L'objecte d'aquesta convocatòria és la concessió d'ajuts individuals, temporals i d'emergència social de l'Ajuntament des Migjorn Gran per a l'any 2023.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Tenen la consideració d'ajuts econòmics individuals, temporals i d'emergència social aquelles prestacions econòmiques, de caràcter no periòdic, que es concedeixen de manera puntual a un/una ciutadà/ciutadana o a una família per tal de donar resposta a una situació de necessitat, i que habitualment serveixen per a la consecució d'uns objectius prèviament definits en un pla d'intervenció pels Serveis Socials.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Finalitat. L'ajut es concep com una eina més per aconseguir els objectius definits pels serveis socials envers la persona o família destinatària, i no com un fi en si mateix. Per aquest motiu, l'ajut formarà part d'un pla d'intervenció mitjançant el qual pugui evitar un retrocés en els objectius aconseguits o una pèrdua greu de la qualitat de vida dels membres del nucli familiar.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 2. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Import dels ajuts. Finançament.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Els ajuts seran atesos amb càrrec a l'aplicació pressupostària 321-48000 del Pressupost General de 2023, amb un import màxim conjunt de 3.000 euros. <span style="color:#000000">E</span>n el cas que es rebi una subvenció per aquest concepte i l'Ajuntament hi aporti més fons, aquest límit es podrà ampliar, prèvia publicació en el Butlletí Oficial de Les Illes Balears.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Quan l'import de les sol·licituds d'ajuts sigui superior a la quantitat màxima fixada a la convocatòria, es prioritzaran les sol·licituds en funció dels criteris objectius per a la concessió dels ajuts establerts en les presents bases, segons els principis i criteris continguts en l'article 8.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Es procurarà, sempre que sigui possible, que el sol·licitant cofinanci part de l'objecte o del servei al qual va destinat l'ajut.</span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 3. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Règim de compatibilitat dels ajuts.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Els ajuts que s'atorguin de conformitat a aquestes bases seran compatibles amb la concessió d'altres ajuts, sens perjudici de l'obligació de les entitats beneficiàries de comunicar-ho a aquest ajuntament en la forma establerta en aquestes bases.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. L'import de les subvencions o ajuts que es concedeixen no pot superar, en cap cas, de manera aïllada o amb concurrència amb altres ajuts, el cost de les activitats subvencionades.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 4. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Beneficiaris dels ajuts.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Poden prendre part en aquesta convocatòria aquelles persones que:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Estiguin empadronades en el municipi des Migjorn Gran.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Siguin majors de 18 anys, o bé menors amb càrregues familiars.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) No disposin d'ingressos per atendre la situació de necessitat o d'emergència.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) No estiguin sotmeses a les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari de les subvencions públiques recollides en els apartats a), d), f), g), h) recollides en l'article 13.2 de la LGS.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) No estiguin sotmeses a les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari de les subvencions públiques recollides en l'article 13.3 de la LGS.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. L'escassetat d'ingressos econòmics dels beneficiaris s'avaluarà d'acord als següents criteris:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Si la unitat familiar està formada per un sol membre, els ingressos mensuals no poden superar el 130% de l'IPREM (14 pagues). Per a l'any 2023, aquesta quantitat queda fixada en <span style="color:#000000">8</span><span style="color:#000000">78,18</span> euros mensuals.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Per unitats familiars amb més membres s'incrementarà un 30% pel segon membre, un 20 % pel tercer i un 10% a partir del quart membre, tots ells sobre el barem de l'importa màxim d'ingressos segons recull la taula següent: </span></span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="color:#000000">c) Per tal de calcular els ingressos econòmics de la unitat de convivència es farà la mitjana dels ingressos obtinguts en els darrers sis mesos anteriors a la data de la sol·licitud.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Excepcionalment, si no es compleix algun dels requisits anteriors, però des de la unitat de treball social es considera justificada la situació de necessitat, podrà concedir-se un ajut. Hi haurà especial consideració en els casos de sol·licituds per emergència social o per motius sociosanitaris en què la necessitat de dur a terme una inversió important i imprescindible superi la capacitat econòmica del sol·licitant. En qualsevol cas, les excepcions han d'estar degudament justificades amb els informes tècnics i/o mèdics que corresponguin en cada cas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. En el cas de l'existència d'estalvis en la unitat de convivència, els estalvis no poden superar el 100% de l'IPREM, és a dir <span style="color:#000000">8.106,28€.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 5. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Condicions específiques segons el tipus d'ajut.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5.1. Ajuts per a habitatge</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>a) Lloguers</strong></span><strong> i quotes puntuals d'hipoteca</strong>: es pot concedir un ajut amb un import màxim equivalent a 3 mensualitats, ja sigui en concepte de lloguer o com a dipòsit, fiança o mensualitat d'hipoteca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>b) Equipament de la llar:</strong> petits electrodomèstics i estris bàsics i necessaris de l'habitatge. Fins a un<span style="color:#000000"> màxim de 500 euros.