text/html ca 2022-09-15 CAIB ![CDATA[<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Decret de Batlia</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.<strong> </strong><span style="color:black">Per mitjà de Decret de Batlia de 23 de maig de 2022 (BOIB núm. 68, de 26 de maig) es va aprovar l'oferta d'ocupació pública d'estabilització corresponent al personal funcionari de l'Ajuntament de Calvià, en el marc de la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat en l'ocupació pública, així com l'oferta d'ocupació pública ordinària corresponent a l'any 2022.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Contra aquest Decret de Batlia (BOIB núm. 68, de 26 de maig) d'aprovació de les ofertes públiques esmentades, per la senyora Maria José Allès Marquès, en representació del senyor Pau Genestar Allès, es va interposar recurs de reposició atès que en la relació de places ofertes no es va determinar la reserva de la quota del 7% per a persones amb discapacitat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. El recurs de reposició s'ha estimat en part mitjançant Decret de data 18/08/2022, per la qual cosa obliga aquesta Administració a modificar l'oferta d'ocupació pública ordinària de l'any 2022,&nbsp; amb la reserva d'una quota no inferior al set per cent de les places vacants per ser cobertes entre persones amb discapacitat.&nbsp; En aquest sentit, es modifica la relació de places de l' oferta ordinària de l'any 2022 amb la reserva de 5 places vacants entre persones amb discapacitat que són: 3 places d'auxiliar d'administració general, 1 plaça d'administratiu/iva d'administració general i 1 plaça de tècnic/a d'administració general (TAG). </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. Així mateix, en el Decret de Batlia&nbsp; de 23 de maig de 2022, que va aprovar les ofertes d'ocupació pública d'estabilització i ordinària de l'any 2022, s'han advertit errors materials que s'han de rectificar.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En concret, s'han detectat 3 places d'auxiliar d'administració general, 2 places pel sistema de concurs de mèrits i 1 plaça pel sistema de concurs-oposició, incloses en l'oferta d'ocupació pública d'estabilització, en el marc de la Llei 20/2021, de 28 de desembre, que no compleixen els requisits de temporalitat i que, per tant, s'han d'excloure de l'oferta. Així, el total de places d'auxiliar d'administració general a estabilitzar pel sistema de concurs són 24 places en lloc de les 26, i pel sistema de concurs-oposició són 11 places en lloc de les 12 previstes inicialment.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">També s'ha advertit un segon error material consistent en que de les 24 places d'auxiliar d'administració general ofertes pel sistema de concurs, una plaça correspon al torn reservat a persones amb discapacitat, i així s'ha de indicar en el llistat de places.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">I, per últim, s'ha d'excloure una plaça d'auxiliar administració general de l'oferta d'ocupació ordinària corresponent a l'any 2022 al haver-la comptabilitzada com a plaça vacant quan en realitat no ho és.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que aquestes poden rectificar en qualsevol moment, d'ofici o a instància de les persones interessades, els errors materials, de fet o aritmètics que hi hagi en els seus actes.&nbsp; </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Atès que correspon a aquesta Tinença de Batlia aprovar les ofertes d'ocupació pública, cal que l'òrgan esmentat aprovi aquest decret a fi que les modificacions i rectificacions siguin vàlides.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">1. L'article 91.1 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, així com l'article 128.1 del Reial decret legislatiu 781/1986, de 18 d'abril, pel qual s'aprova el text refós de les disposicions legals vigents en matèria de règim local.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">2. L'article 2 i Disposició addicional 6ª de la <span style="color:black">Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat en l'ocupació pública.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. L<span style="color:black">'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span> </span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquesta Tinença de Batlia, en virtut de la facultat que li confereix l'article 21.1.h) de la Llei 7/1985, de 2 d' abril de les Bases de Règim Local, dicta la següent</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Resolució&nbsp;</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. M<span style="color:black">odificar l'oferta d'ocupació pública ordinària corresponent a l'any 2022, amb la reserva de cinc places vacants per ser cobertes entre persones amb discapacitat en els termes que s'indiquen en l'Annex 2 d'aquesta resolució.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2.
