text/html CAIB 2022-09-12 38018 664582 CAIB 38016 470 CAIB ca ![CDATA[Acord aprovació preu públic per a les prestacions de serveis de l’escola infantil pública i altres serveis educatius de 0 a 3 anys]] 514254 2022-09-15 ca 2022-09-15 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Pel Ple de la Corporació Municipal, reunit en sessió extraordinària dia 9 de setembre de 2022, es va adoptar, entre d'altre, l'acord següent:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">«<strong>PRIMER.</strong> Aprovar l'establiment de preus públics i l'Acord regulador d'aquests, segons es transcriu a continuació:</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Preu públic per a les prestacions de serveis de l'escola infantil pública i altres serveis educatius de 0 a 3 anys</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 1r </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>OBJECTE I FONAMENT </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el que disposa l'article 41 de l'RDL 2/2004 pel qual s'aprova el text refós de la Llei reguladora de les hisendes locals, aquest ajuntament acorda establir en aquest terme municipal el preu públic relatiu per a les prestacions de serveis de l'escola infantil pública i altres serveis educatius de 0 a 3 anys. Serà d'aplicació a aquest preu públic la regulació que disposen els articles que van del 41 al 48 de la Llei 39/1988, reguladora de les hisendes locals. </span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 2r </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>OBLIGATS AL PAGAMENT </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estan obligats al pagament dels preus públics continguts en aquesta normativa: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Les persones físiques o jurídiques (pares, mares o qui ostenti la tutoria dels infants) que es beneficien dels serveis educatius prestats per les escoles infantils públiques. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) O, si escau, qui pugui estar obligat al pagament dels aliments d'aquests conformement al que preveu el Codi Civil. </span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTICLE 3r </strong></span></p> <p style="margin-bottom:0px; font-size:12px">La quantia a exigir per la prestació dels serveis es determinarà en funció de les tarifes següents, segons els trams horaris i els serveis que s'ofereixen en cadascun d'aquests trams:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>NORMES DE GESTIÓ </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Les tarifes mensuals s'han d'abonar dins els deu primers dies per domiciliació bancària, excepte el primer mes d'admissió, que s'abonarà abans de l'inici del servei.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Les altes que es produeixin dins els quinze primers dies de cada mes abonaran la quota mensual.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Les famílies amb una problemàtica social greu, previ informe motivat del Departament de Serveis Socials, estaran exempts. Aquesta exempció serà de caràcter pregat i resolta la petició d'exempció per Decret de la Regidoria de Serveis Socials.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En el cas que algun usuari pugui ser inclòs en distints grups de tarifes, el preu públic a aplicar serà el de menor quantia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Les baixes definitives en la prestació del servei o les modificacions en el règim d'estada han de ser comunicades pels pares o tutors amb anterioritat al dia 20 del mes anterior en què hagin de produir efecte, i han de ser presentades amb l'imprès elaborat a aquest efecte en el registre general d'entrada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La falta d'assistència d'un infant durant un període d'un mes sense avís previ implica la baixa definitiva de l'escola, sense que això afecti el rebut del mes no assistit. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7. Igualment implica la baixa definitiva de l'escola l'impagament d'un rebut en el termini establert.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Si com a conseqüència d'una malaltia un infant no assisteix a l'escola en un període igual o superior a un mes, els pares, mares o tutors poden sol·licitar la devolució de la meitat de la quota corresponent. Cal acompanyar la sol·licitud de devolució de quota per malaltia amb un certificat mèdic en el qual consti el motiu i la durada de la baixa. Posteriorment, l'Ajuntament ha de sol·licitar un informe a l'escola infantil que corrobori la no-assistència.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Per l'aplicació de les quotes contemplades per les famílies nombroses i famílies monoparentals hauran d'aportar el carnet de família nombrosa o família monoparental en vigor.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Per l'aplicació de les quotes contemplades per les famílies que tinguin un fill amb necessitats educatives especials hauran d'aportar l'informe de l'especialista corresponent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Per l'aplicació de les quotes contemplades per les famílies que tinguin un fill amb discapacitat igual o superior al 33% hauran d'aportar la declaració administrativa de discapacitat expedida per l'òrgan competent de la Comunitat Autònoma o certificat de l'IMSERSO.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. L'import diari es pagarà el mateix dia directament al centre centre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.
