    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="background-color:null"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 19 de febrer de 2015 per la qual s'aprova la convocatòria de les ajudes, per al foment de la producció integrada, per l'any 2015&amp;nbsp;(Pròrroga 2021)&amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, &amp;nbsp;procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="background-color:null"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, &amp;nbsp;procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="background-color:null"&gt;El vicepresidenten matèria agrària del FOGAIBA, en data 4&amp;nbsp;de novembre&amp;nbsp;de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.En data de 28 de febrer de 2015 es va publicar, en el BOIB núm. 30, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al foment de la producció integrada.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.En data de 11 de juny de 2015, es va publicar el BOIB núm. 87, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears per la qual s'aprova la convocatòria per l'any 2015 de les ajudes destinades al foment de la producció integrada.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4.En data de 7 de maig de 2016, es va publicar al BOIB núm. 57,la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBa) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 27 de febrer de 2015, per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al foment de la producció integrada.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5.En data de 30 de gener de 2021, es va publicar al BOIB núm.13 la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per l'any 2021, de les ajudes per prorrogar per segon any els compromisos assumits per al foment de la producció integrada en la convocatòria del 2015.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 22 de juliol de 2016 (BOIB núm 95 de 28 de juliol) per la qual es modifiquen els crèdits i els cofinançaments de diverses convocatòries de subvencions del FOGAIBA, corresponents a les mesures contemplades en el Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8.En data 30 de gener de 2021 es va publicar, en el BOIB núm. 13, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2021, de les ajudes per prorrogar els compromisos assumits per al foment de la producció integrada.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;9.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;10.Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors i d'acord amb els criteris d'elegibilitat establerts, els interessats que figuren a l'Annex I no compleixen amb els requisits establerts en la convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;11. En data 14 de gener de 2022 es notifica, mitjançant publicació a la pàgina web http://www.caib.es, l'informe desfavorable i la proposta provisional de denegació de l'ajuda, emesa per Servia d'Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;12.Dins el termini establert, els interessats indicats a l'Annex I adjunt no han presentat al·legacions, o si les han presentades s'han desestimat per seguir incomplint els requisits&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;16.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;17.Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Proposta de resolució de denegació&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l'Annex 1&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
