    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L&amp;apos;apartat 9.3. de la Convocatòria d&amp;apos;ajudes per al desenvolupament rural de l&amp;apos;illa de Mallorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l&amp;apos;Estratègia de Desenvolupament Local Participatiu de Mallorca, de data 13 de novembre de 2020&amp;nbsp;especifica que la resolució es publicarà amb caràcter informatiu a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d&amp;apos;acord amb els termes que preveu&amp;nbsp;l&amp;apos;article 45.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l&amp;apos;article 43 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El vicepresident en Matèria Agrària del FOGAIBA en&amp;nbsp;data 7&amp;nbsp;de desembre&amp;nbsp;de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;1. En data de 19 de novembre de 2020 es va publicar, en el BOIB núm. 187, l&amp;apos;anunci de la publicació de l&amp;apos;Acord de la Junta Directiva de l&amp;apos;Associació Mallorca Rural Grup d&amp;apos;Acció Local de Mallorca aprovant la Convocatòria, per a l&amp;apos;any 2020, d&amp;apos;ajudes al desenvolupament rural de l&amp;apos;illa de Mallorca, vinculades a projectes relacionats amb els àmbits agrari i/o ambiental i emmarcats en l&amp;apos;Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformitat amb l&amp;apos;apartat sisè de l&amp;apos;esmentada Resolució, el termini de presentació de sol·licituds va acabar el dies 21 de desembre de 2020 , i varen tenir entrada en el Registre del Grup d&amp;apos;Acció Local, Associació Mallorca Rural un total de 70&amp;nbsp;sol·licituds d&amp;apos;ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;&lt;em&gt;3. Els òrgans gestors del Servei d&amp;apos;Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d&amp;apos;acord amb les normes reguladores d&amp;apos;aquesta ajuda. Tots els expedients relacionats a l&amp;apos; Annex I compten amb el seu respectiu informe de subvencionabilitat positiu i han estat aprovats per l&amp;apos;Òrgan decissori del Grup d&amp;apos;Acció Local Mallorca Rural.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;4. &lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;&lt;em&gt;Els interessats assenyalats a l&amp;apos;&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color: rgb(255, 255, 255)"&gt;&lt;em&gt;Annex I adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i s&amp;apos;ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d&amp;apos;aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;5. Una vegada avaluades les sol·licituds d&amp;apos;ajuda pels òrgans gestors, i d&amp;apos;acord amb els criteris d&amp;apos;elegibilitat de la convocatòria, als beneficiaris els hi correspon una ajuda màxima detallada a l&amp;apos; Annex I , després d&amp;apos;aplicar la deducció d&amp;apos;inversions i/o actuacions que no són elegibles per aquesta línia d&amp;apos;ajudes descrita a l&amp;apos; Annex II . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;6. Tenint en compte que el crèdit existent cobreix la totalitat de les peticions d&amp;apos;aquesta convocatòria no hi ha cap impediment per resoldre aquests expedients sense afectar el que disposa els apartats setè i vuitè de la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;7. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;En data &lt;/em&gt;&lt;/em&gt;26 de setembre de 2022&lt;em&gt;&lt;em&gt;&amp;nbsp;el Servei d&amp;apos;Ajudes al Desenvolupament Rural ha emès informe favorable i proposta provisional de concessió d&amp;apos;ajuda als beneficiaris relacionats a l&amp;apos; Annex I . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: null"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;8. En data &lt;/em&gt;&lt;/em&gt;26 de setembre de 2022 &lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;es notifica, mitjançant publicació a la pàgina web http://www.caib.es, l&amp;apos;esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;9. A dia d&amp;apos;avui, i una vegada finalitzat el termini, els interessats relacionats a l&amp;apos;Annex I no han presentat al·legacions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;-&amp;nbsp;Conveni de col·laboració entre el Fons de Garantía Agrària i Pesquera de les Illes Balears com a Organisme Pagador, l&amp;apos;adjunt a la Gerència del FOGAIBA com Autoritat de Gestió i el Grup d&amp;apos;Acció Local Associació Mallorca Rural pel que s&amp;apos;estableixen les condicions per a l&amp;apos;aplicació de la mesura 19 del Programa de Desenvolupament Rural de les Illes Balears 2014-2020 de 20 d&amp;apos;abril de 2018.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;-&amp;nbsp;Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;- Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- Llei 35/2019 de 1 d&amp;apos;octubre de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Per tot això, dict la següent&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

EDLNP32020_1”, deduint les inversions/actuacions no elegibles especificades a l&amp;apos;Annex II.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;2. Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l&amp;apos; Annex I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;3. Determinar que, d&amp;apos;acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l&amp;apos; Annex III . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolució a cada un dels beneficiaris de l&amp;apos; Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Realitzar les inversions o activitats auxiliables durant el termini establert.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en els termes i terminis determinats a la present convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Mantenir les inversions realitzades durant almenys cinc anys, comptats des de la data de pagament de l&amp;apos;ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Complir les normes comunitàries aplicables a la inversió i en especial les relatives a la durabilitat de les operacions previstes a l&amp;apos;article 71 del Reglament (UE) núm. 1303/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Sotmetre&amp;apos;s als controls que dugui a terme l&amp;apos;administració, necessaris per comprovar la correcta concessió de l&amp;apos;ajuda i el posterior manteniment de compromisos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Atendre els requeriments del Grup d&amp;apos;Acció Local Associació Mallorca Rural relacionats amb el seguiment i l&amp;apos;avaluació del projecte i de l&amp;apos;Estratègia de Desenvolupament Local Participatiu.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;-Complir els compromisos adquirits per a la concessió de l&amp;apos;ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;A més, s&amp;apos;hauran de complir les normes d&amp;apos;informació i publicitat previstes a l&amp;apos;annex III del Reglament d&amp;apos;execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s&amp;apos;estableixen disposicions d&amp;apos;aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l&amp;apos;ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;Aquestes obligacions s&amp;apos;entendran sense perjudici de l&amp;apos;obligació de complir-ne la resta que s&amp;apos;estableixen a l&amp;apos;article 11 del text refós de la Llei de subvencions, aprovat pel Decret Legislatiu 2/2005, de 28 de desembre, i a l&amp;apos;article 11 de l&amp;apos;Ordre de bases reguladores de la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, aprovat mitjançant l&amp;apos;Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, així com la resta que deriven de la normativa estatal i comunitària d&amp;apos;aplicació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;El règim jurídic aplicable per l&amp;apos;incompliment d&amp;apos;aquestes obligacions és el que preveu el Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, i comprèn des del reintegrament de l&amp;apos;ajuda i el pagament de l&amp;apos;interès de demora fins a la imposició de les sancions corresponents. En el cas d&amp;apos;incompliment de les obligacions anteriors s&amp;apos;aplicaran les reduccions previstes a la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
