&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;RESOLC FORMULAR:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;L'informe d'impacte ambiental sobre &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;el&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;projecte &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de creació de quatre rutes senderistes locals ubicades a camins públics del municipi d'Artà&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;, en els termes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. Determinació de subjecció a avaluació ambiental i tramitació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 48.&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;la Llei 13/2018&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;, de 28 d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;e desembre, de camins públics i rutes senderistes de Mallorca i Menorca, «els projectes de ruta senderista s'han de subjectar a avaluació ambiental, i si la ruta discorre per espais naturals protegits s'haurà de sol·licitar també l'informe preceptiu que contempla l'article 21 de la Llei 5/2005, de 26 de maig, per a la conservació dels espais de rellevància ambiental (LECO)».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Per tant, el projecte s'ha de tramitar com a una Avaluació d'Impacte Ambiental Simplificada i seguir el procediment establert a la secció 2a del Capítol II d'avaluació d'impacte ambiental de projectes del Títol II d'avaluació ambiental de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental. S'han de complir també les prescripcions de l'article 21 del Decret legislatiu 1/2020, de 28 d'agost, pel qual s'aprova el Text Refós de la Llei d'avaluació ambiental de les Illes Balears, que li siguin d'aplicació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. Descripció i ubicació del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El projecte &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;pretén&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; la creació de quatre rutes senderistes locals, el recorregut de les quals transcorr íntegrament per camins públics de terra o asfaltats del TM d'Artà, amb una longitud total de 39,87 km. Es considera la possibilitat que aquestes rutes siguin catalogades en el futur com a Petit Recorregut (PR) o Sender Local (SL).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Els recorreguts de les quatre rutes serà el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Ruta 1 (25,55 km): S'inicia a la Via Verda i es dirigeix cap al nord del terme municipal per la zona de Son Sureda, recorre el camí utilitzat per a la Marató de Muntanya d'Artà, fins a arribar a l'Ermita de Betlem. Des d'aquí comparteix itinerari amb el sender GR 222 fins a l'Alqueria Vella d'Avall ja immers al Parc Natural de la Península de Llevant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Arriba al Morro d'Albarca i a la Torre d'Aubarca torna a enllaçar amb el sender GR 222 seguint tota la franja costanera fins que de nou se separen en cala Mitjana, des d'aquí es dirigeix cap a Cala Mesquida i finalitza el seu recorregut en arribar a Cala Torta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Ruta 2 (5,94 km): L'inici del recorregut s'inicia entre Hort de Sa Begura i Sa Talaia, fins que enllaça amb la carretera Ma-3334, única opció viable per a tornar a Artà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Ruta 3 (3,13 km): S'inicia a la Via Verda i es dirigeix cap al sud del terme municipal per la zona de Sa Granja, en lleuger, però continu ascens, el traçat es dirigeix cap al Puig de s'Estelrica i pel serral que existeix en aquest, finalitzant el seu recorregut en el límit del terme municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Ruta 4 (5,25 km): S'inicia a la Via Verda i es dirigeix cap a l'oest del terme municipal per l'hipòdrom fins al Torrent de Sa Farinera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Les actuacions previstes del projecte es refereixen bàsicament a la senyalització de les rutes. Tant el cost derivat d'aquesta, que es basarà en el manual de senyalització per a senders PR de la Federació Espanyola d'Esports de Muntanya i Escalada (FEDME), com del manteniment dels camins (desbrossament), aniran a càrrec de l'Ajuntament d'Artà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Es preveu el desbrossament d'un tram de 2.337 m de longitud lineal de la ruta 1, per trobar-se envaït per la vegetació existent, amb l'objecte de garantir que aquesta ruta pot ser homologada, així com per garantir la seguretat dels usuaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Segons el document ambiental, en el recorregut de la ruta 1 que transcorre pel Parc Natural de Llevant, les actuacions previstes en el projecte es regiran pel que es disposa en actitud d'Ordenació de Recursos Naturals (PORN) vigent. Així mateix, aquest serà aplicable en aquelles zones que puguin veure's afectades després de l'aprovació del projecte d'ampliació previst per a aquest espai natural protegit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. Avaluació dels efectes previsibles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;D'acord amb el document ambiental, es preveuen els impactes següents, en relació amb les fases d'obres i funcionament del projecte: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Durant la fase d'obres (senyalització de les rutes), els principals efectes adversos sobre el medi ambient seran un increment del nivell de renou a l'ambient, i la pèrdua de coberta vegetal, derivades de les actuacions de condicionament dels camins, mentre que com a impactes positius es preveu la creació de llocs de feina del sector serveis (logística de les rutes, preparació de documentació...).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Durant la fase de funcionament, els principals efectes adversos sobre el medi ambient seran la pèrdua de coberta vegetal, per tasques de manteniment i per obertura de camins que no formen part de les rutes per part dels senderistes, risc d'incendi forestal per males pràctiques, i compactació i erosió del sòl, mentre que com a impactes positius es preveu la recuperació i conservació de camins i elements patrimonials i culturals d'interès.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4. Consultes a les administracions públiques afectades i persones interessades&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;L'òrgan ambiental ha realitzat les consultes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Costes i Litoral, de la DG de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Planificació al Medi Natural, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei d'Estudis i Planificació, de la DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Gestió del Domini Públic Hidràulic, de la DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Serveis Ferroviaris de Mallorca, de la Conselleria de Mobilitat i Habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Protecció d'Espècies, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei d'Espais Naturals, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Canvi Climàtic i Atmosfera (DG d'Energia i Canvi Climàtic), de la Conselleria de Transició Energètica i Sectors Productius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei d'Ordenació del Territori i Urbanisme, de la DG de Territori i Paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- DG d'Emergències i Interior, de la Conselleria d'Administracions Públiques i Modernització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- DG de Mobilitat i Transport Terrestre, de la Conselleria de Mobilitat i Habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Servei de Gestió Forestal i Protecció del Sòl, de la DG d'Espais Naturals i Biodiversitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Direcció Insular de Medi Ambient, del Departament de Sostenibilitat i Medi Ambient del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Direcció Insular d'Urbanisme, del Departament de Territori del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Direcció Insular de Transició i Ordenació Turística, del Departament de Transició, Turisme i Esports del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- GOB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Amics de la Terra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;En el moment de redactar el present informe, es disposa dels següents informes de les administracions previsiblement afectades i entitats interessades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La DG d'Emergències i Interior, de la Conselleria d'Administracions Públiques i Modernització, amb data 17 de març de 2022, va informar que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Una vegada examinada la nova documentació es mantenen les mateixes consideracions d'aquest Servei de data 4 de febrer de 2021,(...).