    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 31&amp;nbsp;de gener&amp;nbsp;de 2022, per la qual es convoquen ajudes destinades al pagament compensatori en zones de muntanya per a l'any 2022, així com el punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 3&amp;nbsp;de febrer&amp;nbsp;de 2022, per la qual es convoquen ajudes destinades al pagament compensatori per a zones amb limitacions específiques per a l'any 2022, especifiquen que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 3&amp;nbsp;de novembre&amp;nbsp;de 2022, va signar la següent resolució: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;1. En data de 3 de febrer de 2022&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;es va publicar, en el BOIB núm.18, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 31 de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;gener&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;22&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, per la qual s'aprova la convocatòria per a l'any 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;22&amp;nbsp;de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució,&amp;nbsp;i de la Resolució de modificació de la Presidenta del Fogaiba, per a l'any 2022, de determinats ajuts comunitaris directes a l'Agricultura i a la Ramaderia, de data 25 d'abril de 2022, publicada en el boib 56 de 28 d'abril de 2022, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/5/2022, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 257 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. En data de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;5 de febrer de 2022&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;es va publicar, en el BOIB núm. 19, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 3 de febrer de 2022, per la qual s'aprova la convocatòria per a l'any 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;22&amp;nbsp;de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. De conformitat amb l'apartat sisè de l'esmentada Resolució, i de la Resolució de modificació de la Presidenta del Fogaiba, per a l'any 2022, de determinats ajuts comunitaris &amp;nbsp;directes a l'Agricultura i a la Ramaderia, de data 25 d'abril de 2022, publicada en el boib 56 de 28 d'abril de 2022, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/5/2022, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 1213 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquestes ajudes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;els interessats que figuren a l'Annex I &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;no compleix&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en&amp;nbsp;el punt 1b de l'Apartat 3r de les convocatòries.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. En data 28 de setembre de 2022 es notifica, mitjançant publicació a la pàgina web http:// &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;www.caib.es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&amp;nbsp;l'informe desfavorable i la proposta provisional de denegació de l'ajuda &amp;nbsp;emesa per Servei d'Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Dins el termini establert, els interessats indicats a l'Annex I adjunt no han presentat al·legacions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB núm. 082 de 2007&lt;/em&gt;&lt;/span&gt;&lt;em&gt;; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta &amp;nbsp;de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;resolució de&amp;nbsp;&amp;nbsp;denegació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa desfavorablement i propòs al vicepresident en Matèria Agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la resolució als interessats de l'Annex I mitjançant la publicació en el boib.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
