També l'article 29.2.y) de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, assenyala que els municipis tenen competències en regulació i gestió dels equipaments esportius i d'oci i promoció d'activitats. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquestes bases i convocatòria s'emmarquen en el Pla Estratègic de Subvencions 2022 de l'Ajuntament de Llucmajor, publicat en el BOIB núm. 87, de 5 de juliol de 2022, per fomentar l'esport en totes les categories i classes. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta convocatòria es regeix pels principis de publicitat, transparència, concurrència, objectivitat, igualtat i no discriminació, així com pels d'eficàcia en el compliment dels objectius fixats i eficiència en l'assignació i la utilització dels recursos públics.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Règim jurídic</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En tot el que no regulen aquestes bases i convocatòria serà d'aplicació:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Llei 38/2003, de 17 de novembre, general de subvencions (LGS), i el Reglament general de subvencions 887/2006, aprovat el 21 de juliol.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (LPAC).</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Reial decret 203/2021, de 30 de març, pel qual s'aprova el Reglament d'actuació i funcionament del sector públic per mitjans electrònics.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Reial decret legislatiu 2/2004, pel qual s'aprova el text refós de la Llei reguladora de les hisendes locals.,</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Reglament de serveis de les corporacions locals, de 17 de juny de 1955.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les Bases d'execució del Pressupost Municipal de l'any en curs.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1. Objecte i finalitat de la convocatòria</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'objecte d'aquestes bases i convocatòria és regular la concessió d'ajuts i subvencions econòmiques per al desenvolupament de l'activitat esportiva realitzada atenent la temporalització que es fa en el punt 7, que l'Ajuntament de Llucmajo<span style="color:black">r atorgarà a: </span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA A: clubs i associacions esportives sense ànim de lucre</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA B: esportistes individuals</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA C: associacions i entitats no esportives sense ànim de lucre</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La finalitat d'aquesta convocatòria és promoure i facilitar l'accés a l'esport i la seva pràctica, així com donar suport a totes les persones que el practiquen i a les que en promouen la pràctica al terme municipal de Llucmajor.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2. Dotació econòmica i crèdit pressupostari</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a les subvencions que regulen aq<span style="color:black">uestes bases es destina un import màxim de 80.000 €, a càrrec de l'aplicació pressupostària 100002 340 48000 del Pressupost general de despeses per al 2022, per a les següents línies:</span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA A: 60.000 €</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA B: 10.000 €</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">LÍNIA C: 10.000 €</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. Règim de la concessió</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La concessió d'aquestes subvencions es realitzarà mitjançant règim de concurrència competitiva entre les persones i entitats s<span style="background-color:white">ol·licitants, en virtut de la qual es comparen, en un únic procediment, totes les sol·licituds presentades amb la intenció d'establir-hi una prelació a través dels criteris de valoració previstos en el punt 12 d'aquesta convocatòria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. Beneficiaris</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Poden ser beneficiaris de les ajudes que preveu aquesta convocatòria:</span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Clubs i associacions esportives sense ànim de lucre legalment inscrits en el Registre d'Entitats Esportives de la Direcció General d'Esports del Govern de les Illes Balears i en el Registre Municipal d'Entitats Ciutadanes de l'Ajuntament de Llucmajor.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Associacions i entitats sense ànim de lucre inscrites en el Registre Municipal d'Entitats Ciutadanes de l'Ajuntament de Llucmajor, que siguin organitzadores d'esdeveniments i activitats que promoguin l'activitat física i l'esport.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Persones físiques amb llicència federativa durant la temporada 2021/2022 i amb residència al municipi de Llucmajor (com a mínim des de l'1 de gener de 2022), que participin en competicions esportives oficials d'àmbit estatal o internacional. </span></span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. Requisits per accedir a les subven<span style="background-color:white">cions</span></strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Per obtenir la condició de persona o entitat beneficiari s'han de complir els requisits següents:</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">LÍNIA A:</span></strong></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Estar legalment inscrites en el Registre d'Entitats Esportives de les Illes Balears i el Registre Municipal d'Entitats Ciutadanes de l'Ajuntament de Llucmajor.