&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.&amp;nbsp; El 24 de juliol de 2021 es va publicar en el Butlletí Oficial de les Illes Balears número 99 la Proposta de resolució del director general de Residus i Educació Ambiental i Resolució del conseller de Medi Ambient i Territori de convocatòria de subvencions per al finançament d'inversions relatives a la prevenció, reducció i gestió de residus a les Illes Balears per als anys 2021, 2022 i 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.&amp;nbsp; El 23 de setembre de 2021 es va publicar en Butlletí Oficial de les Illes Balears número 131 la Proposta de resolució del director general de Residus i Educació Ambiental i Resolució del conseller de Medi Ambient i Territori de modificació de la resolució del conseller de Medi Ambient i Territori de convocatòria de subvencions per al finançament d'inversions relatives a la prevenció, reducció i gestió de residus a les Illes Balears per als anys 2021, 2022 i 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.&amp;nbsp; En data 22 de desembre de 2021 el conseller de Medi Ambient i Territori va dictar resolució de concessió de subvenció p&lt;span style="color:#000000"&gt;er al finançament d'inversions relatives &lt;/span&gt;&lt;span style="color:#000000"&gt;a la prevenció, reducció i gestió de residus a les Illes &lt;/span&gt;&lt;span style="color:#000000"&gt;B&lt;/span&gt;&lt;span style="color:#000000"&gt;alears per als anys 2021, 2022 i 2023&lt;/span&gt;&lt;span style="color:#000000"&gt;, a favor de &lt;/span&gt;&lt;span style="color:#000000"&gt;l'&lt;/span&gt;&lt;span style="color:#000000"&gt;Ajuntament d'A&lt;/span&gt;&lt;span style="color:#000000"&gt;riany &lt;/span&gt;&lt;span style="color:#000000"&gt;i de l'Ajuntament de Bunyola per un import de 3.484,80 euros i 288 euros, respectivament, &lt;/span&gt;&lt;span style="color:#000000"&gt;els quals&lt;span style="color:#000000"&gt; &lt;/span&gt;s'acolliren al pagament previst per a l'any 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.&amp;nbsp; En data 23 de desembre de 2021 el conseller de Medi Ambient i Territori va dictar resolució de concessió de subvenció &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;er al finançament d'inversions relatives &lt;/span&gt;&lt;span style="color:#000000"&gt;a la prevenció, reducció i gestió de residus a les Illes &lt;/span&gt;&lt;span style="color:#000000"&gt;B&lt;/span&gt;&lt;span style="color:#000000"&gt;alears per als anys 2021, 2022 i 2023&lt;/span&gt;&lt;span style="color:#000000"&gt;, a favor de&lt;/span&gt;&lt;span style="color:#000000"&gt;l &lt;/span&gt;&lt;span style="color:#000000"&gt;Consorci de Residus i Energia de Menorca&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;i de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;Ajuntament &lt;/span&gt;&lt;span style="color:#000000"&gt;de Sencelles per un import de 5.953,20 euros i 16.000 euros, respectivament, &lt;/span&gt;&lt;span style="color:#000000"&gt;els quals&lt;span style="color:#000000"&gt; &lt;/span&gt;s'acolliren al pagament previst per a l'any 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.&amp;nbsp; A data d'avui no s'ha dictat cap resolució expressa d'atorgament o denegació de subvenció per a les entitats que han sol·licitat actuacions que s'han d'executar en posterioritat a l'any 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.&amp;nbsp; En data 18 de novembre de 2022 el cap de secció III del Servei de Residus i Sòls Contaminats va emetre l'informe justificatiu de la necessitat de dur a terme una modificació de la resolució del conseller de Medi Ambient i Territori de convocatòria de subvencions per al finançament d'inversions relatives a la prevenció, reducció i gestió de residus a les Illes Balears per als anys 2021, 2022 i 2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. &lt;span style="color:#000000"&gt;L'article 32.1 de la Llei 39/2015, d'1 d'octubre, &lt;/span&gt;del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. L'article 24.3 del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text Refós de la Llei de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. L'article 13.3 de l'Ordre de 3 d'octubre de 2017 del conseller de Medi Ambient, Agricultura i Pesca per la qual s'estableixen les bases reguladores de subvencions per al finançament d'inversions relatives a la prevenció, la reducció i la gestió dels residus.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Propòs al conseller de Medi Ambient i Territori que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Modificar l'apartat 4, que queda redactat de la manera següent:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;4. Import màxim i crèdits pressupostaris als quals s'imputa.&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. L'import màxim que es destina a aquesta convocatòria és de 2.180.000 euros repartits entre els anys&lt;span style="color:#000000"&gt; 2021, &lt;/span&gt;&lt;span style="color:#000000"&gt;2022, &lt;/span&gt;&lt;span style="color:#000000"&gt;2023 i 2024, &lt;/span&gt;desglossats de la manera indicada a la taula següent i amb càrrec a les partides pressupostàries que hi figuren o a les equivalents de les successives aplicacions pressupostàries.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Si les sol·licituds per actuacions subvencionables no esgoten la quantia prevista a la partida pressupostària 15601 G/571A01 46001 00 o les equivalents de les successives&lt;/span&gt;&lt;span style="color:#000000"&gt; aplicacions pressupostàries es podran traspassar el&lt;/span&gt;&lt;span style="color:#000000"&gt;s romanents a la partida pressupostària 15601 G/571A01 76001 00 o les equivalents de les aplicacions pressupostàries dels anys 2023 i 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. El finançament de les subvencions que estableix aquesta convocatòria queda condicionada a l'existència de crèdit adequat i suficient als pressuposts dels anys 2023 i 2024.