    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de febrer de 2016 per la qual s'aprova la convocatòria de les ajudes, per al foment de la producció integrada, per l'any 2016&amp;nbsp;(Pròrroga 2021)&amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, &amp;nbsp;procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, &amp;nbsp;procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 26&amp;nbsp;de setembre&amp;nbsp;de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.En data de 1 de març de 2016 es va publicar, en el BOIB núm. 28, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2016 de les ajudes destinades al foment de la producció integrada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.En data de 30 de gener de 2021 es va publicar, en el BOIB núm.13, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per l'any 2021 de les ajudes destinades al foment de la producció integrada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.En data de 22 de juliol de 2022 es va publicar a la web del FOGAIBA la proposta provisional de denegació amb l'annex I, que atorgava 10 dies per presentar les al·legacions corresponents.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Durant aquest termini establert no s'han esmenat deficiències per part dels interessats, figurant a l'annex I aquelles persones o entitats que finalment no ho han fet i que per tant, no compleixen els requisits per ser beneficiàries de l'ajuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28 de gener de 2021 per la qual s'aprova la convocatòria per a l'any 2021 de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques, &amp;nbsp;publicada al BOIB núm. 13 de dia 30 de gener de 2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Reglament delegat (UE) núm. 2016/1393 de la Comissió, de 4 de maig de 2016, que modifica el Reglament Delegat (UE) 640/2014, pel qual es completa el Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control i a les condicions sobre la denegació o retirada dels pagaments i sobre les sancions administratives aplicables als pagaments directes, a l'ajuda al desenvolupament rural i a la condicionalitat.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. Reglament d'execució (UE) núm. 809/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control, les mesures de desenvolupament rural i la condicionalitat. I el Reglament d'execució (UE) núm. 2020/501 de la Comissió, de 6 d'abril de 2020, pel qual s'estableixen excepcions a lo disposat en el Reglament d'Execució (UE) núm. 809/2014.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'agricultura i a la ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10. Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;15. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;16. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Proposta de resolució de denegació&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per tot això, s'informa &amp;nbsp;i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Denegar la sol·licitud d'ajuda a les persones detallades a l'annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Informar als beneficiaris que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm. 4 de Palma)&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Publicar la resolució al BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