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durant la temporada <span style="color:black">2021/2022</span>, els esportistes havien de disposar de llicència federativa expedida per la Federació Balear de la modalitat corresponent o estar inscrits en els Jocs Esportius Escolars del Consell de Mallorca.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els estatuts de l'entitat han de preveure la pràctica de l'activitat física i/o esportiva.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Les activitats físiques esportives realitzades pels clubs, associacions i entitats esportives s'han de realitzar en l'àmbit territorial del municipi de Llucmajor i tenir el seu domicili al terme de Llucmajor.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Disposar dels certificats negatius de delictes sexuals, tal com estableix la Llei orgànica 1/1996, de protecció jurídica del menor, modificada per la Llei 26/2015, de modificació del sistema de protecció a la infància i a l'adolescència.</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">LÍNIA B:</span></strong></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Ser persona física empadronada</span> <span style="color:black">al municipi de Llucmajor com a mínim des de l'1 de gener de 2022.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Disposar de llicència federativa en vigor durant la temporada 2021/2022.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Haver participat en competicions oficials d'àmbit estatal o internacional, sempre que s'hi hagi accedit per mèrits esportius assolits en altres competicions.</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">LÍNIA C:</span></strong></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Estar legalment inscrites en el Registre Municipal d'Entitats Ciutadanes de l'Ajuntament de Llucmajor.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Les associacions i entitats han de realitzar les activitats físiques esportives en l'àmbit territorial del municipi de Llucmajor i han de tenir el domicili al terme de Llucmajor.</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">No poden obtenir la condició de beneficiàries les persones o entitats en les quals s'esdevingui alguna de les circumstàncies següents:</span></span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Quan entre elles concorri alguna de les prohibicions establertes en l'article 13 de la LGS.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Quan entre elles concorri alguna de les prohibicions establertes en els articles 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, i 37 de la Llei 8/2016, de 30 de maig, per garantir els drets de lesbianes, gais, trans, bisexuals i intersexuals i per erradicar l'LGTBI-fòbia.</span></span></span></li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'acreditació de no incórrer en les prohibicions establertes en l'article 13 de la LGS s'ha de fer mitjançant una declaració responsable (annex 3).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El compliment de les obligacions tributàries i amb la Seguretat Social s'ha d'acreditar mitjançant les certificacions acreditatives expedides per l'Agència Estatal d'Administració Tributària, l'Agència Tributària de les Illes Balears i la Seguretat Social.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'Ajuntament de Llucmajor comprovarà d'ofici la inscripció en el Registre Municipal d'Entitats Ciutadanes de l'Ajuntament de Llucmajor, les obligacions tributàries amb l'Ajuntament i l'empadronament de les persones físiques sol·licitants. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6. Despeses subvencionables</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són subvencionables les despeses derivades de l'adquisició de béns no inventariables, de lloguers i de serveis, que responguin de manera indubtable a la naturalesa de l'activitat esportiva de l'entitat o l'esportista o que siguin necessàries per desenvolupar-la. Els conceptes de les despeses subvencionades poden ser, entre d'altres, els següents:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses derivades de l'organització d'esdeveniments, programes, campionats, tornejos, campus, actuacions, activitats esportives i activitats de formació de les entitats sol·licitadores de la subvenció.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Roba esportiva específica necessària per al desenvolupament de l'esport.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Material esportiu fungible específic necessari per al desenvolupament de l'activitat esportiva de l'entitat.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses federatives per conceptes d'afiliació a les federacions esportives de les Illes Balears o a la federació espanyola o internacional corresponent, en el supòsit que no hi hagi federació esportiva de les Illes Balears, quotes d'inscripció d'equips o altres tipus de despeses exigides per les federacions.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses derivades d'allotjament, transport i manutenció d'esportistes, tècnics i directius per assistir a campionats, tornejos o similars de caràcter autonòmic, nacional o internacional, inclosos als calendaris federatius oficials.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de subministraments de la seu social del club com llum, aigua, gas, telèfon, etc.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de personal necessàries per al desenvolupament de l'activitat diària de l'entitat sol·licitadora, com personal administratiu, personal tècnic, de neteja, etc.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Trofeus i distincions, sempre que aquesta despesa no estigui subvencionada per una altra línia de subvencions.