&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 11 de novembre de 2016 per la qual es convoquen, ajudes de minimis per a projectes pilot i suport al desenvolupament de nous productes, pràctiques, processos i tecnologies , corresponents als anys 2016-2020, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 22&amp;nbsp;de juliol&amp;nbsp;de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. En data de 17 de novembre de 2016 es va publicar, en el BOIB núm. 145, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2016-2020, ajudes de minimis per a projectes pilot i suport al desenvolupament de nous productes, pràctiques, processos i tecnologies.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. El vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor dels interessats que figuren a l'Annex I amb les dates i imports que figuren a l'esmentat Annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Atesa l'esmentada Resolució de concessió de l'ajuda, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins del termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la forma i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. En data 22/02/2022 amb núm. de registre REGAGE22e00004544543 l'interessat presenta la sol·licitud de pagament juntament amb documentació justificativa. La sol·licitud està presentada fora del termini establert, però s'admet la sol·licitud a tràmit atès què no s'ha revocat l'expedient .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El dia 09/05/2022 se li notifiquen deficiències de la documentació presentada, requerint-li que en un termini de deu dies comptadors des de l'endemà de la publicació de la notificació presenti la documentació que manca.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. En data 22/05/2022 l'interessat presenta documentació. Analitzats els documents presentats, es consideren que no s'han esmenat totes les deficiències, per tant hi ha una sèrie de despeses que es consideren no admissibles.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. El dia 17/06/2022 se li notifica la Proposta provisional de revocació parcial, comunicant-li&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;el detall de les despeses no admissibles, i que disposa de 10 dies hàbils per presentar al·legacions.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. En data 04/07/2022 l'interessat presenta al·legacions a la Proposta.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.&lt;/em&gt;&amp;nbsp;&lt;em&gt;D'acord amb l'apartat novè de la Resolució de convocatòria dalt esmentada, en els casos en els quals es produeixin desviacions entre la inversió realitzada i l'aprovada, s'ajustarà l'ajuda total concedida a l'import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre i quan s'acostin de manera significativa al compliment total dels objectius prevists i suposin almenys un 50% d'execució de la quantitat total d'inversió aprovada a la resolució de concessió inicial. Aquest ajustament es farà aplicant el percentatge de subvenció que pertoqui a la inversió total admisible. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Atès tot això, es proposa fer la&amp;nbsp;revocació parcial per ajustar l'ajuda total concedida a l'import de la inversió realitzada i correctament justificada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Llei 39/2015, de 26 de novembre de règim jurídic de les administracions públiques .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Informe i Proposta&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Analitzades les al·legacions presentades per l'interessat, aquest servei gestor les desestima, tal i com es motiva a l'Annex I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tant, es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Procedir a la revocació parcial de les resolucions d'ajuda concedides als beneficiaris pels imports i amb els terminis detallats a l' Annex I , que són un total de 1 expedient/s i que comença amb SCL DEL CAMP MALLORQUI&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i acaba amb &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;SCL DEL CAMP MALLORQUI,&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que suma un import total de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;19.202,59 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;euros, relativa a la línia d'ajuda “Projectes pilot i desenvolupament de nous productes, pràctiques, processos i tecnologies”, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ja que la justificació de la despesa ha estat inferior a l'aprovada. L'import total de l'ajuda finalment concedida haurà de ser de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;28.397,76&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;euros.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Notificar la resolució a cada un dels beneficiaris de l'Annex I .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller d' Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.-D'acord amb la Llei 38/2003 article 29.7 i el Decret 2/2005 article 38.7, no&amp;nbsp;podrà concertar-se pel beneficiari l'execució parcial o total de les activitats subvencionades amb entitats vinculades, excepte que s'obtengui la prèvia autorització expressa de l'òrgan concedent. A més de no presentar l'autorització prèvia, tampoc presenta l'extracte bancari com s'havia requerit, ni aclareix les contradiccions del concepte ‘mostreig' per poder valorar el seu cost de 600€, ni detalla les hores de coordinació per valorar el seu cost de 1.300€, ni es considera que analitzar 45 mostres val 10,660€.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.- Analitzada la factura de Karretania i l'informe aportat, es considera que l'empresa no té com objecte social la venta d'equipaments o la realització d'instal·lacions, per tant la factura d'instal·lació d'equips de mesura, que inclou equips i hores d'operari per a la seva instal·lació, es considera no admissible. A més, manca detallar model i marca de l'estació meteorològica per poder valorar el seu cost, i s'han trobat incoherències en l'informe detallat de la factura, ja que hi ha conceptes d'instal·lació de l'estació que segons la factura corresponen a «Obra finca Sa tanca dels Ohms» i no al concepte subvencionable de la finca experimental. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.- S'ha realitzat la moderació de costs amb els imports aplicats a altres convocatòries del servei gestor (BOIB 102 de 18 d'agost de 2018, Ajudes per fomentar la producció de productes agrícoles de qualitat per al període 2018-2020. Cost Personal laboral tècnic: 39.270,00 € anuals en jornada de 40 hores) .Aplicant aquest cost de referència, un any de 1.720 hores surt a 22,83€/h. Per tant, de la factura d'Ucabal, es considera que el cost màxim admissible per a coordinar el projecte és de 22,83€/h.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
