&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;En data de 30 d&amp;apos;agost de 2022 la presidenta de l&amp;apos;institut Mallorquí d&amp;apos;Afers Socials (en endavant, IMAS) va dictar Resolució per a la convocatòria de la concertació d&amp;apos;urgència del Servei de centre de dia per a gent gran en situació de dependència en el terme municipal de Palma i va aprovar els Plecs de prescripcions tècniques per a regir l&amp;apos;acció concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Des de la direcció insular d&amp;apos;Atenció Sociosanitària , s&amp;apos;ha trobat una errada material en el apartat cinquè &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;«Mitjans humans i ràtios» &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;del Plec de prescripcions tècniques aprovat en la Resolució abans esmentada, ja que &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;On diu&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;« D&amp;apos;acord amb l&amp;apos;article 21 del Decret 86/2010, de 25 de juny, per prestar el servei de centre de dia per a &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;persones majors, l&amp;apos;entitat ha de disposar del personal necessari per garantir una atenció suficient, continuada i adequada a les necessitats de cada persona usuària, amb les següents ràtios mínimes per cada 100 persones usuàries:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Per tant, es adient la rectificació de l&amp;apos;apartat indicat en el Plec de prescripcions tècniques i l&amp;apos;ampliació del termini per a la presentació de sol·licituds en 3 dies hàbils. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;1.&lt;/strong&gt; Els Estatuts de l&amp;apos;Institut Mallorquí d&amp;apos;Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d&amp;apos;abril de 2019, en especial l&amp;apos;establert a l&amp;apos;article 2 d&amp;apos;acord amb el qual l&amp;apos;Institut Mallorquí d&amp;apos;Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Drets Socials del Consell de Mallorca, és l&amp;apos;organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Decret de la Presidència del Consell de Mallorca, &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de dia 8 de juliol de 2019,modificat per el Decret de la Presidència de dia 28 de desembre de 2021, pel qual es creen els departaments que n&amp;apos;han d&amp;apos;estructurar el govern (BOIB núm. 92, de 9 de juliol de 2019, BOIB 180 de 30 de desembre de 2021), entre els quals es troba el Departament de Drets Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;3. &lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de dia 12 de novembre de 2021 (BOIB núm. 158 de 16 de novembre de 2021) per el que es nomenada la Sra. Sofia Alonso Bigler consellera executiva de Drets Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;4. &lt;/strong&gt;L&amp;apos;òrgan competent per aprovar aquesta resolució és la Presidència de l&amp;apos;IMAS, d&amp;apos;acord amb l&amp;apos;article 7.2.28 dels Estatuts de l&amp;apos;IMAS (BOIB núm. 67, de 18 de maig de 2019). No obstant això, i d&amp;apos;acord amb l&amp;apos;article 8.2.1 les Vicepresidències de l&amp;apos;IMAS supliran a la Presidència i assumiran les seves atribucions en cas de vacant, absència, malaltia, impossibilitat física o una altre causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;5.&lt;/strong&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;La Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d&amp;apos;octubre de 2015). En particular l&amp;apos;article 109.2 que recull «&lt;em&gt;Les administracions públiques podran, així mateix, rectificar en qualsevol moment, d&amp;apos;ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d&amp;apos;acord amb l&amp;apos;article 28.1 dels Estatuts de l&amp;apos;IMAS aprovats per Acord del Ple del Consell de Mallorca d&amp;apos;11 d&amp;apos;abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d&amp;apos;alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d&amp;apos;un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Contra la desestimació expressa del recurs d&amp;apos;alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l&amp;apos;esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Contra la desestimació per silenci del recurs d&amp;apos;alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s&amp;apos;hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 100%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;No obstant l&amp;apos;anterior, es pot exercitar, si n&amp;apos;és el cas, qualsevol altre recurs que s&amp;apos;estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
