    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ple del Consell de Mallorca, en sessió ordinària de dia 10 de novembre de 2022, ha adoptat l'Acord següent:&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antededents&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 31 de desembre de 1998 es publicà al BOCAIB núm. 167 ext. l'ordenança reguladora del preu públic per prestació de serveis i realització d'activitats en les instal·lacions esportives i culturals del Consell.&amp;nbsp; Aquesta ordenança s'ha modificat en diverses ocasions, que s'han publicat al BOIB núm. 156 de 29 de desembre de 2001, al BOIB núm. 49 ext. de 9 d'abril de 2003, al BOIB núm. 97 d'11 de juliol de 2006,&amp;nbsp; al BOIB núm105 de 18 d'agost de 2016, al BOIB núm. 80 d'1 de juliol de 2017 i finalment al BOIB núm. 55 de 27 d'abril de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En data 27 de setembre de 2022 el conseller executiu d'Hisenda i Funció Pública va adjudicar el contracte d'obra per a la construcció de quatre pistes de pàdel al poliesportiu de Sant Ferran amb un termini d'execució de dos mesos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El tècnic d'esports ha informat sobre la necessitat de modificar l'ordenança reguladora dels preus públics per prestació de serveis i realització d'activitats en les instal·lacions esportives del Consell de Mallorca, atès que s'ha aprovat un reestructuració de la instal·lació esportiva consistent en l'execució de quatre pistes de pàdel en el lloc on s'ubiquen les pistes poliesportives.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En data 19 de setembre de 2022, el conseller executiu de Transició, Turisme&amp;nbsp; i Esports va dictar resolució per la qual s'iniciava l'expedient per modificar l'ordenança reguladora dels preus públics per prestació de serveis i realització d'activitats en les instal·lacions esportives del Consell de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. L'expedient compta amb la memòria econòmica per la inclusió dels preus públics nous pel lloguer de les pistes de pàdel, elaborada pel tècnic d'Esports en setembre de 2022, així com amb la memòria abreujada d'impacte normatiu, elaborada per la cap de Secció Jurídica de la Direcció Insular d'Esports.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Vist l'informe jurídic de la cap de Secció Jurídica de la Direcció Insular d'Esports amb la nota de conformitat de la Secretaria General del Consell de Mallorca de data 11 d'octubre de 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Consideracions jurídiques&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. L'Estatut d'Autonomia de les Illes Balears en la redacció donada per la Llei Orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears, atribueix com competències pròpies dels consells insulars la matèria de l'esport i lleure així com el foment i la promoció de les activitats esportives i de lleure.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'article 10 del Decret d'Organització del Consell de Mallorca vigent adscriu al Departament de Transició, Turisme i Esports la instal·lació del Poliesportiu de Sant Ferran.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. D'acord amb l'article 148 del Reial decret legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei reguladora de les hisendes locals (TRLHL), els Consells Insulars &lt;span style="color:black"&gt;poden establir i exigir preus públics per la prestació de serveis o la realització d'activitats de la seva competència, segons les normes incloses en el capítol VI del títol I de l'esmentat text refós (&lt;/span&gt;articles 41 a 47&amp;nbsp; (TRLRHL).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Els articles 49&amp;nbsp; i 108 de la Llei 7/85, de 2 d'abril, reguladora de les bases de règim local (LRBRL).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Articles 101 a 103 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Vist l'article 17.1 m) de la Llei 4/2022, de 28 de juny, de Consells Insulars, correspon al Ple de la institució l'establiment de preus públics.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Vista la instrucció sobre l'elaboració i tramitació de disposicions generals de caràcter no tributari, aprovada pel Consell Executiu de dia 6 de juny de 2018, modificada per acord del Consell Executiu de dia 26 de febrer de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot l'exposat, el conseller executiu de Transició, Turisme i Esports eleva al Ple del Consell de Mallorca, amb el dictamen previ de la Comissió Informativa General i de Comptes, el següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ACORD&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprovar inicialment la modificació de l'ordenança reguladora dels preus públics per prestació de serveis i realització d'activitats en les instal·lacions esportives del Consell de Mallorca, per incloure els preus públics del lloguer de les pistes de pàdel. Així, la modificació consisteix en:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A l'article 4, als punts que inclouen el concepte Pista poliesportiva: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.2. Pista poliesportiva:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.2.1. Sense llum: 20,00 €/hora&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.2.2. Amb llum: 22,00 €/hora&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.2.2. Amb llum: 11,00 €/hora&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.2.1.Sense llum: 3,00 €/hora&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.2.2. Amb llum: 6,00 €/hora&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El text de l'Ordenança amb la modificació, s'adjunta a aquest Acord.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Sotmetre l'expedient a informació pública mitjançant la inserció dels anuncis corresponents en el tauler d'anuncis del Consell de Mallorca, i en el Butlletí Oficial de les Illes Balears,&lt;em&gt; &lt;/em&gt;amb la finalitat que totes les persones que hi estiguin interessades puguin examinar-lo i presentar les reclamacions que considerin pertinents, dins el termini de trenta dies hàbils, comptadors des de la inserció de l'anunci corresponent en el butlletí. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ordenar que es duguin a terme la resta dels tràmits corresponents per l'aprovació definitiva de l'Ordenança, inclosa la sol·licitud dels dictàmens preceptius.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es pot consultar l'expedient i el text de l'Ordenança reguladora del preu públic per prestació de serveis i realització d'activitats en les instal·lacions esportives i culturals del Consell de Mallorca a la seu electrònica del Consell de Mallorca (&lt;span style="color:null"&gt;https://seu.conselldemallorca.net)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En el cas que no es presentin reclamacions, l'acord inicialment adoptat s'entendrà definitivament aprovat sense necessitat de nou acord plenari i es publicarà el text íntegre de l'Ordenança en el Butlletí Oficial de les Illes Balears.”