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses derivades de serveis d'atenció sanitària, sempre que aquesta despesa no estigui subvencionada per una altra línia de subvencions.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses derivades de la contractació d'assegurances, excepte les previstes per les llicències federatives.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de gestories en temes fiscals o laborals.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Serveis en matèria de prevenció laboral.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses d'utilització d'instal·lacions públiques o privades per desenvolupar l'activitat esportiva.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Adquisició de material sanitari (farmacioles i despeses similars).</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Comissions bancàries en les operacions dels pagaments que les entitats presentin per justificar.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses d'alimentació i hidratació derivades de l'activitat esportiva o necessàries per desenvolupar-la.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses derivades de l'adquisició de material per a l'adaptació a la normativa actual de lluita contra la Covid-19.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No són despeses subvencionables:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interessos deutors dels comptes bancaris.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interessos, recàrrecs i sancions administratives i penals.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de procediments judicials.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Material inventariable.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Despeses de sopars i refrigeris d'inauguracions, clausures o altres celebracions. Les despeses d'avituallament (alimentació i hidratació durant els esdeveniments), són subvencionables si responen a la naturalesa de l'activitat esportiva subvencionada (campus, carreres...).</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Premis en metàl·lic per a les persones participants.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les despeses subvencionables han de ser assumides per l'entitat o persona beneficiària (factures a nom de l'entitat o persona beneficiària i abonades per aquesta).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'import de les despeses subvencionades no pot ser superior al valor de mercat.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7. Temporalització de l'activitat subvencionable</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les factures han de ser de data compresa entre l'1 de juliol de <span style="color:black">2021</span> i el 30 de juny de <span style="color:black">2022</span> i pagades en el mateix període. No obstant això, en el cas de factures emeses en la segona quinzena del mes de juny de <span style="color:black">2022, </span>s'admetrà el pagament realitzat fins<span style="color:black"> al 15 de juliol de 2022.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">8. Presentació de sol·licituds</span></strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El termini per presentar les sol·licituds serà d'un mes comptador</span> a partir de l'endemà de la publicació d'aquesta convocatòria en el <em>Butlletí Oficial de les Illes Balears</em>. La presentació de les sol·licituds implica l'acceptació de les bases de la convocatòria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds s'han de formular mitjançant instància dirigida a la Batlia de l'Ajuntament de Llucmajor.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Les sol·licituds es poden presentar a la seu electrònica de l'Ajuntament de Llucmajor o al Registre Electrònic General de l'Administració General de l'Estat. Documentació a presentar</span></strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds s'han de formular d'acord amb el model d'instància (annex 1). Juntament amb la sol·licitud, que ha d'anar signada per l'esportista o el representant legal de l'entitat, s'ha de presentar la següent documentació:</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Certificat bancari que acrediti el compte corrent o la llibreta en què s'ha d'ingressar l'import de la subvenció o document anàleg (annex 2). </span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">b) Certificats d'estar al corrent en el compliment de les obligacions tributàries de l'Agència Estatal d'Administració Tributària, de l'Agència Tributària de les Illes Balears i amb la Seguretat Social.</span></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Annex 3, Declaració responsable.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Així mateix, com que es tracta d'una subvenció que té per objecte una activitat ja realitzada, juntament amb la documentació abans esmentada s'ha de presentar un compte justificatiu integrat per la documentació següent:</span></span></p> <p style="margin-left:80px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Una memòria de l'actuació justificativa de les activitats que s'han fet (annex 4). Segons la línia de subvenció elegida, ha d'incloure, <span style="color:black">a més de l'activitat realitzada i els objectius assolits, com a mínim el següent contingut:</span></span></span></p> <ul style="margin-left:80px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">LÍNIA A: participació en competicions, equips, esportistes i personal tècnic. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">LÍNIA B: modalitat o especialitat esportiva i competicions.