    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) d' 1 de febrer&amp;nbsp;de 2018&amp;nbsp;per la qual s'aprova la convocatòria de les ajudes, per al foment de l'agricultura ecològica, per l'any 2018&amp;nbsp;(Pròrroga 2021),&amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques . &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data &amp;nbsp;27&amp;nbsp;de maig&amp;nbsp;de 2022, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;“PROPOSTA DE RESOLUCIÓ I &lt;/em&gt;&lt;strong&gt;RESOLUCIÓ DE DENEGACIÓ&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;2.En data &amp;nbsp;1 de &lt;/em&gt;&lt;em&gt;febrer &lt;/em&gt;&lt;em&gt;de 201&lt;/em&gt;&lt;em&gt;8&lt;/em&gt;&lt;em&gt;&amp;nbsp;es va publicar, en el BOIB núm. &lt;/em&gt;&lt;em&gt;15&lt;/em&gt;&lt;em&gt;, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 201&lt;/em&gt;&lt;em&gt;8&lt;/em&gt;&lt;em&gt;&amp;nbsp;de les ajudes destinades al &lt;/em&gt;&lt;em&gt;f&lt;/em&gt;&lt;em&gt;oment de l'&lt;/em&gt;&lt;em&gt;a&lt;/em&gt;&lt;em&gt;gricultura &lt;/em&gt;&lt;em&gt;e&lt;/em&gt;&lt;em&gt;cològica&lt;/em&gt;&lt;em&gt;&amp;nbsp;&amp;nbsp;i en data 13 de desembre de 2018 al BOIB 156 s'en publicà una modificació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3.En data 30 de gener de 2021 es va publicar, en el BOIB núm. 13, la &amp;nbsp;Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2021, de les Ajudes per prorrogar els compromisos assumits per al foment de l'agricultura ecològica en la convocatòria de l'any 2018.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En data 11&amp;nbsp;d'abril&amp;nbsp;de 2022 es notifica, mitjançant publicació al portal d'ajudes del FOGAIBA, a la pàgina web http://www.caib.es,&amp;nbsp;l'informe desfavorable i la proposta provisional de denegació de l'ajuda &amp;nbsp;emesa per Servei d'Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;5. Dins el termini establert, els interessats indicats a l'Annex I adjunt no han presentat al·legacions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;6.Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;7.Reglament d'execució (UE) núm. 809/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control, les mesures de desenvolupament rural i la condicionalitat.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;8.Reial decret 1075/2014, de 19 de desembre, sobre l'aplicació a partir del 2015 dels pagaments directes a l'Agricultura i a la Ramaderia i altres règims d'ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;9.Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, de la vinya.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;13&lt;/em&gt;&lt;em&gt;.Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;16&lt;/em&gt;&lt;em&gt;.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;17&lt;/em&gt;&lt;em&gt;.&lt;/em&gt;&lt;em&gt;Llei 3&lt;/em&gt;&lt;em&gt;9&lt;/em&gt;&lt;em&gt;/2&lt;/em&gt;&lt;em&gt;015&lt;/em&gt;&lt;em&gt;, d&lt;/em&gt;&lt;em&gt;'1&lt;/em&gt;&lt;em&gt;&amp;nbsp;d&lt;/em&gt;&lt;em&gt;'octubre&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;del procediment administratiu comú&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;de les administracions públiques. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;18.Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic&lt;/em&gt;&lt;em&gt;.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Proposta de resolució de denegació&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Per tot això, &amp;nbsp;s'informa desfavorablement i propòs al vicepresident en Matèria Agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1.Denegar les sol·licituds presentades pels interessats relacionats a l'Annex I, per incompliment del/s requisit/s indicat/s.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;2. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l'Annex I.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3. Notificar la resolució als interessats de l'Annex I, publicant-la al BOIB.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Contra aquesta resolució - que no exhaureix la via administrativa. Es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb els articles 121 i 122 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
