&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 29&amp;nbsp;d'agost&amp;nbsp;de 2018&amp;nbsp;per la qual es convoquen, ajudes de minimis per a projectes pilot i suport al desenvolupament de nous productes, pràctiques, processos i tecnologies , corresponents a l'any 2018, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 22&amp;nbsp;de juliol de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;INFORME/PROPOSTA/RESOLUCIÓ D'ACCEPTACIÓ DE RENÚNCIA I REVOCACIÓ TOTAL&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;Programa de Desenvolupament Rural de les Illes Balears 2014-2020&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Convocatòria:COPPI 2018_1&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. En data 23/10/2018 va tenir entrada en el Registre del GOVERN DE LES ILLES BALEARS, número registre 23357, la sol·licitud d'ajuda presentada per CAMP MALLORQUI FRUITS SOC. COOP. amb NIF F57658643, per a la convocatòria 2018_1 de la línia de Projectes pilot i &amp;nbsp;desenvolupament de nous productes, pràctiques, processos i tecnologies.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. En data 28/01/2021 el vicepresident del FOGAIBA va dictar Resolució de concessió de l'ajuda, a favor de l'interessat, per un import de 72.824,00 €, finançat 100% per l'ITS 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. El dia 23/05/2022 amb número de registre REGAGE22e00020226948&amp;nbsp;l'interessat presenta el desistiment de la subvenció concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Atès tot això, es proposa fer la revocació total a causa de la renúncia de l'ajuda concedida pel beneficiari que s'indica en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 01 de setembre de 2018, per la qual es convoquen subvencions per donar suport a projectes pilot i al desenvolupament de nous productes, pràctiques, processos i tecnologies per a l'any 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Llei 39/2015, de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement&amp;nbsp;la renúncia i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Acceptar la renúncia presentada per &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;CAMP MALLORQUI FRUITS SOC. COOP.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a l'ajuda concedida per la Resolució del vicepresident del FOGAIBA de dia 28 de gener de 2021&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar l'ajuda concedida en la resolució del vicepresident del FOGAIBA de dia 28 de gener de 2021, corresponent a l'expedient COPPI 2018_1/004 i per l'import indicat en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Declarar conclòs el procediment i arxivar l'expedient COPPI 2018_1/004 .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Notificar aquesta resolució mitjançant la publicació en el Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
