&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist que l'Ajuntament Ple en sessió ordinària celebrada el 27 de setembre de 2022 va aprovar provisionalment l'ordenança fiscal, publicat l'anunci en el BOIB número 128 de data 1 d'octubre de 2022, i atès que no s'han presentat reclamacions contra aquest acord durant el termini d'exposició pública, en virtut de l'article 17.4 del Reial Decret legislatiu, de 5 de març, pel que s'aprova el Text Refós de la Llei Reguladora de les Hisendes Locals, es publica el text integra de l'ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANÇA FISCAL REGULADORA DE LA TAXA DE CEMENTIRI LOCAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 1. Fonament i naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fent ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, i de conformitat amb el que disposen els articles 15 a 19 del RDL 2/2004 del text refós de la LRHL, aquest Ajuntament estableix la "Taxa de Cementiri Local", que es regirà per la present ordenança fiscal, les normes de la qual atenen el que preveu l'article 57 de l'esmentat RDL 2/2004.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 2. Fet imposable&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constitueix el fet imposable de la taxa la prestació dels serveis del Cementiri Local, tals com: assignació d'espais per a enterraments, permisos de construcció de panteons o sepultures, ocupació d'aquests, reducció, incineració, moviment de làpides, col·locació de làpides, reixats i adornaments, conservació dels espais destinats al descans de les persones difuntes i qualsevol altre que, de conformitat amb el que preveu el Reglament de policia sanitària mortuòria, siguin procedents o s'autoritzin a instància de part.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 3. Subjecte passiu&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Són subjectes passius contribuents les persones sol·licitants de la concessió de l'autorització o de la prestació del servei i, si s'escau, les persones titulars de l'autorització concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 4. Responsabilitats&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Respondran solidàriament de les obligacions tributàries del subjecte passiu les persones físiques o jurídiques a les quals es refereix l'article 42 de la Llei 58/2003, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Son responsables subsidiàries les persones responsables de l'administració de les societats, la sindicatura, la intervenció o liquidació de fallides, els concursos, les societats i les entitats en general, en els supòsits i amb l'abast que assenyala l'article 43 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 5. Exempcions subjectives&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estaran exempts els serveis que es prestin en ocasió de::&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les inhumacions que assumeixi l'Ajuntament perquè no es disposi de recursos econòmics tant el propi difunt com els seus familiars obligats per les normes de dret privat al pagament de la prestació del servei d'enterrament, previ informe favorable dels serveis competents en matèria social, sense perjudici que en el cas que posteriorment resulti injustificat la prestació solidària del servei l'Ajuntament pugui reclamar el reintegrament dels costs i les liquidacions de les taxes que siguin d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les inhumacions i exhumacions ordenades per l'autoritat judicial i que s'efectuïn a la fossa comuna..&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Article 6. Quota tributària&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La quota tributària es determinarà per aplicació de la tarifa següent: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 7. Meritació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es merita la taxa i neix l'obligació de contribuir quan s'iniciï la prestació dels serveis subjectes a gravamen. A aquest efecte s'entén que la dita iniciació es produeix amb la sol·licitud d'aquells. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 8. Declaració, liquidació i ingrés &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Els subjectes passius han de sol·licitar la prestació dels serveis de què es tracti. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La sol·licitud de permís per a construcció de mausoleus i panteons ha d'anar acompanyada del corresponent projecte i memòria, autoritzats per un facultatiu competent. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cada servei serà objecte de liquidació individual i autònoma, que serà notificada un cop que s'hagi prestat el dit servei. Els TERMINIS D'INGRÉS en període voluntari de les quantitats esmentades seran els assenyalats en l'article 62 de la Llei 58/2003, general tributària, a) Les notificades entre els dies 1 i 15 de cada mes, fins al dia 20 del mes següent o, si aquest no és hàbil, l'immediat hàbil posterior; b) Les notificades entre els dies 16 i darrer de mes, fins al dia 5 del segon mes posterior o, si aquest no és hàbil, fins a l'immediat hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Un cop transcorregut el període voluntari d'ingrés, es meritarà els recàrrecs assenyalats en l'article 28 de la Llei general tributària. Sense perjudici de les actuacions administratives en matèria d'inspecció tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El LLOC D'INGRÉS en període voluntari serà el compte corrent de l'entitat bancària que a continuació s'indica obert a nom de l'Ajuntament de Llucmajor: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;(aquelles entitats que subscriguin el Conveni Quadern 60)&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas d'haver transcorregut el període voluntari, l'ingrés s'haurà de realitzar a la Tresoreria de l'Ajuntament de Llucmajor, al carrer de la Constitució número 6 del nucli urbà de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Quant als ingressos corresponents al cànon anual per conservació del cementiri per nínxol o tomba, es gestionaran mitjançant Padró, i l'Administració efectuarà una liquidació anual. Els TERMINIS D'INGRÉS en període voluntari de les quantitats esmentades seran els assenyalats en l'article 62 de la Llei 58/2003, general tributària, a) Les notificades entre els dies 1 i 15 de cada mes, fins al dia 20 del mes següent o, si aquest no és hàbil, l'immediat hàbil posterior, b) Les notificades entre els dies 16 i el darrer de mes, fins al dia 5 del segon mes posterior o, si aquest no és hàbil, fins a l'immediat hàbil següent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Un cop transcorregut el període voluntari d'ingrés es meritarà els recàrrecs assenyalats en l'article 28 de la Llei general tributària. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas d'haver transcorregut el període voluntari, l'ingrés s'haurà de realitzar a la Tresoreria de l'Ajuntament de Llucmajor, al carrer de la Constitució número 6 del nucli urbà de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article 9. Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En tot el que fa referència a la qualificació d'infraccions tributàries, així com de les sancions que hi corresponguin en cada cas, s'aplicarà el que disposen els articles 191 i següents de la Llei 58/2003, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposició addicional&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les referències a l'articulat de la present ordenança s'han d'entendre sense perjudici que hagin pogut ser modificades per una normativa posterior a la seva aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposició Derogatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La present ordenança fiscal deroga l'ordenança fiscal reguladora de la taxa de Cementiri Local publicada en el BOIB numero 12 de 24 de gener de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposició final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La present ordenança fiscal entrarà en vigor el mateix dia de la seva publicació en el Butlletí Oficial de les Illes Balears i romandrà en vigor fins a la seva modificació o derogació expresses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
