Aquests permeten consolidar unes bases per a les relacions entre la ciutadania, a la vegada que li donen una alternativa sana i pròxima a l'hora d'adquirir productes diversos. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">A més, comporten una millora en l'oferta en relació a la qualitat dels diferents productes que s'ofereixen i en la competitivitat dels comerços del voltant. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El municipi de Sant Llorenç des Cardassar consta de diferents nuclis, la qual cosa es tradueix en l'existència de mercats en cada un d'ells, donant així facilitat a les persones consumidores d'aquests. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La presència dels mercats origina la necessitat de regular-los de forma que serveixi als interessos generals de la ciutadania, i s'adeqüi a la normativa existent en l'actualitat. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Per aquest motiu, aquesta modificació pretén adequar-se a les condicions actuals del municipi, i al mateix temps millorar el redactat per fer-lo més transparent i pròxim a la ciutadania. Aquesta modificació se centra en la neteja de les zones de mercats, en les obligacions de les persones mercaderes i en certs punts referits als horaris i llocs de realització de l'activitat. La present disposició neix amb la finalitat de seguir els principis de necessitat, eficàcia, proporcionalitat, seguretat jurídica, transparència i eficiència establerts com a principis de bona regulació a l´article 129 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. Es troba en consonància amb la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, la Llei 7/1996, de 15 de gener, d'ordenació del comerç minorista, la Llei 17/2009, de 23 de novembre, de lliure accés a les activitats de serveis i el seu exercici, la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, la Llei 11/2014, de 15 d'octubre, de comerç de les Illes Balears, y la Directiva 2006/123/CE del Parlament Europeu i del Consell de la Unió Europea, de 12 de desembre de 2006, relativa als serveis en el mercat interior. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Així mateix, s'ha tingut en compte la normativa de la Comunitat Autònoma de les Illes Balears relativa a l'ordenació de l'activitat comercial, la Llei 11/2014, de 15 d'octubre, de comerç de les Illes Balears, la Llei 7/2014, de 23 de juliol, de protecció de les persones consumidores i usuàries de les Illes Balears, i a la Llei 17/2016, de 16 de desembre, de modificació de la llei 11/2014, de 15 d'octubre, de comerç de les Illes Balears. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">D'altra banda i d'acord amb la Llei 8/2019, de 19 de febrer, de residus i sòls contaminats de les Illes Balears, els mercats del municipi de Sant Llorenç es veuran obligats a complir aquesta normativa i avançar cap un municipi més sostenible i de residu zero. En aquest sentit el municipi de Sant Llorenç des Cardassar vol ser un municipi que impulsi la promoció dels valors cívics i socials que representen els mercats municipals. Perquè s´entén que els mercats fan poble, són més propers i humans, són sostenibles, integradors, responsables i fomenten l'alimentació saludable.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">CAPÍTOL 1. DISPOSICIONS GENERALS</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 1. Objecte</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El Reglament de mercats de l'Ajuntament de Sant Llorenç des Cardassar, té per objecte la regulació administrativa de la venta de productes en mercats ambulants del municipi de Sant Llorenç des Cardassar.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 2. Concepte</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Es considera venda ambulant la que s'efectua fora d'un establiment comercial permanent, de manera habitual, ocasional periòdica o continuada, en els perímetres o llocs degudament autoritzats, a instal·lacions comercials desmuntables o transportables, incloent-hi camions botiga i de restauració.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Aquest tipus de venda únicament es pot dur a terme a mercats fixes, periòdics o ocasionals així com a llocs instal·lats a la via pública. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les activitats de venda ambulant no perden la seva condició pel fet que es duguin a terme sobre sòl de propietat o titularitat privada.<strong> </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 3. Àmbit d'Aplicació</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'exercici de la venda ambulant es podrà realitzar en els mercats periòdics que es duen a terme al municipi de Sant Llorenç des Cardassar i que són els següents: </span></span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Mercat setmanal d'abastament i Gastromarket de Sant Llorenç des Cardassar </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Mercat setmanal de temporada de sa Coma </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Mercat setmanal d'abastament de Son Carrió</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Mercat setmanal de temporada de S'Illot</span></span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Aquest reglament no serà aplicable a aquelles vendes que, tot i efectuar-se a la via pública, es duen a terme dins una activitat d'interès general, com son els mercadets de Nadal o fires i festes populars. En aquest cas, serà la regidoria corresponent qui s'encarregarà de fer-ne el control. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 4. Competències i ordenació de l'ocupació</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament es&nbsp;&nbsp; l'òrgan competent per autoritzar l'exercici de venda ambulant i podrà ampliar o reduir l'extensió, la temporada i l'horari d'aquests mercats segons les necessitats de la població i circumstàncies de força major,&nbsp; sempre que sigui de forma justificada. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament es reserva la competència de decidir la ubicació dels mercats setmanals la qual serà informada a les persones comerciants abans de l'inici de la nova temporada. Així mateix, es reserva el trasllat dels llocs a altres zones per causa d'interès general, la reducció o l'ampliació del nombre de llocs amb motiu d'esdeveniments festius o causes externes a la dinàmica municipal, &nbsp;el canvi d'horari o la suspensió temporal dels mercats per raó d'obres en la via pública o per altres causes d'interès general o alienes a la dinàmica municipal.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">CAPÍTOL 2. AUTORITZACIONS I TRÀMITS</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 5. Autoritzacions</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament és l'òrgan competent per autoritzar la venda ambulant i d'atorgar a les persones interessades, que compleixen els requisits, la llicència per exercir la venda ambulant, en el qual s'han de determinar el temps i el lloc en què s'ha d'exercir.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No es pot atorgar a la mateixa persona titular més d'una llicència per al mateix mercat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 6. Personalitat de les adjudicacions</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones adjudicatàries podran ser físiques, jurídiques o cooperatives d'àmbit autonòmic, estatal o estrangeres.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 7. Termini de presentació de sol·licituds</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El termini de presentació de noves sol·licituds estarà obert durant tot l'any per a qualsevol mercat setmanal. Aquestes es faran per registre general d'acord amb l'article 8 d'aquest reglament.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les sol·licituds de renovació s'hauran de formular de l'1 al 30 de novembre, ambdós inclosos, per registre general d'acord amb l'article 8 d'aquest reglament.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les sol·licituds de renovació si no es fan dins el termini establert pot suposar la pèrdua del trast i la sol·licitud s'entendrà com una sol·licitud nova.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article&nbsp; 8. Atorgament d'un trast</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Per sol·licitar un trast serà necessari no haver concorregut en alguna de les incompatibilitats previstes a la normativa de contractes del sector públic. Segons el cas, la tramitació és portarà a terme de la següent manera: </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">a) En cas de nova sol·licitud</span></span></span></p> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La persona interessada podrà presentar la sol·licitud en qualsevol moment de l'any natural adjuntant la documentació específica a l'article 8. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'adjudicació dels trasts la farà l'Ajuntament d'acord amb els espais disponibles i la llista de sol·licituds presentades. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'ajuntament informarà a la persona interessada per via telefònica, per correu electrònic o per notificació electrònica, l'autorització de la venda ambulant al mercat municipal. Aquestes normes es facilitaran a la persona venedora, per part de la delegació corresponent, una vegada s'hagi adjudicat el trast i seran d'obligat compliment per part de la persona comerciant. </span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">b) En cas de renovació</span></span></span></p> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La renovació de les autoritzacions no serà automàtica sinó que serà a instància de la persona interessada a aquest efecte. Les sol·licituds de renovació s'hauran de formular des de l'1 al 30 de novembre per registre general i presentant la documentació establerta a l'article 8 d'aquest reglament. No presentar aquesta sol·licitud significa perdre automàticament la llicència de venda. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La revisió de la documentació presentada i l'adjudicació dels trasts la farà l'ajuntament en un termini de 30 dies laborables a partir de la data en que s'ha fet el registre general a l'Ajuntament de Sant Llorenç des Cardassar. Si no hi ha resposta, s'entendrà que el venedor no té concedida l'autortizació.</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'ajuntament informarà a la persona interessada per via telefònica, per correu electrònic o per notificació electrònica, l'autorització de la venda ambulant al mercat municipal. El termini per respondre serà de 15 dies hàbils a partir de la finalització del termini de resolució. En cas que la persona venedora no rebi cap avís s'entendrà que la resolució de l'adjudicació del trast ha estat desfavorable o desestimada.