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">LÍNIA C: tipus d'esdeveniment o activitat, nombre de participants, durada i personal necessari. </span></span></li> </ul> <p style="margin-left:80px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Una memòria econòmica justificativa del cost de les activitats que s'han fet, que ha de contenir:</span></span></p> <ul style="margin-left:80px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Balanç de l'activitat: una relació detallada de les despeses subvencionables originades per l'activitat realitzada i una relació també detallada dels ingressos que corresponguin i s'imputin a aquestes despeses, amb especial indicació de les subvencions que hagin finançat l'activitat subvencionada i assenyalant-ne l'import i la procedència (annex 5).</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Factures o documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa que s'incorporaran a una relació classificada, signada pel representant de l'entitat, en què constarà la identificació del creditor i del document, l'import, la data d'emissió i la data de pagament (annex 5).</span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest punt, relatiu a la documentació acreditativa de la despesa, s'ha de tenir en compte que:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">- <span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'adm</span></span>etran factures simplificades fins a 400 €.</p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">- S'admetran rebuts i de<span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">claracions responsables per justificar les indemnitzacions que poden donar-se per utilització de vehicle propi en desplaçaments derivats de l'activitat.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les despeses s'han de justificar amb factures i altres documents de valor probatori equivalent en el tràfic jurídic mercantil o amb <span style="background-color:white">eficàcia administrativa incorporats en la relació anterior i, si s'escau, amb la documentació acreditativa del pagament, tal com s'estableix en e</span>l <span style="background-color:white">punt</span> <span style="background-color:white">10.</span></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Declaració responsable (annex 6).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">A més, <strong>per accedir a la LÍNIA A també s'ha de presentar:</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Fotocòpia del CIF de l'entitat sol·licitant i fotocòpia del DNI/NIE/passaport de la persona que signa la sol·licitud.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Documentació acreditativa de la representació en virtut de la qual actua la persona que signa la sol·licitud. S'ha d'acreditar el moment i la vigència del càrrec.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Fotocòpia dels estatuts.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Certificat que acrediti la inscripció en el Registre d'Entitats Esportives de les Illes Balears.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Certificat que acrediti la disposició dels certificats negatius de delictes sexuals, tal com estableix la Llei orgànica 1/1996, de protecció jurídica del menor, modificada per la Llei 26/2015, de modificació del sistema de protecció a la infància i a l'adolescència (annex 7). </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">f) Documentació per acreditar els criteris de valoració d'acord amb el punt 12.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:white"><span style="color:black">Per accedir a la LÍNIA B també s'ha de presentar:</span></span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:black">a) Fotocòpia del DNI/NIE/passaport de l'esportista. S'ha d'acreditar el moment i la vigència del càrrec.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Fotocòpia dels estatuts.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:black">d) Documentació per acreditar els criteris de valoració d'acord amb el punt 12.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la sol·licitud i la resta de documentació que s'ha de presentar no reuneix els requisits establerts en la convocatòria, és incompleta o incorrecta, es requerirà l'interessat perquè en el termini màxim de 10 dies esmeni les deficiències, i se l'advertirà que si no ho fa se'l tindrà per desistit de la seva petició.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Qualsevol dels òrgans que intervenen en el procediment de concessió podrà, en qualsevol moment del procediment, sol·licitar a l'interessat la informació complementària, les dades i les acreditacions que estimi necessàries.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">D'acord amb l'article 28.2 LPAC, els interessats tenen dret a no aportar documents que ja es trobin en poder de l'Ajuntament de Llucmajor o hagin estat elaborats per qualsevol altra administració. Aquest Ajuntament podrà consultar o recaptar aquests documents, tret que l'interessat s'hi oposi. En el cas d'haver presentat la documentació a l'Ajuntament, cal indicar l'any de presentació i el procediment en el qual es participava.