&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En el&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;BOIB núm. 1, de 3 de gener de 2023, es va publicar la Resolució del president de l'AETIB, de 27 de desembre, por la qual&lt;/span&gt;&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;s'aproven els plecs de les condicions generals que han de regir la tramitació dels expedients de contractació que es derivin de les sol·licituds de patrocinis singulars amb entitats privades per a esdeveniments singulars que generin repercussió mediàtica per a les marques de les Illes Balears i l'Agència d'Estratègia Turística de les Illes Balears (AETIB) durant l'any 2023 en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea, Next Generation EU.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;D'una primera lectura de la convocatòria s'ha advertit errors materials a la Resolució del president de l'AETIB de data de 27 de desembre de 2022 i l'Annex A dels Plecs de condicions generals que han de regir la convocatòria pública per a &amp;nbsp;la tramitació dels expedients de contractació que es derivin de les sol·licituds de patrocinis singulars amb entitats privades per a esdeveniments singulars que generin repercussió mediàtica per a les marques de les Illes Balears i l'Agència d'Estratègia Turística de les Illes Balears (AETIB) durant l'any 2023 en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea, Next Generation EU.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú, estableix que “Les administracions podran, així mateix, rectificar en qualsevol moment, d'ofici o a instancia dels interessats, els errors materials, de fet o aritmètics existents en el seus actes”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de la Comunitat Autònoma de les Illes Balears, disposa que la revocació dels actes de gravamen o desfavorables i la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tot això, dict la següent,&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Primer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Rectificar els errors observats a la Resolució del Presidente de la AETIB de data de 27 de desembre de 2022 i l'Annex A dels Plecs de condicions generals que han de regir la convocatòria pública per a &amp;nbsp;la tramitació dels expedients de contractació que es derivin de les sol·licituds de patrocinis singulars amb entitats privades per a esdeveniments singulars que generin repercussió mediàtica per a les marques de les Illes Balears i l'Agència d'Estratègia Turística de les Illes Balears (AETIB) durant l'any 2023 en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea, Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En particular,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;1.- En la resolució del President de l'AETIB, en el apartat “Resolc” punt primer, de la versió en castellà i català:&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;On diu:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Català:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;“Aprovar els plecs de condicions generals que han de regir la tramitació dels expedients de contractació que es derivin de les sol·licituds de patrocinis d'esdeveniments singulars amb entitats privades que generin repercussió mediàtica per a les marques de les Illes Balears i l'Agència d'Estratègia Turística de les Illes Balears (AETIB) durant l'any 2023, que s'adjunten com ANNEX A en aquesta resolució.”&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;“Aprobar los pliegos de las condiciones generales que tienen que regir la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios singulares con entidades privadas para eventos singulares que generen repercusión mediática para las marcas de les Illes Balears y la Agencia de Estrategia Turística de les Illes Balears (AETIB) durante el año 2023 en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea, Next Generation EU.”&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;2.- En la resolució del President de l'AETIB i en el ANNEX A, de la versió en castellà y català:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;A tots el apartats &lt;strong&gt;on digui:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Annex A1“&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Ha de dir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Annex 1s”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3.- A l'apartat 1.1 del ANNEX A “Requisits dels esdeveniments”, en el punt A) de la versió en castellà:&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;On diu:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;“Los que se ajusten a la definición de evento estratégico, con voluntad de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;continuidad y con una duración inferior a 10 días anuales, a excepción de&amp;nbsp;aquellos con consideración de ciclos culturales o festivales vinculados a la&amp;nbsp;&lt;span style="line-height:normal"&gt;cultura.”&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Ha de dir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;“Los que se ajusten a la definición de evento singular.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;4.- A l'apartat 3 del ANNEX A&lt;strong&gt; &lt;/strong&gt;“Pressupost de la convocatòria”, de la versió en castellà:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;On diu:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“El importe del patrocinio solicitado nunca podrá superar el 50% respecto del&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presupuesto de gasto indicado al Anexo A1 (impuestos incluidos) y tampoco podrá&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;superar el máximo establecido por marca. Así mismo, tampoco se podrá superar a la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;fase de justificación con relación al gasto real efectivo.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Ha de dir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“El importe del patrocinio solicitado nunca podrá superar el 25% respecto del&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presupuesto de gasto indicado al Anexo A1 (impuestos incluidos) y tampoco podrá&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;superar el máximo establecido por marca. Así mismo, tampoco se podrá superar a la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;fase de justificación con relación al gasto real efectivo.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;5.- En el apartat 6.2 “Documentació Administrativa: Documentació relacionada amb l'entitat sol·licitant” en el cas de persones físiques i jurídiques espanyoles , de la versió en castellà:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;On diu: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Los datos contenidos en este documento regirán la valoración de la solicitud y&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;prevalecerán encima cualquier otro documento librado y, por lo tanto, no se&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;podrán modificar ni enmendar. &lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;On diu:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“Testigo judicial, certificación administrativa o declaración responsable, de no&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;incurrir en las prohibiciones para contratar con la administración según el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ordenamiento jurídico español y por analogía con el ordenamiento del Estado a&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;que pertenece&lt;/span&gt;&lt;/em&gt;&lt;span style="line-height:115%"&gt;.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Ha de dir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Contra aquesta resolució —que exhaureix la via administrativa— es pot interposar recurs potestatiu de reposició davant el president de l'AETIB en el termini d'un mes a comptar des de l'endemà de la seva publicació en el BOIB, d'acord amb el que estableixen l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril) i l'article 123 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;També es pot interposar recurs contenciós administratiu davant el jutjat contenciós administratiu, en el termini de dos mesos des de l'endemà de la publicació en el BOIB, d'acord amb el que estableix l'article 46 de la Llei 29/1998, de 13 de juliol, de la jurisdicció contenciós administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
