    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;L'apartat 9.3 de la Resolució de el president de el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13&amp;nbsp;de desembre de 2019, per la qual es convoquen, per a l'any 2019, subvencions per a inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015 , d'1 d'octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 30/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El vicepresident&amp;nbsp;en matèria agrària del FOGAIBA, amb data 1&amp;nbsp;de juliol&amp;nbsp;de 2022, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.En data de 17 de desembre de 2019 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 169, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per el any 2019, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;En data 3 de maig de 2021, el vicepresident en matèria agrària del Fogaiba va dictar una resolució de concessió als beneficiaris de les ajudes R1, que es va publicar al BOIB núm. 62 de 13 de maig de 2021. Entre els beneficiaris figura una subvenció a favor de FINCAS OLIVIA SL per un import de 5.780,00 €.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;A la sol·licitud d'ajuda es contemplaven les següents inversions: faixa de prevenció d'incendis forestals a una superfície de 0,29 hectàrees (Ha) i recuperació de cultiu a zones abancalades a una superfície de 1,12 Ha.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4.A l'acta de control previ es varen reflectir una superfície de 0,99 Ha de faixa de prevenció d'incendis forestals i 1,12 Ha de recuperació de cultiu a zones abancalades a una superfície de 1,12 Ha.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;La subvenció concedida va ser en base a les següents actuacions: faixa de prevenció d'incendis forestals a una superfície de 0,29 Ha i recuperació de cultiu a zones abancalades a una superfície de 1,12 Ha.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;A la concessió hi va haver una errada a les superfície de faixa de prevenció d'incendis forestals, es varen concedir 0,29 Ha quan realment li corresponien 0,99 Ha.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Tenint en compte que amb el crèdit existent és possible resoldre aquest expedient sense afectar el que disposa els apartats setè i vuitè de la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8.L'expedient esmentat ha estat objecte d'una revisió sistemàtica per part d'un superior, d'acord amb el que estableix l'article 3.2 de la Circular de Coordinació 18/2019, per la campanya 2019, s'han detectat els errors descrits al punt 6.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;FONAMENTS DE DRET&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;em&gt;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per l'any 2018, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Llei 39/2015 de 1 d'octubre del&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;em&gt;procediment administratiu comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;PROPOSTA DE RESOLUCIÓ&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot això, s'informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els següents termes:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Modificar la Resolució del vicepresident en matèria agrària de 3 de maig de 2021 de concessió (R1), per l'import i les dades detallades en l'annex 1 d'aquesta resolució, que és un total d'1 expedient que comença amb FINCAS OLIVIA SL i acaba amb &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;FINCAS OLIVIA SL&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, per un import total de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10.540,00&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, relativa a la línia d'ajuda «&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes&lt;/em&gt;&lt;/span&gt;&lt;em&gt;» a conseqüència de la revisió sistemàtica.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2. Ampliar el import de concessió de la Resolució d'ajuda concedida abans esmentada concedida al beneficiari per l'import i amb les dades detallades en l'annex 1 d'aquesta resolució, que és un total d'1 expedient i que comença amb FINCAS OLIVIA SL &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;i termina amb&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;FINCAS OLIVIA SL&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, per un import de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10.540,00&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, relativa a la línia d'ajuda «&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes&lt;/em&gt;&lt;/span&gt;&lt;em&gt;».&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Notificar aquesta resolució a la persona interessada, mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4&lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Notificar aquesta proposta provisional de resolució a la persona interessada mitjançant la publicació al web del FOGAIBA i informar-li que disposa d'un termini màxim de 10 dies hàbils, comptadors des de l'endemà a la publicació d'aquesta proposta, per presentar al·legacions. En el cas de no fer ús del seu dret per al·legar, en el termini indicat, o si manifesta la seva decisió de no efectuar al·legacions ni aportar nous documents o justificacions, aquesta proposta tindrà caràcter definitiu, i s'elevarà al vicepresident en matèria agrària del FOGAIBA per a què dicti la Resolució de modificació de la resolució de concessió &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3 de maig de 2021&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