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10. Acreditació del pagament</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La documentació acreditativa del pagament segons la forma que hagi utilitzat la persona o entitat beneficiària ha de ser la següent:</span></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">a) Pagament mitjançant transferència bancària o ingressos en un compte bancari:</span></span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Còpia del justificant de l'ordre de transferència bancària o del document bancari acreditatiu del pagament en el qual figuren el concepte de transferència o l'ingrés, la data del document, l'import ,la identificació del concepte, a fi que quedi identificat el pagament de la factura, i les dades de l'ordenant i del destinatari, que han de coincidir amb la persona o entitat beneficiària i amb l'emissora de la factura, respectivament, i</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Extracte del compte bancari de la persona o entitat beneficiària de l'ajuda en la qual figuri el càrrec d'aquesta transferència, quan no quedin acreditats els requisits assenyalats en el paràgraf anterior.</span></span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">b) Pagament mitjançant xec nominatiu:</span></span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Còpia del xec nominatiu o pagaré nominatiu emès a nom del proveïdor que expedeix la factura o document equivalent, sempre que estigui vençut i</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Extracte del compte corrent de la persona o entitat beneficiaria de l'ajuda en el qual figuri el càrrec d'aquest xec o pagaré, o</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Certificat de l'entitat bancària en què consti el número de xec, l'import i la identificació de qui el cobra, i la data de cobrament (no és necessari presentar l'extracte del compte corrent si el certificat de l'entitat bancària inclou també la identificació del número de compte en el qual s'ha carregat el xec i el titular del compte, que ha de coincidir amb la persona o entitat beneficiària de l'ajuda).</span></span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">c) Pagament mitjançant pagarés, lletres de canvi o similars:</span></span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Document acreditatiu del càrrec en compte de l'efecte mercantil i</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Extracte del compte en què figuri el càrrec de l'efecte mercantil. Aquesta documentació es pot substituir per un certificat o document similar emès per l'entitat bancària que contingui: el titular i el número de compte en què s'ha carregat l'efecte mercantil, el lliurador i el deslliurat de la lletra de canvi, la persona o entitat beneficiària, el concepte pel qual es realitza l'efecte mercantil, l'import de la lletra de canvi i la data d'emissió de la lletra i l'abonament per part del lliurat.</span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Pagament mitjançant targeta de crèdit:</span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tiquet de compra en el qual figuri el pagament amb targeta en cas que no s'indiqui en la factura i</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Extracte del compte en el qual figuri el càrrec del pagament amb targeta. L'extracte del compte pot substituir-se per un certificat o títol similar de l'entitat bancària, en el qual, com a mínim, consti el titular i el número del compte corrent en el qual es carrega el pagament de la targeta, la persona o entitat beneficiària, el concepte pel qual es fa la transferència i l'import i la data de l'operació.</span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Pagament mitjançant domiciliació bancària:</span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Notificació bancària del càrrec i</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Extracte bancari en què figuri el càrrec de la domiciliació. Aquesta documentació es pot substituir por un certificat o títol similar de l'entitat bancària, en el qual consti el titular i el número del compte corrent en què s'ha fet el càrrec, i l'ordenant del càrrec, la persona o entitat beneficiària, el concepte pel qual es realitza el càrrec i l'import i la data de l'operació.</span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Pagament en efectiu: rebut, signat i segellat pel proveïdor, en el qual ha d'especificar-se la despesa al qual correspon el pagament, la data i l'expressió «rebut en metàl·lic». Sota la signatura ha de figurar el nom, els cognoms i el número de DNI de la persona que signa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Així mateix, aquests rebuts han d'anar acompanyats d'una declaració responsable signada pel president o la presidenta del club, associacions i entitats esportives que realitzen el pagament en la qual ha d'assumir la despesa i el seu pagament en efectiu, si fos el cas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si es tractés de pagaments en efectiu de factures simplificades, serà suficient la presentació d'aquest document per acreditar-ne el pagament, si hi consta l'expressió «Pagat en efectiu», «Rebut» o similar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">11.</span> Òrgans competents per instruir i resoldre el procediment. Composició de la Comissió Avaluadora</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La instrucció correspon al regidor competent en matèria d'esports que ha de dur a terme totes les actuacions o els actes de tràmit necessaris per vetlar pel compliment dels requisits de la convocatòria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Comissió Avaluadora examinarà si es compleixen els requisits necessaris per accedir a les subvencions i avaluarà les sol·licituds conforme als criteris establerts en aquestes bases. De totes les actuacions se n'aixecarà acta.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta Comissió estarà integrada, com a mínim, pels següents membres: </span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">President/a: el regidor o regidora de l'àrea.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Secretari/ària: un o una representant d<span style="color:black">e l'Àrea d'Esports.