661775 23602 2022-06-11 325222 CAIB CAIB ![CDATA[<p><span style="line-height:115%"><strong>Fets</strong></span></p> <ol> <li><span style="line-height:115%">El dia 31 de desembre de 2020 es va publicar&nbsp; en el BOIB la Resolució del vicepresident i conseller de Transició Energètica i Sectors Productius de 23 de desembre de 2020 per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l'any 2021 per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a particulars, entitats sense ànim de lucre, petites i mitjanes empreses i associacions empresarials.</span></li> <li><span style="line-height:115%">Els expedients llistats a l'annex van presentar a la conselleria de Transició Energètica i Sectors Productius una sol·licitud de subvenció per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a particulars, entitats sense ànim de lucre, petites i mitjanes empreses i associacions empresarials.</span></li> <li><span style="line-height:115%">Els titulars dels expedients que apareixen a l'annex han presentat un escrit en el que indiquen que renuncien a l'esmentada subvenció.</span></li> </ol> <p><span style="line-height:115%"><strong>Consideracions jurídiques</strong></span></p> <ol> <li><span style="line-height:115%">El conseller de Transició Energètica, Sectors Productius i Memòria Democràtica<strong> </strong>és l'òrgan competent per resoldre aquest procediment atesa l'estructura orgànica del Govern de les Illes Balears i d'acord amb l'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia.</span></li> <li><span style="line-height:115%">El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions.</span></li> <li><span style="line-height:115%">L'article 94, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, preveu que l'Administració, en el supòsit de renúncia de la persona interessada als seus drets, acceptarà la renúncia completament i resoldrà el procediment declarant aquesta circumstància, amb indicació dels fets produïts i les normes aplicables.</span></li> </ol> <p><span style="line-height:115%">Per tot l'anterior, dict la següent,</span></p> <p style="text-align:center"><span style="line-height:115%"><strong>RESOLUCIÓ</strong></span></p> <ol> <li><span style="line-height:115%">Acceptar la renúncia a la subvenció presentada pels beneficiaris dels expedients que apareixen a l'annex.</span></li> <li><span style="line-height:115%">Declarar conclòs el procediment i per tant, arxivar l'expedient.</span></li> <li><span style="line-height:115%">Publicar aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>.</span></li> </ol> <p><span style="line-height:115%"><strong>Interposició de recursos</strong></span></p> <p><span style="line-height:115%">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs de reposició davant el conseller de Transició Energètica, Sectors Productius i Memòria Democràtica, en el termini d'1 mes comptador des de l'endemà d'haver-ne rebut la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú i de les administracions públiques i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears.</span></p> <p><span style="line-height:115%">També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="line-height:115%"><span style="line-height:115%">Palma, 8 de juny de 2022</span></span></p> <p style="text-align:center"><strong><span style="line-height:115%">El director general d' Energia i Canvi Climàtic<span style="display:block;
