACIÓ&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Hi poden optar aquells autònoms o empreses que desenvolupin activitats econòmiques que no tenguin a veure amb el turisme, el comerç, la construcció, les transaccions immobiliàries, el transport, la jardineria o qualsevol altra que en pugui ser considerada anàloga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En aquest cas, les empreses preexistents rebran una ajuda de 300€, i les que es posin en marxa durant el 2023 de 500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La quantitat màxima a atorgar per aquesta línia serà de 1.500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C) AJUDES A LA DIGITALITZACIÓ&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Hi poden optar aquells autònoms o empreses que creïn una pàgina web, una aplicació o qualsevol altra eina digital per al desenvolupament de la seva activitat. Les empreses que les desenvolupin durant el 2023 rebran 500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La informació que surti a aquestes eines digitals ha de constar, almenys, en català.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Les empreses que ja tenguin una pàgina web, una aplicació o qualsevol altra eina digital que no estigui en català i la hi tradueixin durant el 2023 rebran 150€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La quantitat màxima a atorgar per aquesta línia serà de 1.500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;CINQUENA.- EN CAS DE TENIR UN NÚMERO DE SOL·LICITUDS MAJOR O MENOR DE LES QUE ES PODREN ATENDRE SEGONS LA PREVISIÓ DE LA BASE QUARTA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Si les sol·licituds vàlides amb dret a rebre la subvenció superassin la suma total de les ajudes, la Comissió Avaluadora podrà formular, amb l'objectiu d'atendre totes les sol·licituds presentades que compleixin els requisits, una Proposta de Resolució que inclogui el prorrateig proporcional entre totes elles. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;En cas de que hi hagués pressupost suficient per a atendre a totes&amp;nbsp;&lt;/span&gt;&lt;/span&gt;les sol·licituds vàlides i, a més, existís un quantitat sobrant, la Comissió Avaluadora&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;podrà proposar una Proposta de Resolució que inclogui un augment proporcional i equitatiu de les quantitats a percebre a totes les línies (prioritzant, si n'hi hagués, les deficitàries).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;SISENA.- BENEFICIARIS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Podran ésser beneficiaris d'aquestes ajudes, en els termes i requisits que estableixen aquestes bases:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Els treballadors autònoms.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Les societats de responsabilitat limitada, les societats anònimes, les societats comandatàries, les societats col·lectives, les societats laborals i les societats cooperatives.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Tots ells hauran de complir amb els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- No superar els 25 treballadors (en la totalitat de la seva activitat, no únicament en la que desenvolupin al municipi de Deià).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Desenvolupar la seva activitat en el municipi de Deià mitjançant establiment físic i/o tenir el seu domicili social i fiscal a Deià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Trobar-se al corrent de les seves obligacions tributàries i amb la Seguretat Social, incloses les de la Hisenda Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- No trobar-se incurs en cap de les prohibicions previstes als apartats 2 i 3 de l'art. 13 de la Llei 38/2003, de 17 de novembre, General de Subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;SETENA.- TERMINIS DE LA CONVOCATÒRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El termini de presentació de les sol·licituds serà el que s'indica a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La presentació de la sol·licitud, juntament amb la documentació exigida, serà a partir de l'endemà de la publicació d'aquestes bases al BOIB i fins al 10 de març de 2023 per a la LÍNIA A i fins al 15 de novembre de 2023 per a les LÍNIA B i LÍNIA C. En cas que el darrer dia sigui inhàbil, el termini es prorrogarà fins al següent dia hàbil.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La presentació de la sol·licitud de subvenció fora del termini establert i la falta de presentació de la documentació exigida a aquestes bases, serà causa d'inadmissió. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;VUITENA.- COMISSIÓ AVALUADORA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La Comissió Avaluadora estarà formada per la batlia i la secretaria-intervenció de l'Ajuntament de Deià. &lt;strong&gt;&amp;nbsp;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;NOVENA.- PROCEDIMENT I RESOLUCIÓ &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La subvenció es concedirà a les sol·licituds que reuneixin tots els requisits establerts en les presents bases que regeixen la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Una vegada finalitzat el termini de presentació, la Comissió Avaluadora comprovarà les sol·licituds i requerirà les esmenes o la resolució de qualssevol dubtes que li sorgeixin respecte de les sol·licituds presentades. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Si de l'examen de la sol·licitud per la Comissió Avaluadora es comprova&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;que no reuneix els requisits establerts en l'article 66 de la Llei 39/2015, d'1 d'octubre,&amp;nbsp;del Procediment Administratiu Comú de les Administracions Públiques, i/o&amp;nbsp;que no aporta la totalitat de la documentació requerida en aquesta Convocatòria, es requerirà, sobre la base de l'art. 23.5 de la Llei 38/2003, de 17 de novembre, General de Subvencions, a l'Entitat sol·licitant, o si escau la designada com a responsable, perquè esmeni la falta o aportació els documents preceptius, en un termini de &lt;strong&gt;deu&amp;nbsp;dies hàbils&lt;/strong&gt; comptats a partir de l'endemà al requeriment, amb la indicació que, si així no ho fes, se li tendrà per desistida de la seva petició, prèvia Resolució que&amp;nbsp;haurà de ser dictada en els termes previstos en l'article 21 de la Llei 39/2015, d'1&amp;nbsp;&lt;span style="line-height:115%"&gt;d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A més, es realitzaran d'ofici quantes actuacions s'estimin necessàries i convenients&amp;nbsp;&lt;/span&gt;per a la determinació, coneixement i comprovació de les dades que figuren&amp;nbsp;&lt;span style="line-height:115%"&gt;en les sol·licituds en virtut de les quals s'hauran de valorar les mateixes per a la resolució de l'expedient de concessió d'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Transcorregut el termini dels deu dies hàbils per a esmenar o aportar nova documentació, la Comissió Avaluadora, un cop comprovat quines sol·licituds reuneixen els requisits establerts a la present convocatòria, elevarà informe a l'òrgan competent per a la seva resolució i que correspon al Batle.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El termini màxim per a resoldre i notificar l'acord serà de dos mesos des de la finalització del termini de presentació de les sol·licituds. Aquest acord posarà fi a la via administrativa i es podrà interposar contra dita resolució recurs potestatiu de reposició en el termini d'un mes, davant el mateix òrgan que hagi dictat la resolució, o bé &lt;span style="color:black"&gt;recórrer directament davant la jurisdicció contenciosa-administrativa en la forma i terminis establerts a la Llei reguladora de la jurisdicció contenciosa-administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;Té coneixement de la normativa aplicable a l'Ajuntament de Deià en matèria de subvencions i les obligacions del beneficiari d'aquestes i en especial les assenyalades en l'article 14 de la Llei 38/2003, i que n'acata l'estricte compliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;No es troba sotmesa a cap de les causes de prohibició de l'obtenció de la consideració de beneficiari assenyalades en l‘article 13 punts 2 i 3 de la Llei 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;El/la sol.licitant no té pendent de justificar cap subvenció fora de termini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;No ha sol·licitat o rebut qualsevol altra subvenció per a la mateixa finalitat. En cas d'haver-ne sol·licitada o rebuda alguna, cal indicar-ne la quantia i l'entitat a la qual s'ha sol·licitat o de la qual s'ha rebut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
