CAIB ca ![CDATA[Acord del Consell de Govern de 28 de novembre de 2022 pel qual s’aprova l’oferta d’ocupació pública per a l’any 2022 corresponent al personal funcionari i al personal laboral al servei de l’Administració de la Comunitat Autònoma de les Illes Balears en l’àmbit dels serveis generals]] CAIB 2022-11-28 CAIB ca 49317 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">L'article 70.1 del Text refós de la Llei de l'Estatut bàsic de l'empleat públic (aprovat pel Reial decret legislatiu 5/2015, de 30 d'octubre), disposa que: «Les necessitats de recursos humans, amb assignació pressupostària, que s'hagin de proveir mitjançant la incorporació de personal de nou ingrés han de ser objecte de l'oferta d'ocupació pública, o a través d'un altre instrument similar de gestió de la provisió de les necessitats de personal […]». D'altra banda, la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, en l'article 47.1<span style="color:#000000">, determina que </span><span style="color:#000000">«</span><span style="color:#000000">constitueix l'oferta pública d'ocupació anual el conjunt de places vacants de personal funcionari i de personal laboral, amb dotació pressupostària, la cobertura de les quals resulta necessària […]</span><span style="color:#000000">».</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'article 18 de la Llei 5/2021</span><span style="color:#000000">, de 2</span><span style="color:#000000">8</span><span style="color:#000000"> de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 202</span><span style="color:#000000">2</span><span style="color:#000000"> </span><span style="color:#000000">estableix el següent:</span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">1. Durant l'any 2022, i sens perjudici del que disposa l'apartat següent, el nombre total de places de nou ingrés del personal de l'Administració de la comunitat autònoma de les Illes Balears i dels ens que integren el sector públic instrumental autonòmic, i també, si escau, els sectors, les funcions i les categories professionals en les quals s'han de concentrar, i les places que ha d'incloure l'oferta pública d'ocupació, s'han de fixar&nbsp;</span></span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">de conformitat amb la delimitació que, amb caràcter bàsic, faci l'Estat per a l'any 2022, per mitjà de la norma de rang legal corresponent i en el marc dels pressuposts generals de l'Estat per a l'any 2022, o, si no n'hi ha, amb la que resulta de la Llei 11/2020, de 30 de desembre, de pressuposts generals de l'Estat per a l'any 2021, i d'acord també amb l'Estatut Bàsic de l'Empleat Públic.</span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">Respectant les disponibilitats pressupostàries de l'exercici de 2022, no computen en el límit anterior les places corresponents a convocatòries pendents d'execució que deriven d'ofertes públiques d'ocupació d'anys anteriors, ni tampoc, dins els límits de les lleis anuals de pressuposts generals de l'Estat corresponents pel que fa a les taxes màximes de reposició d'efectius i, en general, al nombre màxim de places de nou ingrés de cada any, les places inherents a aquestes taxes i nombre màxim d'efectius de nou ingrés encara no convocades o sense oferta pública d'ocupació.</span></span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">2. En tot cas, les ofertes públiques d'ocupació de personal funcionari, de personal estatutari, de personal funcionari docent i de personal laboral de l'Administració de la comunitat autònoma i dels ens que integren el sector públic instrumental autonòmic requereixen els informes previs i favorables de la Direcció General de Funció Pública i de la Direcció General de Pressuposts, que s'han de pronunciar, respectivament, sobre els aspectes de legalitat aplicables i sobre els aspectes pressupostaris i de sostenibilitat financera, a sol·licitud motivada de l'òrgan directiu competent per raó de la matèria </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquesta previsió es completa amb la delimitació que fa la legislació bàsica en l'article 20 de la Llei 22/2021, de 28 de desembre, de pressuposts generals de l'Estat per a l'any 2022, el qual estableix que, durant el 2022, la incorporació de nou personal al sector públic està sotmesa a determinats límits i requisits: la taxa de reposició és del 120 % en els sectors prioritaris i del 110 % per a la resta de sectors. En tot cas, s'han de respectar les disponibilitats pressupostàries del capítol I del pressupost de despeses corresponent. Així mateix, l'article 20 disposa el següent: </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Per calcular la taxa de reposició d'efectius, el percentatge de taxa màxim fixat s'aplica sobre la diferència resultant entre el nombre d'empleats fixos que, durant l'exercici pressupostari anterior, van deixar de prestar serveis a cadascun dels respectius sectors, àmbits, cossos o categories, i el nombre d'empleats fixos que s'hi van incorporar, en l'exercici esmentat, per qualsevol causa, excepte els procedents d'ofertes d'ocupació pública, o que hi van reingressar des de situacions que no comportin la reserva de llocs de treball. </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">A aquests efectes, es computen els cessaments en la prestació de serveis per jubilació, retir, mort, renúncia, declaració en situació d'excedència sense reserva de lloc de treball, pèrdua de la condició de funcionari de carrera o l'extinció del contracte de treball o en qualsevol altra situació administrativa que no suposi la reserva de lloc de treball o la percepció de retribucions a càrrec de l'Administració en què se cessa. </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Igualment, es tindran en compte les altes i baixes produïdes pels concursos de trasllats a altres Administracions Públiques, així com les produïdes a conseqüència del que es disposa en l'apartat Cinc.3 d'aquest article i en l'apartat U.2 de les disposicions addicionals dècima setena, desena octava i dècima novena respecte de la mobilitat del personal amb una relació preexistent, fixa i indefinida en el sector de què es tracti. </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les places de professor contractat doctor que quedin vacants a conseqüència de l'accés a un Cos docent universitari, es podran incloure en la taxa de reposició de l'exercici següent. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Atès tot això, en relació amb la promoció interna, cal indicar que el Text refós de la Llei de l'Estatut bàsic de l'empleat públic la configura com una mesura de planificació de recursos humans que té per objecte contribuir a la consecució de l'eficàcia en la prestació dels serveis i que ha de facilitar l'Administració com a via per adquirir les competències i els requisits necessaris corresponents per a la progressió en la carrera professional des dels nivells inferiors fins als superiors.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">D'acord amb la taxa de reposició, per al període comprès entre l'1 de gener i el 31 de desembre de 20</span><span style="color:#000000">2</span><span style="color:#000000">1</span><span style="color:#000000"> correspon reposar un total de </span><span style="color:#000000">332 </span><span style="color:#000000">places.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Així doncs, és necessari aprovar l'oferta d'ocupació pública de la Comunitat Autònoma de les Illes Balears corresponent al personal funcionari i al personal laboral de l'àmbit dels serveis generals per a l'any 2022, encara que, d'acord amb el que estableix l'article 70.1 del Text refós de la Llei de l'Estatut bàsic de l'empleat públic, l'execució d'aquesta oferta ha de desenvolupar-se en un termini improrrogable de tres anys.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquesta oferta d'ocupació pública es va negociar en les sessions del dia </span><span style="color:#000000">23</span><span style="color:#000000"> de </span><span style="color:#000000">novembre</span><span style="color:#000000"> de 202</span><span style="color:#000000">2</span><span style="color:#000000"> de</span><span style="color:#000000"> la Mesa Sectorial de Serveis Generals.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Atès tot això, i d'acord amb l'article 5.2.<em>k)</em></span><span style="color:#000000"> de la Llei 3/2007, </span><span style="color:#000000">el Consell de Govern, a proposta d</span><span style="color:#000000">e </span><span style="color:#000000">l</span><span style="color:#000000">a</span><span style="color:#000000"> conseller</span><span style="color:#000000">a</span><span style="color:#000000"> d</span><span style="color:#000000">e </span><span style="color:#000000">Presidència, Funció Pública i Igualtat,</span><span style="color:#000000"> en la sessió de </span><span style="color:#000000">28</span><span style="color:#000000"> </span><span style="color:#000000">de </span><span style="color:#000000">novembre</span><span style="color:#000000"> de 202</span><span style="color:#000000">2, adoptà, entre d'altres, l'Acord següent:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Primer.</strong> Aprovar l'oferta d'ocupació pública per a l'any 20</span><span style="color:#000000">2</span><span style="color:#000000">2</span><span style="color:#000000"> corresponent al personal funcionari i laboral al servei de l'Administració de la Comunitat Autònoma de les Illes Balears en l'àmbit dels serveis generals, que suposa un total </span><span style="color:#000000">de </span><span style="color:#000000">332</span><span style="color:#000000"> </span><span style="color:#000000">places</span><span style="color:#000000">, amb la distribució indicada en els annexos que s'adjunten i en els termes </span><span style="color:#000000">establerts en aquest Acord.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Segon.</strong> Desglossar les places d'aquesta oferta de la manera següent:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em><span style="color:#000000"> </span>166</span><span style="color:#000000"> p</span>laces de personal funcionari pertanyen a l'oferta ordinària corresponent a la taxa de reposició d'efectius ordinària, d'acord amb els criteris establerts en l'art<span style="color:#000000">icle </span><span style="color:#000000">20</span><span style="color:#000000">.</span><span style="color:#000000">U</span><span style="color:#000000"> de la Llei </span><span style="color:#000000">22/2021, les quals s'adjunten com a annex 1.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em><span style="color:#000000"> </span>166</span><span style="color:#000000"> places de personal funcionari corresponen a la promoció interna de l'oferta ordinària, places que no computen a l'efecte del límit màxim de places derivat de la taxa ordinària de reposició d'efectius d'acord amb els criteris establerts </span><span style="color:#000000">en</span><span style="color:#000000"> l'article </span><span style="color:#000000">20</span><span style="color:#000000">.</span><span style="color:#000000">U</span><span style="color:#000000">.</span><span style="color:#000000">6</span><span style="color:#000000"> de la Llei </span><span style="color:#000000">22/2021</span><span style="color:#000000">, les quals s'adjunten com </span><span style="color:#000000">a annex 2.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Tercer.</strong> Reservar una quota mínima d'un 7 % del total de les places objecte de l'oferta perquè les cobreixin persones amb un grau de discapacitat igual o superior al 33 %, d'acord amb el que disposa l'article 59.1 del Text refós de la Llei de l'Estatut bàsic de l'empleat públic.
