    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La regidora delegada, el dia 18 de maig de 2022 ha dictat la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;"&lt;strong&gt;DECRET:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; Atès que mitjançant el decret d'Alcaldia núm. 2022-3840, de data 25/04/2022, es van aprovar les bases i la convocatòria que ha de regir el procés selectiu per a la provisió de 15 places de Policia Local vacants i dotades pressupostàriament: 1 plaça procedent de l'Oferta d'Ocupació Pública de 2020 (BOIB núm. 91 de data 23 de maig de 2020) amb número de codi AgPol0082, 1 plaça procedent de l'Oferta d'Ocupació Pública de l'any 2021 (BOIB núm. 85 de data 29 de juny de 2021) amb número de codi AgPol0083 i 13 places procedents de l'Oferta d'Ocupació Pública de l'any 2022 (BOIB núm. 47 de data 7 d'abril de 2022) amb número de codi AgPol0084, AgPol0085, AgPol0086, AgPol0087, AgPol0088, AgPol0089, AgPol0090, AgPol0091, AgPol0092, AgPol0093, AgPol0094, AgPol0095 i AgPol0096, pel sistema d'accés de torn lliure, places enquadrades en la plantilla de personal funcionari, escala d'Administració Especial, Subescala de Serveis Especials, Classe Policia Local, Grup de classificació C1, per a cobrir el lloc de treball d'Agent de la Policia Local, que ha estat publicat en el Butlletí Oficial de les Illes Balears núm. 58 de data 3 de maig de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; Atesa la revisió de les bases que s'han referenciat abans duta a terme per part de l'Institut de Seguretat Pública de les Illes Balears (ISPIB) a l'empara del que estableix l'article 13.1.c del Decret 3/2009, de 16 de gener, pel qual es regula l'Institut de Seguretat Pública de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.&lt;/strong&gt; Considerant que les modificacions proposades no alteraran les condicions d'igualtat ni publicitat en el procediment selectiu que està en tràmit.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.&lt;/strong&gt; De conformitat amb l'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, que assenyala que “&lt;em&gt;Les administracions públiques podran, així mateix, rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.&lt;/strong&gt; D'acord amb els antecedents assenyalats i fent ús de les atribucions que m'han estat delegades mitjançant el Decret d'Alcaldia núm. 2020-1083 de data 19 de febrer de 2020 (BOIB núm. 29 de 7/03/2020),&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLC:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMER.-&lt;/strong&gt; Rectificar les bases de la convocatòria que han de regir el procés selectiu per a la provisió de 15 places de Policia Local, en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Allà on diu:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;&lt;em&gt;PRIMERA. OBJECTE, NORMATIVA D'APLICACIÓ, PROCEDIMENT DE SELECCIÓ I TRAMITACIÓ D'URGÈNCIA. &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

S'aplicaran a aquestes proves selectives les presents bases; la Llei 4/2013, de 17 de juliol, de coordinació de les policies locals de les Illes Balears, amb la modificació efectuada per la Llei 11/2017, de 20 de desembre; el Decret 40/2019, de 24 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears i es modifica el Decret 55/2017, de 15 de desembre, del Fons de Seguretat Pública de les Illes Balears; la Resolució de la consellera d'Administracions Públiques i Modernització de 23 d'octubre de 2020 per la qual es determina la metodologia d'execució, supervisió i avaluació de les pràctiques en el municipi per a les diferents categories de policia local, el Decret 11/2017, de 24 de març, d'exigència del coneixement de la llengua catalana en els procediments selectius d'accés a la funció pública i per a ocupar llocs de treball de l'Administració de la Comunitat Autònoma de les Illes Balears, el Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut Bàsic l'Empleat públic, i la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, així com la resta de disposicions legals aplicables a la Policia Local.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;[…/...]&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3.1.2. Juntament amb la sol·licitud, les persones aspirants han de presentar:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) Document Nacional d'Identitat en vigor. No cal presentar-ho si la persona aspirant no s'oposa al fet que l'Administració obtingui aquest document mitjançant les xarxes d'intermediació de dades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) Acreditació d'haver abonat la taxa per drets d'examen. La falta de justificació del pagament de la taxa indicada determina l'exclusió de l'aspirant. Aquest pagament no substitueix, en cap cas, el tràmit de presentar la sol·licitud en el termini i en la forma prevista.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) En el seu cas, Certificat d'aptitud física de l'Escola Balear d'Administració Pública (EBAP), en els termes que s'estableixen en l'article 165.3 del Decret 40/2019, a l'efecte de quedar exempt de la realització de les proves físiques. La validesa dels certificats és de dos anys comptats des del dia de la superació de les proves. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Les persones que acreditin el certificat d'aptitud física emes per l'Escola Balear d'Administració Pública, en els termes que s'estableixen en la Disposició Transitòria primera del Decret Llei 6/2021 de 9 de juliol, estan exemptes de realitzar les proves físiques que figuren a l'annex I. Seran vàlids els certificats emesos des de l'entrada en vigor del Decret 40/2019 (26/05/2019) fins a l'entrada en vigor del Decret Llei 6/2021 (11/07/2021) amb una amb una vigència de dos anys comptadors des del dia de la superació de les proves d'acreditació de l'aptitud física que certifiquin.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Les persones que acreditin el certificat d'aptitud física de l'EBAP de l'article 165.3 del Decret 40/2019, de 24 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears, en vigor en la data de finalització del termini de presentació de sol·licituds resten exemptes de fer les proves físiques que es determinen en l'annex I de les presents bases. La validesa dels certificats és de dos anys comptadors des del dia de la superació de les proves. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;[…/...]&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Les persones que acreditin el certificat d'aptitud física emes per l'Escola Balear d'Administració Pública, en els termes que s'estableixen en la Disposició Transitòria primera del Decret Llei 6/2021 de 9 de juliol, estan exemptes de realitzar les proves físiques que figuren a l'annex I. Seran vàlids els certificats emesos des de l'entrada en vigor del Decret 40/2019 (26/05/2019) fins a l'entrada en vigor del Decret Llei 6/2021 (11/07/2021) amb una amb una vigència de dos anys comptadors des del dia de la superació de les proves d'acreditació de l'aptitud física que certifiquin.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;[…/...]”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGON. &lt;/strong&gt;Mantenir inalterable la resta de les bases del procés selectiu, publicades en el Butlletí Oficial de les Illes Balears núm. 58 de 3 de maig de 2022, en tots els seus termes.&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCER. &lt;/strong&gt;Publicar aquesta resolució en el Butlletí Oficial de les Illes Balears, en el tauler d'anuncis de la seu electrònica de l'Ajuntament d'Eivissa (https://eivissa.sedelectronica.es) i en la pàgina web municipal (http://www.eivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;QUART.&lt;/strong&gt; Contra aquesta resolució, que posa fi a la via administrativa, es pot interposar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Directament, recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma de Mallorca en el termini de dos mesos comptadors des de l'endemà d'haver-ne rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Recurs potestatiu de reposició davant l'Alcaldia, en el termini d'un mes comptador des de l'endemà d'haver-ne rebut la notificació, d'acord amb l'article 123 i 124 de la Llei 39/2015, d'1 d'octubre de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimació per silenci del recurs de reposició, que es produirà pel transcurs d'un mes des de la seva presentació sense que s'hagi resolt expressament ni s'hagi notificat, podrà interposar-se el recurs contenciós administratiu, en el termini de sis mesos a partir del dia següent a la desestimació presumpta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Qualsevol altre recurs que cregueu convenient, d'acord amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i de la Llei 39/2015, d'1 d'octubre de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
