    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 24&amp;nbsp;de novembre&amp;nbsp;de 2022, va signar la següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.El de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015 (BOIB núm. 185), 22 de juny de 2016 (BOIB núm. 81), 26 de juny de 2018 (BOIB núm. 80), 14 de juny de 2019 (BOIB núm. 80), 2 de març de 2020 (BOIB núm. 28), 6 de maig de 2020 (BOIB núm. 77), 22 de juny de 2020 (BOIB núm. 114), 23 de juliol de 2021 (BOIB núm. 101), 19 de novembre de 2021 (BOIB núm. 162), 1 de juliol de 2022 (BOIB núm. 87).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;En data 1 de juliol de 2022 es va dictar Resolució de la presidenta del FOGAIBA per la qual es modifica la Resolució de 10 de juliol de 2015 mitjançant la qual es convoquen, per als anys 2015 a 2020, subvencions per a inversions en les explotacions agràries. En aquesta modificació de la Resolució, l'apartat novè, punt 4 permet l'increment de crèdit durant el període de 6 mesos posteriors a la resolució de l'ajuda sense necessitat de convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El 12 d'agost de 2022, data en què va finalitzar el període de 6 mesos per a incrementar el crèdit.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Es va concedir un termini de 10 dies hàbils comptadors des de l'endemà de la publicació del requeriment perquè l'interessat s'oposés a la concessió de l'ajuda i que en cas de no fer-ho es donaria per acceptada la proposta, es dictaria l'acte de concessió i es procediria a la seva notificació. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El 25 d'octubre de 2022, amb registre d'entrada núm. 623058/2022,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;l&lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a persona indicada en l'apartat anterior ha presentat una sol·licitud de canvi d'inversions, en la qual indica que el model de tractor que va sol·licitar (M125GX-IV-S marca Kubota), amb un import de 64.660,00 €, ja no es fabrica i que passa a ser el M6132 24/24 marca Kubota, amb un import de 91.870,00 €. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7.El 8 de novembre de 2022 s'emet informe de moderació de costs del tractor M125GX-IV-S marca Kubota on s'informa que el preu màxim elegible és el de la sol·licitud d'ajuda, per tant l'import elegible del tractor és de 64.660,00 €.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El 7 de novembre de 2022, amb registre d'entrada núm. 650333, Juan Oliver Gornals sol·licita el desistiment de les inversions del remolc del cultivador i del chisel; amb un import d'inversió de 30.703,00 €.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'import de l'ajuda sol·licitat era de 95.363,00 € i descomptant l'import de 30.703,00 € dels desistiments sol·licitats pel beneficiari queda un import sol·licitat de 64.660,00 €. Amb el 50% de nivell d'ajuda, queda un import d'ajuda concedida de 32.330,00 €. Per tant, s'han de revocar un total de 15.351,50&amp;nbsp;€, tal com s'especifica en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