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Vocals: un o una representant de l'Àrea d'Intervenció, un o una representant de l'Àrea d'Esports i un o una representant de l'Àrea de Secretaria. </span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; Procediment de concessió</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'òrgan instructor, a la vista de l'expedient i de l'acta de la reunió de la Comissió, formularà proposta de resolució (indicarà beneficiaris i quanties atorgades).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La competència per resoldre el procediment i concedir la subvenció s'atribueix, com ja s'ha dit, a la Batlia, que dictarà la resolució definitiva, a la vista de la proposta de resolució de l'instructor i de l'informe de fiscalització de la Intervenció Municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El termini màxim per resoldre i notificar l'acord és de sis mesos, a comptar de l'endemà del termini de presentació de les sol·licituds. La resolució es publicarà a la web de l'Ajuntament de Llucmajor. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>14. Justificació i pagament</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament de la subvenció únicament es pot efectuar, una vegada dictada la resolució corresponent i justificada de manera suficient la realització de l'activitat subvencionada, al compte corrent indicat a l'efecte per la persona o entitat beneficiària de la subvenció.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El termini per justificar acaba el dia en què acaba la presentació de sol·licituds, atès que, com s'ha dit, es tracta d'una subvenció per activitats finalitzades, i juntament amb la sol·licitud i la resta de documentació expressada en aquesta convocatòria, se n'ha de presentar la justificació.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>15. Compatibilitat amb altres subvencions</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas que l'entitat o persona beneficiària rebi altres subvencions o ajudes per a la mateixa activitat o tipus d'actuació, l'import de totes les subvencions atorgades no pot ser, en cap cas, de tal quantia que, de forma aïllada o en concurrència amb altres subvencions o ajudes, superi el cost de l'activitat subvencionada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>16. Obligacions de les entitats i les persones beneficiàries</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A més de les obligacions establertes en les disposicions normatives que són d'aplicació a les persones i entitats beneficiàries d'una subvenció, s'han de complir les següents:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Acceptar i complir la normativa de l'Ajuntament de Llucmajor.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Acreditar davant l'Ajuntament la realització de l'activitat subvencionada amb la documentació corresponent.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Comunicar a l'òrgan competent en qualsevol moment l'obtenció de subvencions per a la mateixa finalitat no consignades en la sol·licitud.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Facilitar tota la informació que requereixi l'Ajuntament.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sotmetre's a les actuacions de fiscalització i control de la Intervenció de l'Ajuntament de Llucmajor.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Donar l'adequada publicitat del caràcter públic del finançament de les activitats que siguin objecte de subvenció mitjançant un anunci a la pàgina web del club o entitat o, en absència de pàgina web, a las xarxes socials en què s'indiqui l'obtenció d'una subvenció de l'Ajuntament de Llucmajor, l'activitat subvencionada i l'import. </span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>17. Revocació i reintegrament</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es podran anul·lar totalment o parcialment les subvencions i ajudes concedides d'acord amb aquesta convocatòria en el supòsit que la persona o entitat beneficiària incorri en alguna de les causes previstes als articles 36 i següents de la Llei 38/2003, general de subvencions, així com en el cas d'incompliment d'alguna de les obligacions previstes en aquestes bases i la resta de normativa aplicable.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquests casos, la persona o entitat beneficiària estarà obligada a reintegrar les quantitats percebudes i els interessos de demora que corresponguin, amb la tramitació prèvia del procediment corresponent.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>18. Protecció de dades</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La informació i les dades declarades en les sol·licituds de subvenció d'aquesta convocatòria estan emparades pel que preveu el Reglament (UE) 2016/679, de 27 d'abril, general de protecció de dades (RGPD).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>19. Règim de recursos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquestes bases i convocatòria, que posen fi a la via administrativa, es pot interposar, amb caràcter potestatiu, recurs de reposició davant el Batle de l'Ajuntament de Llucmajor en el termini d'un mes, de conformitat amb el que disposen els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, o bé recurs contenciós administratiu davant l'ordre jurisdiccional contenciós administratiu en el termini de dos mesos, comptats des de l'endemà de la seva publicació en el <em>Butlletí Oficial de les Illes Balears</em>, d'acord amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:black">La resolució de concessió o denegació posarà fi a la via adminis</span></span><span style="color:black">trativa.
