font-size:12px">El Ple de l'Ajuntament d'Esporles en sessió ordinària celebrada el dia 28 de juliol de 2022, aprovà l'expedient 1041/2022 de modificació de l'Ordenança Fiscal reguladora del preu públic per la prestació dels serveis de piscina, pistes poliesportives cobertes, pistes poliesportives descobertes, camp de futbol, pista de tennis i alberg juvenil de Son Trias i que es la següent:</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">“ORDENANÇA FISCAL REGULADORA DEL PREU PÚBLIC PER LA PRESTACIÓ DELS SERVEIS DE PISCINA, GIMNÀS, PISTES POLIESPORTIVES COBERTES, PISTES POLIESPORTIVES DESCOBERTES, CAMP DE FUTBOL, PISTA DE TENIS I ALBERG JUVENIL DE SON TRIAS</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 1er<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Concepte</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el previst a l'article num. 127, en relació amb l'article 41 i següents, ambdós del Real Decret Legislatiu 2/2004, de 5 de març, pel que s'aprova el Tex Refós de la Llei&nbsp; Reguladora de les Hisendes Locals, aquest Ajuntament estableix el preu públic per la prestació dels serveis de la piscina, gimnàs, pistes poliesportives cobertes, pistes poliesportives descobertes, camp de futbol, pista de tennis i refugi-alberg Hort de Son Trias.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 2n<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Fet imposable</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constitueix el fet imposable del preu públic l'aprofitament especial d'instal·lacions, prestació dels serveis de la piscina, gimnàs, pistes poliesportives cobertes, pistes poliesportives descobertes, camp de futbol, pista de tennis i alberg juvenil de Son Trias que s'especifiquen en aquesta ordenança.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 3r<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Subjectes passius</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són subjectes passius d'acord amb l'art. 43 del RDL 2/2004, de 5 de març, els que utilitzin les esmentades instal·lacions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'obligació de contribuir neix per l'entrada a las instal·lacions esportives de propietat municipal, així com la utilització dels diferents serveis existents a les mateixes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estan obligats a pagar el preu públic regulat en aquesta ordenança qui es&nbsp; beneficiï de l'entrada, dels serveis o activitats, prestats o realitzats per aquest Ajuntament, a què es refereix l'article anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 4t<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Quantia</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- La quantia del preu públic regulat en aquesta Ordenança serà fixada a la tarifa continguda a l'apartat següent, per cada un dels distints serveis o activitats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La tarifa d'aquesta preu públic serà la següent:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Piscina municipal</strong></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Entrades de 4 a 14 anys: 1,25 €/dia</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Entrades majors de 14 anys: 1,50 €/dia</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Refugi de Son Trias</strong></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Preu diari per persona en llitera: 14,50 €</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Preu diari per persona en tenda de campanya: 5,50 €</span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 5è<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Obligació i lloc de pagament</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La obligació de pagar al preu públic regulat en aquesta ordenança neix des de què es presti o realitzi qualsevol dels serveis o activitats especificades a l'apartat 2 de l'article anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament del preu públic s'efectuarà en el moment d'entrar al recinte que es tracti o al sol·licitar el&nbsp; lloguer dels objectes a que es refereix l'apartat 2 de l'article anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament, com a norma general, es farà a les oficines de l'Ajuntament d'Esporles, a excepció d'aquells equipaments que tenguin concessionada la seva gestió o que al seu protocol de reserva s'indiqui un lloc diferent on liquidar el preu públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposició derogatòria</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Queden derogats tots els texts de les ordenances fiscals contraris el nou tex.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposició Final</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La present ordenança entrarà en vigor el dia de la seva publicació en el Bolletí Oficial de la Comunitat Autònoma de les Illes Balears, romanent en vigor fins la seva modificació o derogació expressa.”</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px;
