&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;I&lt;/strong&gt;. Les ordres de funcions són l'instrument tècnic d'ordenació mitjançant el qual l'Administració assigna les funcions als llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En data 28 de maig de 2010, la presidenta de l'Institut Mallorquí d'Afers Socials (en endavant IMAS), va aprovar el Reglament intern pel qual s'atribueixen funcions als llocs de feina adscrits a l'IMAS (en endavant, Reglament intern de funcions), el qual es va publicar al BOIB núm. 82 Ext. de 2 de juny de 2010. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presidència de l'IMAS va modificar en dues ocasions el citat Reglament, els dies 19 de maig de 2011 i el 24 de març de 2014, els quals varen ser publicats al BOIB núm. 99 de 30 de juny de 2011 i núm. 56, de 24 d'abril de 2014, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès les modificació de la relació de llocs de feina de l'IMAS, la presidència de l'IMAS va tornar a modificar el Reglament intern de funcions de forma puntual els dies 6 de setembre de 2017, 4 de desembre de 2017, 22 de novembre de 2018 aquesta darrera publicada al BOIB núm. 12, de 26 de gener de 2019. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Posteriorment, el Reglament intern es va tornar a modificar en data 12 de febrer de 2019 (BOIB núm. 23, de 21 de febrer), 7 de març de 2019 (BOIB núm. 36, de 19 de març), 18 de desembre de 2019 (BOIB núm.8, de 18 de gener de 2020), 3 d'agost de 2020 (BOIB núm. 151, de 1 de setembre) i 15 de juliol de 2021 (BOIB núm. 98 de 22 de juliol de 2021). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;II. &lt;/strong&gt;En virtut de la modificació de la relació de llocs de treball (en endavant RLLT) de l'IMAS mitjançant l'expedient núm. 1/2022 (BOIB núm. 82, de 25 de juny) i la proposta de la direcció insular d'Infància i Família de l'IMAS sobre les funcions genèriques i específiques de determinats llocs de feina, es fa necessari la modificació del vigent reglament intern de funcions de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;III. &lt;/strong&gt;La proposta de resolució de la direcció insular d'Infància i Família a la presidència de l'IMAS de modificació del Reglament intern de funcions dels llocs de feina de l'IMAS i els seus annexos I i II, d'acord amb el procediment d'elaboració establert a la Instrucció 1/2010 de la presidència de l'IMAS, que regula l'establiment dels criteris per a l'elaboració de les propostes d'atribució de funcions als llocs de feina adscrits a les distintes àrees de l'IMAS (en endavant, Instrucció 1/2010).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;IV.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La secretaria en funcions de &lt;/span&gt;&lt;span style="color:#000000"&gt; la Mesa Sectorial de Negociació de l'IMAS, &lt;/span&gt;&lt;span style="color:#000000"&gt;certifica el dia 2&lt;/span&gt;&lt;span style="color:#000000"&gt;7 &lt;/span&gt;&lt;span style="color:#000000"&gt;d'octubre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2022, que a la sessió de la Mesa Sectorial de Negociació de l'IMAS celebrada el 12 d'abril de 2022, es &lt;/span&gt;&lt;span style="color:#000000"&gt; varen negociar i aprovar &lt;/span&gt;&lt;span style="color:#000000"&gt; de les funcions genèriques i específiques les següents modificacions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1&lt;/strong&gt;. L'article 189.3 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears disposa que el personal al servei de les entitats locals de les Illes Balears depèn, orgànicament, del president o la presidenta de la corporació, que n'exerceix el comandament del mateix i, funcionalment, del o de la responsable últims de la unitat administrativa a la qual s'integra el lloc de feina que ocupa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; L'article 34 de la Llei 3/2007, de 27 de març, de la Funció Pública de la Comunitat Autònoma de les Illes Balears, estableix que les ordres de funcions són l'instrument tècnic d'ordenació mitjançant el qual l'administració assigna les funcions als llocs de feina. Així mateix, en el seu