</span></span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Si la persona titular d'una autorització d'ocupació no concorre al trast assignat el dia de mercat, aquest podrà ser ocupat per un altre mercader o per meitats per les persones titulars dels trasts que hi confrontin lateralment. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les autoritzacions s'atorgaran sense perjudici de les obligacions de caràcter fiscal, laboral o de qualsevol altre classe que hagin de complir les persones venedores. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones adjudicatàries de trasts hauran de pagar anualment les taxes fixades a l'Ordenança Fiscal sobre l'ocupació d'espais públics en mercats municipals. La durada de la possessió del trast adquirit és per un any natural i les liquidacions es notificaran a les persones interessades una vegada atorgat el trast a principi de l'any.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 10. Atorgament extraordinari d'autoritzacions per als trasts de comerç local, artesania i/o comerç just</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Sense prejudici d'allò que estableix l'article 5, es possibilita l'atorgament d'autoritzacions extraordinàries per motius derivats de l'atractiu del producte que es vol vendre, producte local (article 15), punts de comerç just (article 16), etc. Aquestes sol·licituds seran estudiades i resoltes per la Junta de Govern Local, qui acordarà l'atorgament de l'autorització en aquests casos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'atorgament d'aquest tipus de trast podrà ser motiu d'exempció o reducció de liquidació del trast sempre i quant el producte de venta sigui entre un 70% i 100% producte local o de Mallorca, artesà, ecològic o de comerç just. A més a més s'haurà de justificar amb un segell de qualitat vigent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 11. Identificació del trast</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament facilitarà a les persones adjudicatàries un cartró acreditatiu que inclourà, la numeració del trast, el nom de la persona titular i de les persones autoritzades, un domicili, les mercaderies autoritzades i l'any en curs. També expedirà un carnet identificatiu a les persones titulars de trasts i autoritzades, per això, les persones adjudicatàries i les autoritzades hauran d'aportar, en el moment que els comuniquin l'adjudicació, fotografia carnet. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones adjudicatàries hauran de tenir a disposició del personal de de l'Ajuntament i visible en el lloc, en tot moment, la documentació acreditativa de ser la persona titular del trast. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">En cas de defunció o jubilació de la persona titular durant el període de la concessió es podrà traspassar els trasts al seu o la seva cònjuge o persona hereva després d'haver-ho autoritzat batlia o la regidoria delegada. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones venedores només poden muntar en els trasts que tenen autoritzats. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Si qualque venedor/a, sense prèvia autorització municipal, munta la seva mercaderia en un trast diferent al que té autoritzat, el personal municipal podrà ordenar el desmuntatge i cessament de l'exercici per aquell dia de mercat. Si el trast continu no està ocupat per la persona titular o venedora itinerant, podrà ser ocupat, per meitats, per les persones titulars dels trasts que hi confrontin lateralment. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'explotació de trasts eventuals queda condicionada al pagament corresponent, segons especifiquen les ordenances fiscals que figurin a les ordenances fiscals de l'Ajuntament que siguin d'aplicació. L' incompliment d'aquesta obligació comportarà la caducitat de l'ocupació. En cas que es declarés la caducitat es perdrà l'antiguitat i per obtenir nova autorització s'haurà de fer nova petició &nbsp;a més a més de fer el pagament pendent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones adjudicatàries han de satisfer el total d'exaccions que figuren a les ordenances fiscals, així com les contribucions, tributs i resta d'arbitris exigits per l'estat, la comunitat autònoma o el municipi. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 12. Pèrdua del trast</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Aquelles faltes no comunicades per endavant computaran com a falta d'assistència, llevat de que posteriorment es pugui justificar amb prou evidència (justificant mèdic…).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La no assistència injustificada al mercat 5 vegades consecutives a Sant Llorenç i a Son Carrió o 3 vegades consecutives al mercat &nbsp;de sa Coma de i s'Illot, sense ser justificat podrà suposar la pèrdua del nº i lloc del trast que s'haurà ostentat fins al moment. De la mateixa manera, podrà suposar la pèrdua del trast el fet de no assistir al mercat 8 vegades alternades a Sant Llorenç i a Son Carrió i 5 a Sa Coma i s'Illot.