En el BOIB núm. 183 de 27/10/2020 es va publicar Resolució de Batlia de data 22/10/2020 per la qual s'aprovava la taxa addicional d'estabilització de l'ocupació temporal per a l'any 2018, i la determinació i el nombre de places a convocar pel procediment de promoció interna. Tot això plegat, conformava l'Oferta Pública d'Ocupació per a l'any 2018 d'aquest ajuntament.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En el mateix butlletí es va publicar Resolució de Batlia de data 22/10/2020 per la qual s'aprovava la taxa addicional d'estabilització de l'ocupació temporal per a l'any 2019, i la determinació i el nombre de places a convocar pel procediment de promoció interna. Tot això plegat, conformava l'Oferta Pública d'Ocupació per a l'any 2019 d'aquest ajuntament.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. En data 28 de desembre de 2021 es va aprovar la </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a l'ocupació pública, publicada en el BOE núm. 312, de 29 de desembre de 2021, que autoritza un tercer procés d'estabilització d'ocupació pública. Addicionalment als processos d'estabilització que van regular la Llei 3/2017, de 27 de juny, de Pressupostos Generals de l'Estat per a l'any 2017 i la Llei 6/2018, 3 de juliol, de Pressupostos Generals de l'Estat per a l'any 2018, s'autoritza una taxa addicional per a l'estabilització d'ocupació temporal que inclourà les places de naturalesa estructural que, estiguin o no dins les relacions de llocs de treball, plantilles o altra forma d'organització de recursos humans que estiguin contemplades a les diferents Administracions Públiques, i estant dotades pressupostàriament, hagin estat ocupades de forma temporal i ininterrompudament almenys en els tres anys anteriors a 31 de desembre de 2020. Les Administracions Públiques hauran d'oferir, abans de l'1 de juny del 2022, les places de personal temporal actualment ocupades.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. La </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a l'ocupació pública estableix a l'article 2 que les places afectades pels processos d'estabilització prevists en l'Oferta Pública d'Ocupació per a l'any 2018 i per l'any 2019, seran incloses dins el nou procés d'estabilització sempre que haguessin estat incloses en les corresponents ofertes d'ocupació pública d'estabilització i arribada la data d'entrada en vigor de la present Llei, no haguessin estat convocades, o havent estat convocades i resoltes, hagin quedat sense cobrir.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. E</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">l </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">sistema de selecció serà el de concurs-oposició, amb una valoració en la fase de concurs d'un 40% de la puntuació total, en què es tindrà en compte majoritàriament l'experiència en el cos, escala, categoria o equivalent de què es tracti podent no ser eliminatoris els exercicis en fase d'oposició, en el marc de la negociació col·lectiva establerta a l'article 37.1. ) del Text Refós de la Llei de l'Estatut Bàsic de l'Empleat Públic.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Les places que haguessin estat ocupades amb caràcter temporal de manera ininterrompuda des d'abans de l'1 de gener de 2016 es convocaran pel sistema de concurs de manera excepcional, en aplicació de la Disposició Addicional 6na de la &nbsp;Llei 20/2021, de 28 de desembre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">5. <span style="background-color:white">Estableix la</span></span><span style="color:black"> Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a l'ocupació pública</span><span style="background-color:white"><span style="color:#222222"> que aquests processos, que s'han de fer una sola vegada, poden ser objecte de negociació en cadascun dels àmbits territorials de l'Administració de l'Estat, les comunitats autònomes i les entitats locals. El procés d'estabilització ha estat objecte de negociació </span></span><span style="color:black">en el si de la Mesa General de Negociació dels empleats públics d'aquest ajuntament en sessions de data 13/04/2022, 26/04/2022, 04/05/2022, 13/05/2022, 19/05/2022</span><span style="color:#222222">.</span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">6. D'altra banda l'article 20 de </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">la Llei 22/2021, de 27 de juny, de Pressupostos Generals de l'Estat per a l'any 2022, </span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">&nbsp;</span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">inclou l'aprovació de l'Oferta d'Ocupació Pública&nbsp;ordinària, subjecta a una taxa de reposició d'efectius del 110 per cent, sense perjudici dels processos d'estabilització la&nbsp;aprovació&nbsp;sense perjudici dels processos d'estabilització.&nbsp;</span></p> <p><strong>Fonaments de Dret</strong></p> <p><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif">1. L'article 91.1 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, així com l'article 128.1 del Reial decret legislatiu 781/1986, de 18 d'abril, pel qual s'aprova el text refós de les disposicions legals vigents en matèria de règim local, disposen que les corporacions locals han de formular públicament la seva oferta d'ocupació pública, ajustant-se als criteris fixats en la normativa bàsica estatal.</span></p> <p><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="color:black">2.</span></span><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> </span><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif"><span style="color:black">L'article 2.1</span></span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif"> de la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a la ocupació pública en quant autoritza una taxa addicional per a l'estabilització de d'ocupació temporal a l'administració i que les places afectades pels processos d'estabilització prevists en l'Oferta Pública d'Ocupació per a l'any 2018 i per l'any 2019, seran incloses dins el nou procés d'estabilització sempre que, arribada la data d'entrada en vigor de la Llei, no haguessin estat convocades.</span></p> <p><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif">3.</span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif"> L'article 2.2 de la Llei 20/2021, de 28 de desembre, de mesures urgents per a la reducció de la temporalitat a la ocupació pública que estableix que Les ofertes d'ocupació que articulin els processos d'estabilització contemplats en l'apartat 1, així com el nou procés d'estabilització, s'hauran d'aprovar i publicar en els respectius diaris oficials abans de l'1 de juny de 2022.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">4. Disposició Addicional 6 de la Llei 20/2021, de 28 de desembre, que disposa amb caràcter excepcional el sistema de concurs per a aquelles places que, reunint els requisits establerts en l'article 2.1 de la Llei, haguessin estat ocupades amb caràcter temporal de manera ininterrompuda amb anterioritat a 1 de gener de 2016.</span></p> <p><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif">5. O</span>rdenar la publicació d'aquesta resolució en el BOIB, en compliment del que disposa l'article 47.5 de la llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">Contra aquest acte administratiu, que exhaureix la via administrativa, es pot presentar recurs de reposició davant el mateix òrgan que l'ha dictat, d'acord amb l'article 123 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. El termini per interposar-lo és d'un mes comptador des de l'endemà de la publicació d'aquesta resolució.
