&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El Ple de l&amp;apos;Ajuntament d&amp;apos;Alaior, en sessió ordinària de dia 5 de juliol de 2022 acordà, entre altres, aprovar inicialment la modificació de l&amp;apos;ordenança fiscal reguladora de la taxa per a l&amp;apos;entrada de vehicles a través de les voreres, reserves de la via pública per a aparcament, càrrega i descàrrega de mercaderies de qualsevol classe, i l&amp;apos;obertura d&amp;apos;un termini d&amp;apos;exposició pública de 30 dies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Atès que no s&amp;apos;han presentat al·legacions, s&amp;apos;entén aprovada definitivament i es procedeix a la publicació íntegre del text:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 1&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Objecte&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;De conformitat amb el que preveu l&amp;apos;article 20.3 &lt;/span&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;h&lt;/span&gt;&lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; del RDLEG 2/2004, de 5 de març, Text refós de la Llei reguladora de les hisendes locals, aquest Ajuntament estableix la taxa per utilització privativa i aprofitaments especials per a entrades de vehicles a través de les voreres i la reserva de la via pública per a aparcaments exclusius, càrrega i descàrrega de mercaderies de qualsevol classe, especificat en les tarifes contingudes en l&amp;apos;apartat 2 de l&amp;apos;article 3 següent, que es regeix per aquesta Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 2&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Obligades a pagar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Estan obligades a pagar la taxa regulada en aquesta Ordenança les persones o entitats a favor de les quals s&amp;apos;atorguin les llicències o les que es beneficiïn de l&amp;apos;aprofitament si es procedeix sense autorització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 3&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Quantia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Les tarifes de la taxa són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Tarifa primera&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Entrada de vehicles en edificis o cotxeres particulars o aparcaments de propietat dins d&amp;apos;un aparcament general i els situats en zones o carrers particulars que formen part de comunitats de propietaris, amb prohibició d&amp;apos;aparcament per a vehicles que no siguin de propietat d&amp;apos;alguna persona membre de la comunitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a) &lt;/em&gt;Per cada plaça d&amp;apos;aparcament amb referència cadastral individualitzada o que constitueixi un local independent ..............&amp;nbsp;20,00&amp;nbsp;€/any&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;em&gt;b) &lt;/em&gt;&lt;span style="color: rgb(0, 0, 0); font-family: &amp;quot;Times New Roman&amp;quot;, Times, serif"&gt;Per les places d&amp;apos;aparcament en habitatges unifamiliars sense referència cadastral individualitzada, per formar part de l&amp;apos;habitatge:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Entrada en garatges o locals per guardar-hi vehicles, amb la possibilitat de realitzar-hi reparacions de vehicles, prestació de serveis de greixatge, rentatge, polvoritzacions amb petroli, etc., o reposar carburants:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Reserva d&amp;apos;espais a les vies i terrenys d&amp;apos;ús públic concedits a hotels, entitats o particulars per a aparcament exclusiu o prohibició d&amp;apos;estacionament. Han de satisfer, a l&amp;apos;any, per cada 5 metres lineals o fracció .................................................................................. 20,50&amp;nbsp;€/any&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0); font-family: &amp;quot;Times New Roman&amp;quot;, Times, serif"&gt;2. Reserva d&amp;apos;espais o prohibició d&amp;apos;estacionament a les vies, terrenys d&amp;apos;ús públic per a principi o final de parades de línies de serveis, regulars interurbans de transports col·lectius de viatgers, serveis discrecionals d&amp;apos;excursions i d&amp;apos;agències de turisme i anàlegs:&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;- Per cada 5 metres lineals o fracció de calçada que abasti la reserva d&amp;apos;espai, a l&amp;apos;any......................................................................28,70&amp;nbsp;€/any&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 4&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Bonificació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;S&amp;apos;estableix una bonificació de l&amp;apos;1,5&amp;nbsp;% de l&amp;apos;import, a favor dels subjectes passius que hagin domiciliat els seus deutes corresponents a aquesta taxa a una entitat financera, sempre que aquests siguin abonats en el moment de presentar-los a cobrament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;En cas de manca d&amp;apos;abonament del rebut domiciliat en el moment de la seva presentació al cobrament, excepte quan concorrin circumstàncies de caràcter excepcional, alienes a la voluntat del subjecte passiu, es perdrà el dret a la bonificació esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 5&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Normes de gestió&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Les quantitats exigibles d&amp;apos;acord amb les tarifes s&amp;apos;han de liquidar per cada aprofitament sol·licitat o realitzat i són irreductibles pels períodes naturals de temps, assenyalats en els epígrafs respectius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. Les persones o entitats interessades en la concessió d&amp;apos;aprofitaments regulats en aquesta Ordenança hauran de sol·licitar, prèviament a la llicència corresponent, realitzar el dipòsit previ a què es refereix l&amp;apos;article següent i formular declaració adjuntant-hi un plànol detallat de l&amp;apos;aprofitament i de la seva situació dintre del municipi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Els serveis tècnics d&amp;apos;aquest Ajuntament hauran de comprovar i investigar les declaracions formulades per les persones interessades, i es concediran les autoritzacions si no es troben diferències amb les peticions de llicències. Si hi hagués diferències, es notificaran a les persones interessades i es giraran, si escau, les liquidacions complementàries que escaiguin. Es concediran les autoritzacions una vegada les persones interessades hagin esmenat les diferències i, si escau, una vegada fets els ingressos complementaris que siguin procedents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. En cas de denegar-se les autoritzacions, les persones interessades podran sol·licitar a aquest Ajuntament la devolució de l&amp;apos;import ingressat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Una vegada autoritzada l&amp;apos;ocupació s&amp;apos;entendrà prorrogada mentre no es presenti la declaració de baixa per part de la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. La presentació de la baixa tindrà efectes a partir del dia primer de l&amp;apos;any natural següent al de la seva presentació. La no-presentació de la baixa determinarà l&amp;apos;obligació de continuar abonant la taxa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 6&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Meritació i ingrés&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. La meritació de la taxa regulada en aquesta Ordenança es produeix:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a)&lt;/em&gt; Si es tracta de concessions de nous aprofitaments de la via pública, en el moment de sol·licitar la llicència corresponent, o bé en el moment en què s&amp;apos;iniciï l&amp;apos;aprofitament especial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;b)&lt;/em&gt; Si es tracta de concessions d&amp;apos;aprofitaments autoritzats i prorrogats, el dia primer de cada any natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. El pagament de la taxa s&amp;apos;ha d&amp;apos;efectuar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a)&lt;/em&gt; Si es tracta de concessions de nous aprofitaments que requereixin sol·licitud, mitjançant autoliquidació, i en els casos en què no sigui necessari presentar sol·licitud, s&amp;apos;emetrà la corresponent liquidació tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;b)&lt;/em&gt; Si es tracta de concessions d&amp;apos;aprofitaments ja autoritzats i prorrogats, una vegada inclosos en els padrons o matrícules d&amp;apos;aquesta taxa, es gestionaran mitjançant padró o matrícula i s&amp;apos;haurà d&amp;apos;efectuar el pagament dins el període indicat en el corresponent anunci de cobrança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Article 7&lt;span style="display: block; line-height: 1.6; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Dret supletori&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per al procediment de recaptació s&amp;apos;aplicarà supletòriament la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Disposició final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La present Ordenança fiscal entrarà en vigor l&amp;apos;endemà de la seva publicació en el BOIB i serà d&amp;apos;aplicació fins que es modifiqui o derogui expressament.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