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>c) Manteniment de la llar i subministraments:</strong> petites obres i reparacions per tal de millorar les condicions de l'habitatge i pagament de subministraments. Fins a un màxim de 600 euros.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>d) Inspeccions tècniques obligatòries d'immobles: </strong>fins a un màxim d'un 75% de l'import de la inspecció per antiguitat d'edificis.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>e) Pagament de pensions/hostals:</strong> atesa la temporalitat de la situació, es pagarà com a màxim l'import de dos mesos d'estada, sempre que s'hagin esgotat altres vies com cases d'acollida o altres recursos disponibles.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En tots els casos d'ajuts per habitatge ha de quedar acreditat que no s'han pogut acollir a les ajudes per arrendament, ni a les de renda bàsica d'emancipació per a joves ni a les de rehabilitació del Govern de les Illes Balears o altres ajuts que convoquin l'Administració local o autonòmica durant el període de sol·licitud de les ajudes regulades en aquestes bases.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5.2. Ajuts per a manutenció</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>a) Bolquers i llet per a nadons:</strong> per a un període màxim de 6 mesos i per una quantia màxima de 180 euros per mes i fillet/a.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>b) Pagament de menús:</strong> per un període màxim d'un mes i per una quantia màxima de 180 euros per persona, sempre que no sigui possible o s'hagin esgotat altres vies, com menjadors socials, cases d'acollida, etc.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>c) Manutenció en general:</strong> per a les unitats familiars que, per circumstàncies puntuals, no compten amb ingressos econòmics suficients per cobrir les necessitats bàsiques d'alimentació de tots els seus membres. Per un període màxim de 6 mesos i per una quantia màxima de 180 euros per mes i persona. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>5</strong></span><strong>.3. A més dels ingressos econòmics, es valorarà especialment la necessitat educativa i social de gaudir del servei de menjador escolar.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>d) Menjadors infantils d'activitats estiu: </strong>fins a un màxim del 100% de la despesa. A més dels ingressos econòmics, es valorarà especialment la necessitat educativa i social de gaudir del servei de menjador.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>e) Pagament d'activitats extraescolars i de lleure durant el període lectiu:</strong> fins a un màxim del 75% del cost total anual. A més dels ingressos econòmics, es valorarà especialment la necessitat educativa i social de gaudir d'aquestes activitats. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>f) Pagament d'activitats extraescolars i de lleure durant l'estiu: </strong>fins a un màxim del 100&nbsp;% del cost total anual. A més dels ingressos econòmics, es valorarà especialment la necessitat educativa i social de gaudir d'aquestes activitats. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>g) Pagament de transport escolar:</strong> fins a un màxim del 75&nbsp;% del cost total anual. Així mateix, en els casos que no puguin acollir-se a transport escolar organitzat, es pot subvencionar el cost de la targeta de transport del Consell Insular. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Excepcionalment, en el cas dels ajuts per necessitats educatives, quan es donin circumstàncies en què sigui necessari prioritzar el benestar i l'atenció del menor, es poden superar els màxims previstos en els apartats anteriors. En qualsevol cas, les excepcions han d'estar degudament<span style="color:#000000"><strong> </strong></span>justificades amb els informes tècnics corresponents.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5.4. Ajuts per a inserció social i laboral</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Pagament puntual d'<strong>ajuts per a l'assistència a accions formatives</strong> per a les persones amb especials dificultats d'inserció social i laboral que no es puguin acollir a altres tipus de beques, ajuts o prestacions, i sempre que es valori que l'ajut és imprescindible per les circumstàncies del cas (<span style="color:#000000">amb un màxim de 12 euros/dia).</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>b) Ajudes per a transport </strong>per afavorir la inserció social i laboral per a les persones que assisteixen a una acció formativa i que viuen fora del municipi on s'imparteix. Es valorarà la possibilitat de finançar una part de la targeta de transport corresponent o, de forma excepcional, en els casos en què no sigui possible el transport públic, finançar fins a un màxim de<span style="color:#000000"> 0,21 €/km.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>c) Ajuts puntuals per desplaçaments</strong> <strong>per</strong> <strong>inserció social</strong> per a les persones que no compten amb recursos econòmics suficients per poder atendre les despeses de desplaçament que siguin imprescindibles per afavorir-ne la inserció social (desplaçaments per tramitació de documentació, assistència a judicis, permisos i visites penitenciaries, etc.).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>d) Ajuts puntuals per a la</strong> <strong>guarda del fills</strong>, per a les situacions en què la seva atenció dificulti la inserció laboral, sempre que no hi hagi altres alternatives, recursos o ajuts.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5.5. Ajuts per motius sociosanitaris</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>a) Ajudes tècniques</strong>: per a aparells com audiòfons, ulleres, cadires de rodes, faixes ortopèdiques, pròtesis, matalassos antiescares, adaptació de vehicles, etc. Se'n finançarà com a màxim el 75&nbsp;% del cost total. Per tal de fixar el tant per cent que es finançarà es valorarà, a més de la capacitat econòmica de la unitat de convivència, que el model sol·licitat s'adeqüi a la prescripció feta per l'especialista, si està o no finançat per l'IBSALUT o una altra entitat, i el grau de necessitat. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>b) Reparació/adaptació de la llar</strong>: es tracta de totes les obres que es duen a terme en un domicili amb l'objectiu de facilitar l'estada a una persona discapacitada o a una persona major amb dificultats de mobilitat. S'atorgarà només en els casos en què el sol·licitant no s'hagi pogut acollir, per un motiu justificat, als ajuts d'accessibilitat a edificis i habitatge regulats per la conselleria competent del Govern de les Illes Balears. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Es finançarà com a màxim el 75&nbsp;% del cost total. Per tal de fixar el tant per cent que es finançarà, es valorarà la capacitat econòmica de la unitat de convivència i el grau de necessitat de l'obra efectuada.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>c) Tractaments professionals</strong>: es tracta dels tractaments que no són coberts pel sistema nacional de salut, pel sistema d'autonomia i d'atenció a la dependència o per qualsevol organització de servei públic implantada al territori, com poden ser tractaments psicològics, de rehabilitació, d'estimulació precoç, de logopèdia, etc. En aquests casos excepcionals es valorarà la capacitat econòmica de la unitat de convivència, la necessitat del tractament, la freqüència i el període previst de tractament. Se'n finançarà com a màxim el 75% del cost total.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>5.6. Ajuts per emergència social</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Es tracta d'emergències greus i imprevisibles que fan que una persona o família es trobi de sobte en situació de necessitat; per exemple, a causa d'incendis, inundacions, accidents, robatoris, etc.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 6. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Forma de concessió dels ajuts</strong>.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La concessió d'aquests ajuts es realitzarà en règim de concurrència, competitiva, mitjançant la comparació de les sol·licituds presentades, a fi d'establir la prelació d'aquestes segons els criteris previstos a l'article 8 d'aquesta convocatòria.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 7. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Sol·licituds i documentació a presentar.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Les sol·licituds s'han de presentar, dins del termini establert en la convocatòria, a l'Àrea de Serveis Socials de l'Ajuntament des Migjorn Gran i consistiran en la següent documentació:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">j) Declaració jurada del sol·licitant de no haver rebut ajudes econòmiques, en el mateix any natural, d'altres organismes pel mateix concepte o, en el cas d'haver-ne rebudes, que no cobreixin totalment la necessitat objecte de la petició, amb indicació, en aquest cas, de la quantia rebuda,</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">k) Declaració responsable de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques recollides en l'article 13.2 de la Llei 38/2003, de 17 de novembre, general de subvencions,</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 8. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Criteris en la concessió dels ajuts</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Els ajuts es concediran d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat, per mitjà del procediment de concurrència competitiva.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En la selecció de les sol·licituds i la graduació dels ajuts, les sol·licituds seran valorades d'acord amb el següent ordre de prioritats i tot tenint en compte la dotació pressupostària recollida en l'article 2:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Els imports màxims i les condicions de cadascun dels ajuts seran els recollits a l'article 5.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) La necessitat de realitzar l'activitat, compra o servei subvencionat, manifestada i/o certificada o justificada mitjançant recepta, recomanació, ... d'algun professional.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) L'esgotament de recursos previs i «ordinaris» per a solucionar el problema econòmic que presenta.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Finalment, s'atendrà els ajuts per ordre d'entrada.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 9. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Comissió tècnica d'ajuts socials.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Es crea la comissió tècnica d'ajuts socials, que està formada per l'equip tècnic dels Serveis Socials.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Les funcions de la comissió tècnica seran les següents:</span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Examinar, avaluar i qualificar les sol·licituds d'acord amb els criteris i els requisits que estableix aquesta convocatòria.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Emetre l'informe que ha de servir de base per elaborar la proposta de resolució.</span></span></span></li> </ul> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 10. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Tramitació i resolució dels ajuts.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. La treballadora social serà l'òrgan instructor del procediment de concessió d'aquests ajuts.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. La treballadora social analitzarà el compliment dels requisits establerts en aquesta convocatòria, afegirà els documents dels quals el sol·licitant hagi autoritzat a consulta de dades, així com el certificat d'empadronament, avaluarà les sol·licituds presentades i evacuarà un informe social. Amb aquest fi, ha d'examinar les sol·licituds presentades i la documentació adjunta per tal de determinar si l'ajuda s'adequa a l'objecte d'aquesta convocatòria. En particular, realitzarà totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades, en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts. Si es considera necessari disposar de documentació complementària per poder fer una correcta valoració de la necessitat sol·licitada, podrà sol·licitar la documentació que consideri oportuna.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. La Comissió tècnica d'ajuts socials examinarà la documentació i emetrà un informe on es concretarà el resultat de l'avaluació efectuada.