669433 CAIB 2023-01-26 text/html ca 3326 140 2023-01-25 69006 ca 3328 2023-01-26 ![CDATA[<p><span style="color:#00000a; font-family:&quot;Times New Roman&quot;,Times,serif">D'acord amb l'edicte publicat al Butlletí Oficial de les Illes Balears (BOIB) núm. núm. 126, de 27 de setembre de 2022, amb relació a l'acord adoptat pel Ple de l'Ajuntament de Son Servera, en sessió ordinària de 15 de setembre de 2022, mitjançant el qual es va aprovar inicialment la modificació de l'Ordenança fiscal núm. 30 reguladora de la taxa per a la prestació del servei d'assistència al centre d'estades diürnes de Son Servera.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el previst als articles 22.2.d), 49, i 70.2, de la Llei 7/1985, de 2 d'abril de Bases de Règim Local, i havent transcorregut el termini d'exposició al públic sense que s'hagin presentat cap al·legació ni reclamació amb relació a la modificació de l'Ordenança fiscal núm. 30 reguladora de la taxa per a la prestació del servei d'assistència al centre d'estades diürnes de Son Servera, per la qual cosa queda aprovada definitivament, i es transcriu a continuació el text íntegre de l'ordenança: </span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“ORDENANÇA Nº 30. TAXA PER A LA PRESTACIÓ DEL SERVEI D'ASSISTÈNCIA EN EL CENTRE D'ESTÀNCIES DIURNES DE SON SERVERA</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 1r Fonament legal</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fent ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les Bases de Règim Local, i de conformitat amb allò disposat als articles 15 a 19 del RDL 2/2004, de 5 de març, Regulador de les Hisendes Locals, aquest ajuntament estableix la taxa per a la prestació del servei d'assistència al Centre d'estàncies diürnes de Son Servera. S'entén per servei d'assistència, aquell prestat des del moment en el que la persona es beneficiària del servei d'estàncies diürnes. La finalitat fonamental d'aquest recurs es millorar la qualitat de vida, tant de la família assistent com del major depenent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 2n Fet imposable</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Constitueix el fet imposable d'aquesta taxa l'activitat municipal derivada de la prestació del Centre d'Estàncies Diürnes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) El pagament de la taxa inclourà els següents serveis: servei d'atenció personal, servei d'atenció social al resident, servei d'atenció sanitària, servei d'alimentació/menjador, activitats de rehabilitació funcional, servei d'informació, orientació i recolzament als familiars cuidadors, activitats lúdiques.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 3r Subjectes passius</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són subjectes passius d'aquesta taxa les persones que utilitzin el servei d'assistència en el Centre d'Estàncies Diürnes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A l'aplicació d'aquesta taxa no s'admetrà cap exempció ni cap benefici tributari, a excepció d'aquells previstos expressament a les normes amb categoria de llei o els derivats de l'aplicació dels tractats internacionals.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 6è Acreditació</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a)&nbsp;S'acreditarà la taxa i sorgeix l'obligació del pagament a partir del començament de la prestació del servei.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) S'entén que s'inicia la prestació del servei quan es produeix l'ingrés del subjecte passiu en el centre d'estàncies diürnes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 7è Normes de gestió</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) El pagament s'efectuarà per mensualitats vençudes, dia 27 de cada mes, mitjançant transferència bancària a favor de l'ajuntament. Aquesta transferència la tindrà que ordenar el subjecte passiu en el moment de fer l'ingrés en el Centre d'Estàncies Diürnes i cada cop que siguin modificades les tarifes de la taxa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) A les estàncies permanents, el mes d'entrada i/o sortida es facturarà segons els dies que han fet servir el servei.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) A les estàncies temporals es facturarà segons el nombre efectiu de dies en que han fet servir el servei.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) L'Ajuntament establirà un sistema de subvencions per als usuaris del servei que no puguin pagar la taxa. En cap cas podran ser subvencionades les tarifes dels usuaris que tinguin patrimoni o ingressos d'altre tipus, suficients per pagar la taxa, així com dels usuaris que tinguin parents de primer grau amb capacitat econòmica suficient per atendre la taxa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 8è Infraccions i sancions</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En tot allò relatiu a infraccions tributàries i la seva qualificació, així com a les sancions que corresponguin a cada cas, s'aplicaran les normes contingudes a la Llei General Tributària i en el Reglament General de Recaptació.”</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra el present acord, es podrà interposarà recurs contenciós-administratiu, davant la Sala contenciosa administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos a comptar des de l'endemà a la publicació del present anunci, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciós-Administrativa.