&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 1&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'acord amb el previst a l'article 41 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei Reguladora de les Hisendes Locals, el Consell de Mallorca estableix els preus públics per prestació de serveis i realització d'activitats –especificant en les tarifes contingudes en l'article quart – en instal·lacions esportives del Consell, que es regeix per aquesta ordenança.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;Article 2 &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Fet imposable&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El fet imposable dels preus públics és la prestació de serveis i realització d'activitats en les instal·lacions esportives del Consell Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Subjecte passiu&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El subjecte passiu són les persones que es beneficiïn dels serveis o activitats realitzades o prestades pel Consell Insular de Mallorca a que es refereix l'apartat anterior. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Meritació i pagament &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El preu públic es merita en el moment en què se sol·licita la utilització de la instal·lació o en el moment de la inscripció a les activitats. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament del preu públic s'ha de realitzar mitjançant ingrés, transferència bancària o mitjançant targeta de crèdit, d'acord amb els documents d'ingrés facilitats pel Consell Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament s'ha de fer abans d'utilitzar la instal·lació o en el moment de la inscripció a les activitats. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Pagament de forma mensual a mes vençut &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament del preu públic per la utilització d'instal·lacions del poliesportiu per centres d'ensenyament de primària o secundària per a la realització de classes d'educació física de manera regular corresponents a l'ensenyament formal, es realitzarà de forma mensual a mes vençut. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix, les persones físiques o jurídiques, públiques o privades que utilitzin les instal·lacions del poliesportiu de manera regular abonaran el preu públic de forma mensual a mes vençut. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;S'entén per persones usuàries regulars les persones físiques o jurídiques, públiques o privades, que tenen reservada una instal·lació determinada del poliesportiu de forma continuada, en horaris i dies fixes, durant un període d'almenys dos mesos. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Devolució d'ingressos indeguts &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es produirà la devolució d'ingressos efectuats per les persones usuàries de les instal·lacions i/o serveis del Poliesportiu Sant Ferran quan una vegada abonat el preu públic corresponent les persones interessades no puguin gaudir de l'ús de les instal·lacions o del servei pel qual s'ha abonat el preu públic. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix s'ha de tramitar la devolució d'ingressos efectuats per persones usuàries quan per error aquests abonen per duplicat un pagament o bé quan es fa per error un pagament superior al preu a abonar. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'expedient de devolució d'ingressos s'iniciarà d'ofici o a instància de les persones interessades i ha de contenir almenys la documentació que acrediti els aspectes següents:&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'ús continuat durant la temporada escolar es regularà seguint aquesta temporalització:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Del 2 de maig al 15 de maig. Presentació de sol·licituds de renovació anual.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Del 1 de juny al 15 de juny. Presentació de noves sol·licituds&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En qualsevol moment de l'any s'admetran sol·licituds de reserva d'instal·lacions d'ús puntual, d'ús no continuat (per una durada inferior al mes) i d'ús continuat (per una durada superior al mes).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tant les reserves per a usos no continuats com per ús continuat es formalitzen una vegada rebut l'ingrés del 10% de la totalitat de la reserva, fins a un màxim de 250 € com a garantia, que s'ha d'abonar en un termini no superior a 5 dies a partir de la confirmació de la reserva per part del Consell de Mallorca. La falta de pagament d'aquesta garantia dins el termini fixat pot suposar perdre la reserva d'espai.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. S'aplicaran els preus públics que es detallen a continuació a les activitats o competicions esportives oficials organitzades per federacions esportives, el Govern de les Illes Balears, entitats públiques de Mallorca i les activitats organitzades per entitats amb finalitat d'integració social, sanitari, humanitari i benèfic. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Preus públics per a les activitats esportives organitzades pel Consell de Mallorca per a persones amb discapacitat, amb greus dificultats econòmiques, famílies nombroses i monoparentals i a les persones de 65 anys o més.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1 Famílies monoparentals &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;S'entén per família monoparental la constituïda per un sol progenitor amb el qual conviuen els fills i filles nascuts o adoptats, que constitueixen el seu únic sosteniment. Aquest aspecte s'acreditarà per la persona interessada en el moment d'abonar el corresponent preu públic. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;S'aplicaran el preus públics relacionats a aquest article al progenitor o progenitora i als fills i filles menors de 18 anys. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2 Famílies nombroses &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Només s'aplicaran aquests preus als progenitors i als fills i filles menors de 18 anys. Aquest extrem acreditarà per la persona interessada aportant el carnet de família nombrosa en el moment d'inscripció en l'activitat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.4 Persones amb greus dificultats econòmiques &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es consideren persones amb greus dificultats econòmiques les que formen part d'una unitat familiar en la qual la suma dels ingressos de tots els seus membres dividit pel nombre de membres, és igual o inferior a l'import de l'IPREM fixat per a l'any que es tracti. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquest extrem acreditarà per la persona interessada aportant la documentació relativa a la darrera declaració d'IRPF de que es disposi en el moment d'inscripció en l'activitat. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Utilització d'instal·lacions del poliesportiu per centres d'ensenyament públics, privats i concertats de primària o secundària per a la realització de classes d'educació física de manera periòdica corresponents a l'ensenyament formal &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Preu públic: 0,50 euros/alumne/hora &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. En el cas que, d'acord amb l'establert a aquesta ordenança se'n puguin derivar varis preus públics, s'aplicarà el que sigui més beneficiós per a l'usuari.&lt;/span&gt;&lt;/p&gt;