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones que tinguin adjudicat un trast estan obligades a avisar amb 15 dies d'antelació, sempre i quan sigui possible la seva absència al mercat per motiu de baixa laboral o vacances. A més, hauran d'avisar amb 15 dies d'antelació, sempre i quan sigui possible, de la seva reincorporació al mercat. </span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">CAPÍTOL III. DELS LLOCS DE VENDA</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 13. Dimensions dels trasts</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'activitat es desenvoluparà a través d'un trast o lloc on la persona venedora desenvolupa la seva activitat de venda. Els trasts tindran sempre el caràcter eventual. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les furgonetes-botiga tindran la mateixa consideració que els trasts, a efectes de compliment de la present normativa reglamentària. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Cada trast tindrà un mínim de 4m de llargària i 3m d'amplària. La dimensió màxima de les parades podrà ser de 12m x 3m.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 14. Aquest muntatge no pot superar els 30 minuts. La persona mercadera que arribi fora d'aquests horaris no tindrà dret a que se li hagi reservat el seu lloc habitual i només podrà descarregar i fer el muntatge si rep autorització expressa de l'autoritat municipal. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Una vegada estiguin al lloc assignat, els vehicles seran retirats el més aviat possible, deixant-los aparcats correctament fora de la ubicació del mercat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'autorització general tindrà un caràcter anual. Producte local/km0</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Per promocionar el producte local del petit comerç i fet a mà i que siguin elaborats per persones de les Illes Balears, la Junta de govern podrà atorgar llicencies extraordinàries (article 10) a:</span></span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els pagesos o pageses que tinguin productes agrícoles elaborats a les Illes Balears sempre i quan l'activitat dels quals estigui acreditada per la cambra de comerç agrícola o per la conselleria d'agricultura, podran sol·licitar un trast per col·locar el romanent dels seus productes fruitals, vegetals i d'hortalissa, formatges, olis, vi i begudes alcohòliques, ous, mel, embotit mallorquí, confitures, fruits secs i derivats (entre altres).</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Artesans i artesanes de les Illes Balears amb la certificació corresponent (Carta d'Artesania) que facin productes manuals i de qualitat respectuosos amb l'entorn (joieria, tèxtil, ceràmica..) o també elaboració de productes naturals i higiènics de segell producció ecològica.</span></span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els pagesos o pageses de producte local, artesans amb carta d'artesania i comerciants de productes ecològics amb reconeixement ecoambiental podran sol·licitar la seva participació als mercats setmanals i/o al Gastromarket en cas que es faci en dia o horari diferent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La sol·licitud es farà per registre general mitjançant autorització específica i d'acord amb l'article 8 d'aquest reglament. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 16. Comerç just</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'ajuntament reserva un lloc preferencial per mercaders que comerciïn exclusivament amb mercaderies de comerç just, degudament acreditades i segellades. Les persones titulars d'aquests llocs hauran de complir el que disposa aquesta ordenança tret dels punts referents a taxes d'ocupació i assistència.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els productes de comerç just podran sol·licitar la seva participació als mercats setmanals i/o al Gastromarket en cas que es faci en dia o horari diferent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La sol·licitud es farà per registre general mitjançant autorització específica i d'acord amb l'article 8 d'aquest reglament.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">CAPITOL IV. RÈGIM DE DEURES, INFRACCIONS I SANCIONS </span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 17</span></strong><span style="line-height:107%">. <strong>Obligacions de les persones venedores</strong> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones adjudicatàries dels trasts estan obligades a: </span></span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Complir totes les disposicions legals que siguin d'aplicació en matèria d'abastament, sanitat, residus, neteja viària, alimentació, comerç. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Ocupar personalment el trast o a través del seu personal contractat. Les podran substituir el seu o la seva cònjuge, sempre que compleixi el reglament, o si s'escau parents/es de primer grau, després d'haver-ho autoritzat l'Ajuntament. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Emprar bon llenguatge i tenir bon comportament, entre elles i amb el públic i les persones representants de l'Ajuntament. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Posar a la vista del públic el permís oficial (cartró), identificar-se de manera visible mitjançant el carnet corresponent.