apartat 2, estableix que les ordres de funcions son una manifestació de la potestat d'organització i de direcció de l'Administració, se dicten i se modifiquen segons les necessitats del servei i d'acord al procediment establert. L'apartat tercer del mateix article continua dient que les ordres de funcions es publicaran en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;El Reglament intern de funcions aprovat per la Presidència de l'IMAS en data 28 de maig de 2010 publicat al BOIB núm. 82 Ext. de 2 de juny de 2010, després modificat mitjançant dues Resolucions de la presidència de l'IMAS dels dies 19 de maig de 2011 i 24 de març de 2014 publicats al BOIB núm. 99 de 30 de juny de 2011 i al BOIB núm. 56, de 24 d'abril de 2014, respectivament. Posteriorment, la presidència de l'IMAS ho va tornar a modificar puntualment els dies 6 de setembre de 2017, 4 de desembre de 2017, 22 de novembre de 2018 (BOIB núm. 12, de 26 de gener de 2019), 12 de febrer de 2019 (BOIB núm. 23 de 21 de febrer), 7 de març de 2019 (BOIB núm. 36 de 19 de març), 18 de desembre de 2019 (BOIB núm.8, de 18 de gener de 2020), 3 d'agost de 2020 (BOIB núm. 151 de 1 de setembre) i 15 de juliol de 2021 (BOIB núm. 98 de 22 de juliol)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; La modificació de RLLT de l'IMAS que afecta a aquesta modificació del Reglament intern de funcions és l'aprovada mitjançant Acord de Ple de dia 12 de maig de 2022 relatiu a l'expedient núm. 1/2022 publicat al BOIB núm. 82, de 25 de juny de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; L'article 1.4 de la Instrucció 1/2010 disposa que a l'empara de la potestat d'autoorganització, la presidenta de l'IMAS determina discrecionalment les funcions que corresponen als llocs de feina integrats dins la seva estructura orgànica, tot respectant el contingut essencial de les funcions de la subescala, classe i especialitat i els criteris establerts a l'esmentada instrucció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; L'article 9.4 de la Instrucció 1/2010, determina que una vegada fermes les propostes es lliuraran als representants sindicals en el si de la Mesa Sectorial de Negociació de l'IMAS. Respecte a l'aprovació i publicació, el president a proposta de la direcció insular de infància i família aprovarà el Reglament d'atribució de funcions als llocs de feina de l'IMAS. Finalment, al punt 5, estableix que aquest Reglament s'ha de publicar al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;L'article 16.6 dels Estatuts de l'IMAS (BOIB núm. 67, de 18 de maig de 2019), estableix que la Presidència determina les funcions dels llocs de treball adscrits a l'Institut Mallorquí d'Afers Socials, les quals s'han de publicar al Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer&lt;/strong&gt;.-MODIFICAR el Reglament intern de funcions de l'IMAS, de 28 de maig de 2010, pel qual s'atribueixen funcions als llocs de feina adscrits a l'IMAS, en el sentit que consta en els annexos I i II, els quals s'adjunten a aquesta Resolució. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon&lt;/strong&gt;.- ORDENAR la publicació d'aquesta modificació en el Butlletí Oficial de les Illes Balears que entrarà en vigor a partir del dia següent de la seva publicació i la publicació del text consolidat del Reglament intern de funcions de l'IMAS a la Seu Electrònica del Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28 dels Estatuts de l'Institut Mallorquí d'Assumptes Socials aprovats pel Ple del Consell de Mallorca de data 11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, en el termini d'un mes, comptat a partir de l'endemà de la notificació de la present resolució. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptats a partir de l'endemà de la notificació de la desestimació de l'esmentat recurs. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir de l'endemà de la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No obstant l'anterior, es pot exercitar, si escau, qualsevol altre recurs que s'estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciós Administrativa, i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
