10 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En no haver-se presentat reclamacions durant el termini d'exposició al públic, queda automàticament elevat a definitiu l'Acord plenari provisional de modificació de l'Ordenança Fiscal Reguladora de de les tarifes del servei públic d'escola infantil de Deià, el text íntegre del qual es fa públic, per al seu general coneixement i en compliment de l'article 17.4 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret Legislatiu 2/2004, de 5 de març.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“ORDENANÇA REGULADORA DE LES TARIFES DEL SERVEI PÚBLIC D'ESCOLA INFANTIL DE DEIÀ”</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 1r.- Concepte</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb allò previst a l'art. 127 en relació amb l'art. 41), ambdós del RDL 2/2004, de 5 de març de març pel que s'aprova el Tex Refós de la Llei Reguladora de les Hisendes Local, aquest Ajuntament estableix els preus públics per al serveis educatius, de guarderia i d'altres prestats per l'Escola Infantil de Deià.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">També es fa conforme al <em>Decret llei 8/2022, de 16 d'agost,</em> <em>de mesures urgents per garantir la gratuïtat de l'educació dels infants matriculats al tercer nivell d'educació infantil als centres de la xarxa pública d'escoles infantils i de la seva xarxa complementària a partir del mes de setembre de 2022, i per a la creació d'un fons extraordinari per compensar una part dels descomptes del transport interurbà a partir de l'1 de setembre de 2022 i fins al 31 de desembre de 2022</em>, a la <em>Llei orgànica 3/2020, de 29 de desembre (LOMLOE)</em>, a la <em>Llei 1/2022, de 8 de març, d'educació de les Illes Balears</em>, a la Llei 9/2019, de 19 de febrer, de l'atenció i els drets de la infància i l'adolescència de les Illes Balears</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquests preus públics estan especificades a les tarifes contingudes als articles 3r i es regiran per la present Ordenança.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 2n.- Obligats al pagament</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estan obligats al pagament de les tarifes regulades per aquesta Ordenança les persones que es beneficiïn dels serveis als quals fa referència l'article anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tendran una bonificació del 10% sobre el preu d'acollida, escolarització i recollida:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1) Les famílies nombroses.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2) Les famílies monoparentals.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3) Les famílies amb un infant matriculat amb necessitats educatives especials.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquelles famílies que tenguin dos o més fills matriculats tendran una bonificació del 50% sobre el preu d'acollida, escolarització i recollida.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 4t.- Obligació de pagament</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Neix des de es moment de la matriculació en ferm a partir del primer dia del curs. Si la matriculació és posterior a l'inici del curs l'obligació de pagament neix a partir de la data de la matriculació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 5è.- Normes de gestió</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament s'efectuarà per mensualitats avançades, i dins els primers cinc dies de cada mes per domiciliació bancària.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el moment de la matrícula el/s progenitor/s o tutor/s legal/s aportaran la documentació acreditativa dels seus ingressos i l'acreditativa de qualsevol supòsit de bonificació. Si no s'aporta es considerarà automàticament que queden acollits a l'opció 3.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el casos de falta de pagament de les tarifes es seguirà el següent procediment:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Falta de pagament durant un mes: la direcció de l'escoleta es posarà en contacte amb la família de l'infant per tal d'aclarir la situació detectada.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Falta de pagament durant dos mesos: la treballadora social de l'Ajuntament es posarà en contacte amb la família de l'infant per tal d'aclarir la situació detectada.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Falta de pagament durant tres mesos: un retard en el pagament de més de tres mensualitats sense motiu que ho justifiqui significarà la baixa de l'infant al centre, previ avís per escrit amb quinze dies d'antelació. Amb anterioritat la direcció de l'escoleta elaborarà l'informe corresponent que remetrà a l'Ajuntament.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 6è.- Exempcions</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A instància de la part interessada i en tot cas previ informe tècnic favorable dels serveis socials, l'Ajuntament pot atorgar l'exempció de tot o part del pagament, quan les circumstàncies socioeconòmiqes del sol·licitant en manifestin la necessitat.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposició transitòria.- Pagaments realitzats en el curs 2022-2023</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta Ordenança no operarà pel que fa a pagaments ja realitzats en el curs 2022-2023, però sí en els que s'hagin d'efectuar a partir de la seva aprovació definitiva. Pel que fa a la previsió de l'article 5è, el/s progenitor/s o tutor/s legal/s que ja hagin matriculat els seus infants aportaran la documentació acreditativa dels seus ingressos i l'acreditativa de qualsevol supòsit de bonificació en 10 dies naturals a partir del dia següent a la seva publicació al BOIB, en què hauran de ser advertits per la direcció del centre. Si no s'aporta es considerarà automàticament que queden acollits a l'opció 3.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposició addicional primera</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cas de modificació de la legislació a què s'ha fet referència en aquesta Ordinança, quederan derogats, en virtut del principi de jerarquia normativa, tots els preceptes que resultin contraris o incompatibles amb la nova situació legislativa. A aquest efecte, les referències fetes al dret positiu en aquest Reglament, s'entendran fetes a les normes que en cada moment estiguin en vigor.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposició addicional segona</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cas que el Parlament de les Illes Balears o el Govern de les Illes Balears aprovàs una legislació per a fer extensiva la gratuïtat de l'educació infantil als cursos 0-1 o 1-2, la batlia de l'Ajuntament de Deià podrà suspendre per Decret de Batlia el cobrament dels preus públics previstos que es vegin afectats pel canvi legislatiu mentre es duu a terme la modificació d'aquesta ordenança.