</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Presentar, en la sol·licitud del trast, els justificants d'estar al corrent de les seves obligacions laborals, fiscals i sanitàries, i les de caire econòmic amb l'entitat concessionària de l'explotació del mercat; a tal efecte presentaran albarans, factures o similars, acreditatius de l'origen de mercaderies i els preus d'adquisició. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Facilitar la documentació de la llicència, sempre que sigui demanada per les persones representants de l'Ajuntament. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La persona titular haurà de tenir en tot moment, i a disposició de les persones representants de l'Ajuntament els justificants d'haver pagat els drets municipals. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Avenir-se a la classificació atorgada pel que fa a l'activitat econòmica reconeguda i declarada, en funció del que estableixen la normativa d´aplicació i/o els plecs de cada mercat. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones venedores estan obligades a tenir permanentment el preu dels productes ben visibles i que no portin a confusió.</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones venedores estan obligades a estacionar els vehicles als llocs on determini l'autoritat municipal. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Vendre només allò per a què s'ha sol·licitat i obtingut autorització. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Deixar neta la zona de venda després de cada mercat. Està prohibit buidar i evacuar aigua bruta damunt les vies, en els espais lliures públics i en les zones verdes. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No està permesa la neteja dels estris necessaris pel desenvolupament de l'activitat a la zona de venda, a la via pública i a les zones verdes. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No està permès l'ús de bosses de plàstic amb menys del 70% de plàstic reciclat i no fragmentable tal com indica la Llei 8/2019 de 19 de febrer, de residus i sòls contaminants de les Illes Balears i que serà d'obligat compliment a partir del 2024.</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els trasts de menjar preparat hauran de servir el menjar objecte de venda en recipients compostables o reutilitzables i hauran d'anar etiquetats indicant en quina fracció de residus l'haurà de dipositar el consumidor.&nbsp; </span></span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El dipòsit i l'abocament de residus es farà de la següent manera:</span></span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els residus que es generin pel desenvolupament de l'activitat s'han de separar en les diferents fraccions: fracció orgànica (dipositats dins bosses compostables), paper i cartró, vidre, envasos lleugers i resta (dipositats dins bosses). </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Aquests residus, una vegada separats en les diferents fraccions, hauran de ser abocats als contenidors corresponents que amb aquest fi l'Ajuntament instal·li a la via pública o cedeixi temporalment als llocs de venda.</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">En els contenidors instal·lats per abocar els residus produïts per l'activitat de vendre en els mercats, es prohibeix dipositar-ho residus que contenguin líquids o que puguin liquar-se (olis, greixos solidificats per baixa temperatura), així com residus tòxics i perillosos, materials en combustió i objectes voluminosos. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Cap tipus de residus no podrà ser evacuat per la xarxa de clavegueram, fins i tot en el supòsit que s'hagi triturat prèviament o liquat. </span></span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">A més de les obligacions anteriorment esmentades, les persones venedores de fruites, verdures, fruits secs i derivats, hauran de complir les següents normes: </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">1. En relació al personal: </span></span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Tenir carnet per manipular aliments i sempre dur-lo damunt. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Utilitzar roba de treball, bata blanca o blava per a les persones venedores de productes hortofructícoles i tenir netedat. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Tenir el número de Registre d'Indústries Agràries. </span></span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">2. En relació als trasts: </span></span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els productes destinats a la venda estaran a una altura mínima de 40 cm de terra, o bé en caixons de plàstic nets i desinfectats Els fruits secs i els productes salats hauran d'estar protegits del sol. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Si es fan servir poals per pesar a la menuda hauran d'estar desinfectats i nets per a cada mercat. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El dipòsit i abocament d'escombraries es farà en la forma que determini el present Reglament. Aquest dipòsit i abocament serà responsabilitat de les persones venedores. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Si s'utilitzen tendals o para-sols, aquests s'elevaran 2 metres com a mínim per damunt de la rasant de la calçada. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Els llocs han de respectar les delimitacions horitzontals i verticals del trast ubicades al paviment, en el cas del mercat de sa Coma. Les mercaderies no poden sobresortir de l'anomenada delimitació. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Assistir al mercat, si no es causa degudament justificada i avisada per endavant. </span></span></span></p> </li> <li> <p style="margin-bottom:0px; En el cas dels mercats de Sant Llorenç seran 3 mercats consecutius o 10 alternats. </span></span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les infraccions molt greus se sancionaran amb la revocació de l'autorització per exercir la venda a qualsevol dels mercats municipals, després de la incoació de l'expedient corresponent, en els supòsits i en la forma prevista a la normativa de procediment administratiu comú i en la normativa reguladora de règim local. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Aquestes infraccions també podran ser castigades amb sancions de 501 a 1<span style="color:red">.</span>000 euros. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les infraccions greus seran castigades amb una sanció de 201 a 500 euros. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les infraccions lleus seran castigades amb una multa de fins a 200 euros. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No respectar aquestes normes i no fer el pagament de les infraccions greus o molt greus pot suposar la pèrdua del trast.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">CAPITOL V. ALTRES DISPOSICIONS</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 19</span></strong><span style="line-height:107%">. <strong>Productes no autoritzats</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">En el mercat de Sant Llorenç des Cardassar queda prohibida la venda de carns, aus i caça fresca, ni refrigerada, ni congelada. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Pel que fa al peix i marisc fresc, refrigerat i congelat, es podrà vendre sempre i quan vinguin en vehicles autoritzats isotèrmics. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Altres productes que per les seves especials característiques, i a criteri de les autoritats competents, suposin un risc sanitari. No obstant, es permetrà la venda dels productes abans esmentats quan a parer de les autoritats sanitàries competents es disposi de les instal·lacions adequades i aquests estiguin envasats degudament. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No es permetrà la venda de productes d'imitació de cap tipus de marca. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les autoritats sanitàries competents, en els casos excepcionals, en què motius de salut pública ho aconsellin, podran prohibir la venda de determinats productes alimentaris. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 20</span></strong><span style="line-height:107%">.<strong> Drets i obligacions de les persones compradores </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones compradores tindran el dret que els donin les mercaderies en condicions de qualitat, pes, mesura i de manera higiènica i sanitària. Les persones compradores que no es mostrin conformes amb el pes o mesura de les mercaderies, abans d'abandonar el mercat on les hagi comprat, avisarà el personal de l'Ajuntament perquè l'acompanyi a fer la segona pesada o repès municipal. Per a la comprovació pertinent així mateix tindrà dret a denunciar totes les deficiències que vegi, respecte a la qualitat de les mercaderies, servei i tracte per part de les persones venedores. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Queda absolutament prohibit a les persones compradores tocar o palpar les mercaderies exposades al públic, especialment aquells productes susceptibles de fàcil contaminació. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Les persones compradores han de mantenir una actitud correcta tant respecte a les persones venedores i subministradores com respecte al personal municipal i el públic concorrent. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No podran accedir ni circular pels mercats les persones captadores o venedores no autoritzades. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 21. Personal municipal al servei dels mercats</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El personal municipal ordenarà, com a mesura cautelar que no tindrà el caràcter de sanció, el desmuntatge i cessament de l'exercici per aquell dia de mercat d'aquells trasts les persones venedores del qual hagin tingut una brega o presentin productes en evidents males condicions. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament determinarà el personal que, conforme a les necessitats del servei, prestarà les seves funcions en el mercat municipal. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">El personal encarregat estarà a disposició de les persones usuàries del mercat amb tot allò que concerneixi al servei. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Article 22. Campanya de sensibilització, Mercats sostenibles</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">L'Ajuntament de Sant Llorenç des Cardassar posarà el recursos necessaris per iniciar una campanya de conscienciació dirigida tant a la ciutadania i a les persones venedores dels mercats municipals sobre com adquirir nous hàbits de compra i de consum i reduir residus.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">DISPOSICIÓ FINAL.
