&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 9 de novembre de 2022, la Comissió Negociadora de SITIBSA aprovà la proposta d'adhesió del seu personal laboral al conveni col·lectiu del personal laboral al servei de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 11 de novembre de 2022 , Teresa Vanrell Cerda, en representació de la Comissió Negociadora de l'Acord, sol·licità el registre, el dipòsit i la publicació de l'Acord esmentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. L'article 90.3 del text refós de la Llei de l'Estatut dels treballadors, aprovat pel Reial decret legislatiu 2/2015, de 23 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Reial decret 713/2010, de 28 de maig, sobre registre i dipòsit de convenis i acords col·lectius de treball.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. L'article 45 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Inscriure i dipositar l'Acord d'adhesió al Conveni col·lectiu del personal laboral al servei de la CAIB del personal laboral de SITIBSA en el Registre de Convenis col·lectius, Acords col·lectius de treball i Plans d'igualtat de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Notificar aquesta Resolució a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Publicar l'Acord en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Acord pel qual el personal laboral de l'entitat pública empresarial Servei d'Informació Territorial de les Illes Balears, s'adhereix al v Conveni col·lectiu &lt;em&gt;&lt;span style="color:#000000"&gt;per al personal laboral al servei de l'Administració de la Comunitat Autònoma de les Illes Balears&lt;/span&gt;&lt;/em&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Parts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En representació del Servei d'Informació Territorial de les Illes Balears (en endavant SITIBSA), la gerent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En representació del personal laboral de l'empresa, el delegat de personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. El dia 8 d'agost de 2013 la representació de l'Administració de la Comunitat Autònoma de les Illes Balears i la del seu personal laboral subscriviren el text del v Conveni col·lectiu &lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;per al personal laboral al servei de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Amb l'objecte de regular les relacions laborals entre el personal de la societat anònima Serveis d'Informació Territorial de les Illes Balears, S.A.U. i l'empresa, el 20 de juny de 2014 la gerent i el delegat de personal de SITIBSA van acordar subscriure un Acord d'Adhesió al v Conveni col·lectiu &lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;per al personal laboral al servei de l'Administració de la Comunitat Autònoma de les Illes Balears i regular els aspectes que no queden coberts per l'adhesió.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les parts ens reconeixem mútuament la capacitat legal necessària per a formalitzar aquest Acord d'Adhesió, d'acord amb les següents&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Clàusules&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;1. Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'objecte d'aquest Acord d'Adhesió és regular les relacions laborals entre SITIBSA i el personal laboral al servei de SITIBSA.&lt;span style="color:#000000"&gt; Amb la subscripció d'aquest Acord d'Adhesió, SITIBSA s'adhereix al v Conveni col·lectiu &lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;per al personal laboral al servei de l'Administració de la Comunitat Autònoma de les Illes Balears,&lt;/span&gt;&lt;/em&gt; amb les particularitats que s'estableixen. Acord d'Adhesió que és igual a l'Acord subscrit el 20 de juny de 2014, excepte que l'Annex I de les retribucions complementàries inclou els imports actualitzats a 31 de desembre de 2021 i s'afegeix un Annex II amb les categories professionals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;2. Modificacions de referències&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Totes les referències del v Conveni col·lectiu de la Comunitat Autònoma de les Illes Balears a l'Administració de la Comunitat Autònoma de les Illes Balears s'entenen fetes a l'empresa SITIBSA. Així mateix, les referències a l'òrgan competent en matèria de funció pública, s'entenen fetes a l'òrgan de SITIBSA competent en matèria de personal; les referències al Comitè Intercentres, al delegat de personal; les referències a la Comissió Paritària de Prevenció de Riscs Laborals, al delegat de personal; i les millores del personal funcionari, a les millores del personal laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;3. Vigència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'adhesió serà vigent des de 31 de gener de 2022, data d'aprovació de la vigent Relació de llocs de treball, i mentre ho sigui el v Conveni col·lectiu, incloent-hi, si pertoca, el termini de trenta mesos al qual fa referència el darrer paràgraf de l'article 4 d'aquest.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;4. Disposicions inaplicables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Del v Conveni col·lectiu de la Comunitat Autònoma de les Illes Balears són inaplicables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Els articles 15 i 16, relatius a la classificació professional i els nivells de classificació, per venir determinats per la disposició addicional quinzena de la Llei 15/2012, de 27 de desembre, de pressuposts generals de la comunitat autònoma de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'antepenúltim i el penúltim paràgraf de l'article 2, relatiu a les exclusions de l'àmbit d'aplicació del Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Els articles 21 &lt;em&gt;f&lt;/em&gt; i 28, relatius a la mobilitat entre les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article 26 &lt;em&gt;b&lt;/em&gt;, que estableix un requisit per concórrer a la promoció interna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Els apartats de l'article 27 que fan referència a l'establiment del concurs com una de les tres formes d'accés al lloc de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article 29.3, relatiu a la contractació nominativa del personal laboral no permanent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La causa d'excedència forçosa que estableix l'article 52 &lt;em&gt;a&lt;/em&gt;. El contracte de treball del personal laboral fix només s'extingeix per un acomiadament per expedient disciplinari o per causes econòmiques, tècniques, organitzatives o productives d'acord amb els articles 51 o 52 o la disposició addicional vintena de l'Estatut dels treballadors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article 73, relatiu al Servei de Prevenció de Riscs Laborals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les disposicions addicionals primera, segona, tercera, quarta, setena, vuitena i setzena, relatives al personal laboral no fix indefinit per extingir, al personal de seguretat, al personal destinat al complex de Marivent, a la promoció creuada, a les actuacions en matèria de llicència per assumptes propis, a la suspensió de l'acord relatiu a l'homogeneïtzació dels complements específics i al pla d'igualtat entre homes i dones (que se n'haurà de negociar un per a SITIBSA), respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;5. Disposicions modificades en virtut de la disposició addicional quinzena de la Llei 15/2012, de 27 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2013&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Es modifiquen les disposicions següents del v Conveni col·lectiu de la Comunitat Autònoma de les Illes Balears, en virtut de la disposició addicional quinzena de la Llei 15/2012:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. L'article 77.2, relatiu a les retribucions complementàries, queda modificat de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Retribucions complementàries&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.1. Complement d'insularitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.2. Complement de dedicació especial.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.3. Complement de responsabilitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.4. Complement de dificultat tècnica.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.5. Complement personal, transitori i absorbible.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Complement de responsabilitat: concepte que engloba tots els complements destinats a retribuir les prefectures orgàniques, el comandament de personal, la direcció d'equips i qualsevol altre de similar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Complement de dificultat tècnica: concepte que engloba tots els complements destinats a retribuir la complexitat de les tasques assignades, la diversitat o l'heterogeneïtat de les funcions, l'experiència exigida i qualsevol altre de similar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. La retribució del complement d'insularitat i del complement de paga extraordinària queden definits segons el V Conveni. La resta de retribucions complementàries aplicables als treballadors de SITIBSA queden definides a l'Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;6. Altres modificacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