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.Modificar l'apartat 15 que queda redactat de la manera següent:&lt;/strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;15. Terminis d'execució i justificació de les actuacions subvencionades&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Seran subvencionables les actuacions previstes al punt 6 d'aquesta convocatòria que s'hagin iniciat a partir del dia 1 de gener de 2021 fins a les dades limit d'execució que s'estableixen a aquesta convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. S'estableixen tres límits d'execució de les actuacions subvencionables:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins a 30 dies després de la publicació d'aquesta convocatòria al BOIB per aquelles actuacions que es puguin acollir al pagament previst a l'any 2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins el dia 1 de juny de 2023 s'hauran d'haver executat el 100% les actuacions previstes als punts 6.1, 6.5, 6.6 i 6.9 d'aquesta convocatòria i el 50% de les actuacions previstes als punts 6.3 i 6.7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins el dia 5 d'abril de 2024 s'hauran d'haver executat el 100% les actuacions previstes als punts 6.2, 6.4, 6.8 d'aquesta convocatòria i el 50% de les actuacions previstes als punts 6.3 i 6.7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. S'estableixen tres dates límit de presentació de la documentació justificativa indicada al punt 16 d'aquesta convocatòria per les actuacions realitzades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins a 20 dies des de la resolució de concessió de la subvenció concedida per aquelles actuacions que es puguin acollir al pagament previst per l'any 2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins el dia 20 de juny de 2023 s'hauran d'haver justificat el 100% les actuacions previstes als punts 6.1, 6.5, 6.6 i 6.9 d'aquesta convocatòria i el 50% de les actuacions previstes als punts 6.3 i 6.7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fins el dia 25 d'abril de 2024 s'hauran d'haver justificat el 100% les actuacions previstes als punts 6.2, 6.4, 6.8 d'aquesta convocatòria i el 50% de les actuacions previstes als punts 6.3 i 6.7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Aquelles entitats que es desitgin acollir als períodes d'execució i justificació de l'any 2021 ho hauran de fer marcant la casella prevista a tal efecte a l'annex 1. En cas de que una mateixa entitat es vulgui acollir als terminis prevists per l'any 2021 i pels prevists per l'any 2023 hauran de presentar dues sol·licituds (Annex 1) diferents.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. No es preveuen pròrrogues en els terminis d'execució ni de justificació per aquesta convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Modificar l'apartat 19 que queda redactat de la manera següent:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El pagament de la subvenció es farà efectiu una vegada s'hagi dictat la corresponent resolució i acreditat el compliment de la finalitat per la qual la subvenció va esser atorgada i s'hagi justificat la realització de l'activitat mitjançant la presentació de la documentació indicada al punt 16 i, en cas necessari, després d'haver dut a terme les inspeccions corresponents.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.&amp;nbsp; Es preveuen dos moments de pagaments ordinaris per les actuacions subvencionables. Aquelles actuacions de les que s'hagi sol·licitat l'execució i justificació l'any 2021 podran percebre el total de la subvenció atorgada presentant la documentació justificativa establerta al punt 16 d'aquesta convocatòria en el termini de fins a 20 dies des de la data de resolució de la concessió del ajuts. Les actuacions que no hagin sol·licitat la presentació de la documentació justificativa l'any 2021 s'hauran d'acollir als terminis prevists per l'any 2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Les actuacions amb terminis d'execució i justificació posterior a l'any 2021 podran sol·licitar un pagament parcial d'acord amb les prescripcions següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a. L'import pressupostat del total d'actuacions per les quals s'ha sol·licitat subvenció per part del municipi ha d'esser igual o superior al 30.000€.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b. Només seran subvencionables les despeses pagades abans de presentar la documentació justificativa per acollir-se al pagament parcial.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c. Només es podrà pagar de forma parcial fins al 50% de la subvenció atorgada per aquella actuació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.Per acollir-se a aquest pagament parcial les entitats beneficiàries hauran de presentar la documentació que s'indica al punt 16 d'aquesta convocatòria abans del dia 20 de juny de 2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.La memòria justificativa a la que fa referència el punt 16.b que es presenti al final de l'execució ha d'abastar la totalitat del projecte o actuació subvencionada, independentment de les memòries o informació ja aportada per obtenir el pagament parcial previst l'any 2023.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Per tot això, dit la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Medi Ambient i Territori en el termini d'un mes comptador des de l'endemà de la seva publicació en el Butlletí Oficial de les Illes Balears, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació d'aquesta Resolució en el Butlletí Oficial de les Illes Balears, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
