2022-08-16 460 CAIB 663899 ![CDATA[Control de les zones d’estacionament regulat establertes a l’Ordenança reguladora de l'ORA i identificació dels controladors]] 34591 CAIB text/html ca 2022-08-18 ca CAIB 2022-08-18 ![CDATA[<p style="margin-bottom:0cm; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓ D'ALCALDIA</strong></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A la vista dels antecedents següents:</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès el Real Decret Legislatiu 6/2015 de 30 d'octubre, pel qual s'aprova el text refós de la Llei sobre Trànsit, Circulació de Vehicles a motor i Seguretat Vial, on s'atribueix als municipis la competència de regulació, gestió, vigilància i disciplina del trànsit a les vies urbanes de titularitat municipal.</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atesa l'Ordenança Municipal de la taxa per a l'autorització administrativa de l'estacionament de vehicles de tracció mecànica en els espais públics municipals (ORA), publicada al BOIB n.º 82, el 25 de juny de 2022, on s'estableix, en el seu article:</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.4. Les zones d'estacionament regulat podran ser: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-ORA (Operació de Regulació d'Aparcament): Quan es subjecti l'estacionament al previ pagament de la taxa establerta. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-ZAR (Zona d'Aparcament Restringit): Quan es reservi l'estacionament exclusivament per als residents, independentment que dit règim coexisteixi, o no, amb altre tipus de regulació d'aparcament, en els termes definits per l'article 12 de la present ordenança.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- SER (Servei d'estacionament regulat): Zones reservades a l'estacionament de residents de la zona i d'altres usuaris no residents. Els usuaris no residents estaran obligats a indicar de manera visible en el vehicle la data i hora d'arribada tenint en compte el temps d'estacionament màxim a la zona establert a la senyalització vertical. Aquesta zona pot crear-se per un període de temps i horari determinat.</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que l'Entitat Pública Empresarial Sóller 2010 gestiona el servei públic de l'ORA mitjançant encomana de gestió aprovada pel Ple de l'Ajuntament de Sóller en data 26 de novembre de 2004. </span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que tot el personal específic destinat a controladors ORA ha rebut la formació adient en vers l'ordenança municipal reguladora de de la taxa per a l'autorització administrativa de l'estacionament de vehicles de tracció mecànica en els espais públics municipals (ORA).</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que l'estacionament a zona regulada, no implica el desconeixement de les normes de circulació, ni l'abonament del preu públic dóna dret a no complir la resta de la normativa.</span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atesa la potestat reguladora de l'administració municipal, d'acord a la Llei 7/1985, de 2 d'abril, Reguladora de les bases de Règim Local.</span></p> <p style="margin-bottom:0cm"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En conseqüència, <strong>RESOLC:</strong></span></p> <p style="margin-bottom:0cm"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">PRIMER</span></strong><strong>.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- El control de l'estacionament a les zones d'estacionament regulat, serà dut a terme de manera directa pel personal de Sóller 2010, adscrit al servei de controladors ORA.</span></p> <p style="margin-bottom:0cm"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">SEGON</span></strong><strong>.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Que a les zones d'estacionament regulat, que marca l'Ordenança ORA, puguin denunciar les infraccions incloses a l'article 18 de la mateixa Ordenança, corresponents a:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em>1. Estacionar sense exhibir el tiquet o exhibint el corresponent en zona tarifària distinta.</em></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>2. Estacionar superant el temps autoritzat segons el tiquet. </em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>3. Estacionar col·locant defectuosament el tiquet, de forma que no permeti la seva lectura des de l'exterior del vehicle. </em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>4. Estacionar col·locant nou tiquet, ocupant un estacionament situat a menys de 150 metres al que s'ha utilitzat anteriorment, durant el període dels 30 minuts següents a l'hora de finalització del temps màxim autoritzat. </em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>5.Estacionar exhibint comprovant horari o distintiu falsificats o manipulats.</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>6. Estacionar exhibint distintiu en els següents supòsits: </em></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- Una vegada transferida la propietat del vehicle per al qual es va atorgar. </em></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- En vehicle distint a l'autoritzat. </em></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>- Amb posterioritat al canvi de domicili del titular del mateix.</em></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>7. Estacionar exhibint un tiquet amb tarifa de resident on la matrícula no correspongui al vehicle estacionat.</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>8. Obtenir el distintiu mitjançant l'empadronament o transferència del vehicle ficticis. </em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>9. Estacionar un vehicle prohibit a zona d'ORA.</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>10. Estacionar a zona ZAR sense el corresponent distintiu.</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>11. Estacionar a zona SER sense indicar l'hora d'arribada.</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>12. Excedir el temps d'estacionament màxim a zona SER.</em></span></p> <p style="margin-bottom:0cm"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">TERCER</span></strong><strong>.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> El personal controlador de l'estacionament regulat anirà vestit amb uniformitat proporcionada per Sóller 2010 i amb identificació, així com amb peces d'alta visibilitat.</span></p> <p style="margin-bottom:0cm"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">QUART</span></strong><strong>.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Els controladors de l'estacionament regulat tindran assignat un distintiu identificatiu que serà el que figurarà al butlletí de denuncies. Aquest distintiu es correspon amb la següent grafia: C000, on C és invariable, 000 es correspon al nombre de controlador, que s'assigna de manera correlativa natural.</span></p> <p style="margin-bottom:0cm"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">CINQUÈ</span></strong><strong>.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> La relació actualitzada, amb detall de la identificació del servei de vigilància de l'estacionament regulat, que no siguin agents de l'autoritat, amb expressió del nom, llinatges, adreça, les tres darreres xifres del seu NIF i lletra, així com el número d'identificació és la que figura al punt sisè. En les notificacions que es tramitin, en el seu cas, es farà constar el número de controlador i la referencia del present BOIB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SISÈ.-</strong> D'acord amb allò dispost a l'article 87.2 del Real Decret 6/2015, de 30 d'octubre pel que s'aprova el text consolidat de la Llei de Trànsit, Circulació, Vehicles a motor i Seguretat Vial, mitjançant la present publicació es facilita les dades d'identificació dels denunciants:</span></p> <table border="1" style="border:1px solid #000000;
