    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per Acord del Ple de 12 de juliol de 2022, es va aprovar definitivament la relació de béns i drets afectats per l'expedient d'expropiació forçosa pel sistema general de punt verd del municipi de Selva, així com la designació nominal dels interessats amb els quals han d'entendre's els successius tràmits, quedant declarada la necessitat d'ocupació d'aquests, la qual cosa es publica a l'efecte de l'article 21 de la Llei d'Expropiació Forçosa de 16 de desembre de 1954.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;« &lt;span style="color:#000000"&gt;&lt;strong&gt;Primer. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Aprovar la relació de les persones propietàries i la descripció dels béns i dels drets afectats per l'expropiació for&lt;/span&gt;&lt;span style="color:#000000"&gt;çosa d'un sistema general per implantar un punt verd al municipi de Selva, tot això a l'efecte de concretar la necessitat d'ocupació, iniciar l'expedient expropiatori i designar nominalment els interessats amb els quals s'han de seguir els tràmits successius, en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Notificar aquest acord a les persones interessades i publicar-ne un extracte tant en el Butlletí Oficial de les Illes Balears com en un dels diaris de major circulació a les Illes Balears, amb les indicacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Contra aquest acord es pot interposar un recurs potestatiu de reposició davant del Ple de l'Ajuntament de Selva en el termini d'un mes comptador des de l'endemà de la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. També es pot interposar directament un recurs contenciós administratiu davant del Jutjat contenciós administratiu de Palma en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. Tot això sens perjudici que es pugui presentar qualsevol altre recurs que es consideri oportú.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- La notificació comporta l'inici del termini de quinze dies per convenir l'adquisició dels béns i drets per mutu acord, sense perjudici que es pugui assolir en qualsevol moment de la tramitació com a peça separada de l'expedient ordinari per fixar el preu just.&lt;/span&gt;»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
