    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;em&gt;&lt;span style="color:black"&gt;Una vegada finalitzat el termini d'exposició pública sense que s'hagin presentat al·legacions, ha resultat aprovada definitivament l' &lt;/span&gt;&lt;/em&gt;&lt;strong&gt;ORDENANÇA REGULADORA DE LA TAXA PER A L'EXPEDICIÓ DE DOCUMENTS ADMINISTRATIUS&lt;/strong&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; Es publica el text íntegre de la mateixa, per a la seva entrada en vigor i aplicació, en compliment del previst a l'article 103 de la Llei 20/2006, de 15 de desembre, municipal i de règim local, que és el següent:&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;“ORDENANÇA REGULADORA DE LA TAXA PER A L'EXPEDICIÓ DE DOCUMENTS ADMINISTRATIUS (PLE 31/03/2022)&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 1. Fonament i naturalesa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;A l'empara d'allò previst als articles 2, 57 i 20.4.a); h); i) del Reial Decret Legislatiu 2/2004, 5 de març, pel que s'aprova el text Refós de la Llei reguladora de les Hisendes Locals, l'Ajuntament estableix la taxa pel servei d'expedició de documents administratius i per la utilització de documentació municipal, que es regirà per aquesta Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 2. Fet imposable&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; El fet imposable de la taxa el constitueix l'activitat administrativa desenvolupada amb motiu de la tramitació, a instància de part, de tot tipus de documents que expedeixi i d'expedients de què entengui l'administració o les autoritats municipals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; A aquests efectes, s'entendrà tramitada a instància de part qualsevol documentació administrativa que el particular hagi provocat o que redundi en el seu benefici, encara que no hagi existit sol·licitud expressa de l'interessat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; La tramitació de documents i expedients necessaris per al compliment d'obligacions fiscals no estarà sotmesa a aquesta taxa, com tampoc no ho estaran les consultes tributàries, els expedients de devolució d'ingressos indeguts, els recursos administratius contra resolucions municipals de qualsevol classe i els relatius a la prestació de serveis o a la realització d'activitats de competència municipal i a la utilització privativa o l'aprofitament especial de béns del domini públic municipal, que estiguin gravats per una altra taxa municipal o pels que aquest Ajuntament exigeixi un preu públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 3. Subjectes passius&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Són subjectes passius contribuents les persones físiques i jurídiques i les entitats a què es refereix l'article 36 de la Llei General Tributària que sol·licitin, provoquin o en l'interès de les quals redundi la tramitació del document o expedient de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 4. Responsables&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Són responsables tributaris les persones físiques o jurídiques determinades com a tals en la legislació general tributària. El motiu d'aquesta es perquè s'ha considerat que era una errada en la redacció i quedava poc clara.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La derivació de responsabilitat requerirà que, prèvia audiència de l'interessat, es dicti acte administratiu, en els termes previstos a la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 5. Beneficis fiscals&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Gaudiran d'exempció aquells contribuents que reuneixin les següents condicions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Els interessats en un procés administratiu municipal, que hagin de presentar documentació compulsada, que formi part d'aquest procés (oposicions, licitacions...). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Els menors de 12 anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Aquells que hagin obtingut dels serveis socials municipals un informe que acrediti que no disposen de capacitat econòmica suficient&amp;nbsp; pel pagament d'aquesta taxa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; No s'aplicaran bonificacions ni reduccions per a la determinació del deute, llevat de les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Els estudiants, prèvia presentació del carnet d'estudiant, per a l'obtenció de certificacions de residència serà d'un euro (1,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Majors de 65 anys pels certificats de resident i de convivència, la quota a abonar serà d'un euro (1,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 6. Quota tributària&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;La quota tributària es determinarà per una quantitat fixa que s'assenyalarà segons la naturalesa dels documents o expedients que s'han de tramitar, d'acord amb les tarifes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;La taxa es merita quan es presenti la sol·licitud que iniciï l'actuació o l'expedient, que no es realitzarà o tramitarà sense que s'hagi efectuat el pagament corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;En els casos a què fa referència el número 2 de l'article 2, la meritació es produeix quan esdevinguin les circumstàncies que originin l'actuació municipal d'ofici o quan aquesta s'iniciï sense sol·licitud prèvia de l'interessat però que redundi en benefici seu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; L'ingrés es farà a la Tresoreria Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Els escrits rebuts pels conductes a què fa referència l'article 71 de la Llei de règim jurídic i del procediment administratiu comú, que no arribin degudament reintegrats, s'admetran provisionalment però no es podran cursar si no s'esmena la deficiència, per la qual cosa es requerirà l'interessat perquè, en el termini de 10 dies, aboni les quotes corresponents amb l'advertiment que, passat aquest termini, si no ho ha fet es tendran els escrits per no presentats i la sol·licitud serà arxivada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Article 9. Infraccions i sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Pel que respecte a les infraccions i sancions tributàries que, en relació a la taxa regulada en aquesta Ordenança, resultin procedents, s'aplicarà el que disposa la legislació tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Disposició final&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;D'acord amb el que disposa l'article 103 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, aquesta Ordenança entrarà en vigor, un cop aprovada definitivament per la Corporació, a partir de la data en què es publiqui el seu text íntegre en el Butlletí Oficial de la Comunitat Autònoma de les Illes Balears i sempre que hagi transcorregut el termini previst a l'article 113 de l'esmentada Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
