    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El Batle d'aquesta Corporació Municipal, el dia 24 de maig de 2022, entre d'altres, ha adoptat el Decret, núm. 2022-1477, que diu així:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;«&lt;/span&gt;&lt;strong&gt;DECRET DE BATLIA&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;De conformitat amb els articles 91.1 de la Llei 7/1985 de bases del règim local i 128.1 del Text refós 781/1986 del règim local sobre formulació per les Corporacions Locals de l'Oferta d'Ocupació Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#212121; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En aplicació de la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a l'ocupació pública, que estableix l´obligatorietat d´aprovar i publicar l´oferta d´ocupació pública per a l´estabilització dels empleats del sector públic abans de l´1 de juny de 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Atès que en data 23 de maig de 2022 es va procedir a negociar amb els representant sindicals, reunió de la qual es va aixecar la corresponent acta que consta incorporada a l'expedient, i es va obtenir l'acord corresponent.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;D´acord amb l'article 70 del text refós de la Llei de l'Estatut Bàsic de l'Empleat públic, aprovat pel Reial decret Legislatiu 5/2015, de 30 d'octubre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Atès l'informe emès pel Secretari de l'Ajuntament en data 23 de maig de 2022 pel qual no es pot avalar jurídicament el contingut del present decret, i que es transcriu a tenor literal:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;“&lt;/span&gt;&lt;em&gt;Visto el expediente 973/2022 relativo a la Oferta pública de empleo del Ayuntamiento de Andratx.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#222222"&gt;&lt;em&gt;Visto el informe emitido por la técnico de personal de fecha 10 de mayo de 2022, en el que señala: “Per tot això, inform de la impossibilitat d'emetre informe amb la relació de les places objecte de la convocatòria del processos d'estabilització de l'Oferta d'Ocupació Pública per a l'Estabilització de l'Ocupació Temporal per manca de mitjans materials i humans que l'Ajuntament d'Andratx disposa, d'acord amb els antecedents que s'exposa en el present informe.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#222222"&gt;&lt;em&gt;Dado que no a esta secretaría no le consta cómo han sido analizadas las plazas incluidas en dicha Oferta extraordinaria de empleo, y que no consta informe de personal que evalúe dichas plazas incluidas en la propuesta, hago constar que la falta de identificación de las plazas puede originar que los procesos posteriores derivados de dicha OPE no se desarrollen en términos de normalidad. Este es el informe que emito sin perjuicio de otro mejor fundamentado en derecho.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