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. L'equip tècnic de serveis socials formularà una proposta de resolució a la batlia, que dictarà resolució sobre la concessió o denegació dels ajuts.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. Els ajuts s'atorgaran per Decret de batlia en base a la proposta de la comissió tècnica de Serveis Socials. El termini màxim per resoldre serà de dos mesos, comptadors des de la data de presentació de la sol·licitud o l'esmenada definitiva de les deficiències, si són necessàries. Si no recau resolució en el termini indicat, les sol·licituds presentades s'entendran com desestimades.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 11. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Obligacions dels beneficiaris.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Són obligacions dels beneficiaris:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Destinar l'import de l'ajuda a l'objecte per al qual s'ha sol·licitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Justificar davant l'ajuntament el compliment dels requisits i condicions recollits a l'article 4 d'aquestes bases.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Justificar l'aplicació de la subvenció, segons el que determinen aquestes bases.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Sotmetre's a les actuacions de comprovació i control que pertoquin per part d'aquest Ajuntament, la Sindicatura de Comptes o d'altres òrgans de control extern, així mateix es comprometen a facilitar quanta informació els sigui requerida per aquestes en relació amb els ajuts concedits.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Comunicar a l'Ajuntament l'obtenció d'altres subvencions, ajuts, ingressos o recursos que financin les activitats subvencionades.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">f) Conservar els documents justificatius de l'aplicació dels fons rebuts, inclosos els documents electrònics, en tant puguin ser objecte de les activitats de comprovació i control.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 12. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Abonament dels ajuts</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Atesa la naturalesa i l'objectiu social d'aquests ajuts, l'import de la subvenció s'abonarà un cop aprovada la concessió de l'ajut, la qual cosa no eximeix la seva plena justificació.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. L'abonament es podrà realitzar, segons els casos en favor del beneficiari o d'una entitat o persona col·laboradora, per tal d'aconseguir els fins que persegueixen la concessió de l'ajut.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 13. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Justificació de les subvencions. Forma i règim de pagament.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. La justificació de la inversió proposada en la resolució s'haurà de realitzar abans del 31 de <span style="color:#000000">gener </span>de 2024.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. La documentació a entregar per justificar la subvenció seran factures o altres comprovants de la despesa efectuada. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. En el supòsit que no es justifiqui totalment la realització de l'activitat subvencionada, però s'hagi complert parcialment la finalitat per a la qual va ser concedida, es procedirà a la revisió de la quantia, tot minorant-se proporcionalment a la part no justificada.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 14. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Reintegrament dels ajuts concedits.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. D'acord amb el que disposen els articles 37 i 8 de la Llei 38/2003, de 17 de novembre, general de subvencions, el beneficiari ha de reintegrar totalment o parcialment les quantitats rebudes i, si n'és el cas, l'interès de demora, en els casos següents: </span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'incompliment de la finalitat per a la qual es concedí la subvenció.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'obtenció de la subvenció sense que es compleixin les condicions requerides per a això, o quan s'alterin les condicions tingudes en compte per concedir-la, sempre que sigui per causes imputables a la persona beneficiària.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">L'incompliment de l'obligació de justificació o la justificació insuficient, en els termes establerts en l'article 30 de la Llei 38/2003, de 17 de novembre.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La concurrència de subvencions incompatibles per a la mateixa activitad.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La negativa a sometre's a les actuacions de comprovació i control previstes en la Llei 38/2003, de 17 de novembre, o l'obstrucció injustificada d'aquestes actuacions.</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Per tal de reintegrar les ajudes s'han d'aplicar els procediments prevists per a aquest efecte en els articles 41, 42 i 43 de la Llei 38/2003, de 17 de novembre, general de subvencions, en els quals s'han de garantir l'audiència a les persones interessades.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Les quantitats reintegrades tenen la consideració d'ingressos de dret públic i poden ser exigides per la via de constrenyiment.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 15. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Règim d'infraccions i sancions</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. El règim d'infraccions i sancions administratives aplicables serà l'establert en el títol IV de la Llei 38/2003, de 17 de novembre, general de subvencions.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. L'òrgan competent per imposar les sancions que es derivin d'infraccions de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions és la batlia de l'Ajuntament.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Article 16. </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Normativa aplicable.</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. En tot allò no previst expressament en aquestes bases serà d'aplicació l'ordenança general reguladora de la concessió de subvencions<span style="color:#000000">.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.