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;És a dir, en relació, tant amb les rutes afectades per risc d'inundació (rutes 2, 3 i 4), com per aquelles afectades per risc d'incendi forestal (ruta 1), no suposen impediment per al projecte. No existeix cap instal·lació afectada pels riscos definits al RD 840/2015, de 21 de setembre, pel qual s'aproven mesures de control dels riscos inherents als accidents greus en els quals intervenen substàncies perilloses, en tot el municipi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Tot i això, una vegada vista l'experiència de la ruta del Camí de Cavalls a Menorca i com afecta la permeabilitat de la gent en territoris de difícil accés en situacions d'emergència, convindria incorporar al projecte fites identificatives de la ubicació exacta i que aquestes fossin conegudes pels serveis d'emergència, sobretot en els llocs més inaccessibles. Igualment, convé preveure i estudiar els itineraris que haurien d'utilitzar els serveis d'emergència per arribar a cada fita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- La Direcció Insular d'Urbanisme, del Departament de Territori del Consell de Mallorca, amb data 21 de març de 2022, va informar que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El present projecte no suposa cap nova intervenció sobre el territori als efectes d'obertura de nous camins públics. Dins el document ambiental, s'indica que la ruta 1, transcorre per espais de rellevància ambiental, concretament es veu afectat el LIC i ZEPA Muntanyes d'Artà i el Parc Natural de Llevant, així com les Àrees de Protecció de Risc d'Incendis, Erosió i Esllavissament, per tant, és la que ambientalment resulta més compromesa. També en el seu tram final afecta al Domini Públic Marítim Terrestre. La resta de rutes discorren majoritàriament per Sòl Rústic General i de forma molt puntual, la ruta tres es troba afectada per una zona APR d'inundació. El Document Ambiental, una vegada analitzats els impactes ambientals positius i negatius de les quatre (4) rutes senderistes, conclou, indicant que el projecte no compromet cap dels elements que li donen valor a les zones de Xarxa natura 2000, tal com són els hàbitats, la flora i la fauna sensible de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Dins el projecte no es detecten els plànols a Escala 1/10.000 i 1/50.000, de l'Annex I, indicats dins l'apartat 2.- Cartografia, de la memòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- El Servei de Planificació al Medi Natural, de la DG d'Espais Naturals i Biodiversitat, amb data 23 de març de 2022, va informar que: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En resposta al vostre escrit de data 11 de març passat (valib 83.109) sol·licitant informe en relació al Projecte de creació de 4 rutes senderistes locals al municipi d'Artà, he de comunicar-vos que la xarxa natura 2000 del municipi d'Artà coincideix amb l'àmbit Pla d'Ordenació dels Recursos Naturals (PORN) de la Península de Llevant i de l'ampliació del Parc Natural de la Península de Llevant, per la qual cosa s'hauria de trametre al Servei d'Espais Naturals per al seu informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5. Anàlisi dels criteris de l'annex III de la Llei 21/2013&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;S'han analitzat els criteris de l'annex III de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, i no es preveu que el projecte pugui tenir efectes significatius sobre el medi ambient, en concret:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. Característiques del projecte: &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;E&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;s&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;pretén&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; la creació de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;quatre&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; rutes senderistes, el recorregut de les quals transcorr íntegrament per camins públics &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de terra o asfaltats d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;el &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;TM&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Artà&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;amb una longitud total de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;39&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;87&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; km.&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Les actuacions previstes inclouen la senyalització de les rutes i &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;el d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;esbross&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;ament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;un&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;tram intransitable de la ruta &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1 &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;337&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; m, per garantir que &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;aquesta&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; p&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;ugui&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; ser homologada, així com per garantir la seguretat dels usuaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El projecte avaluat&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; consisteix en la reformulació del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;«Proyecto de diseño, ejecución y mantenimiento de rutas senderistas en el municipio de Artà», &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;respecte del&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; qual es &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;va dictar resolució del president de la CMAIB, amb data 15 de desembre de 2021, relativa a la seva su&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;jecció a avaluació d'impacte ambiental ordinària (&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;175a/2020, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;BOIB núm. 180, de 30 de desembre de 2021),&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;man&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;t&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;enint-se&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;íntegrament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; el traçat de les rutes 1,2,3 i 4 del projecte original, i suprim&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;int-se&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;completament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; el traçat de la ruta 5, que va ser informada desfavorablement pel Servei d'Espais Naturals, en data 30 de novembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Ubicació del projecte: D'acord amb el Pla Territorial de Mallorca (PTIM), la zona d'estudi es troba qualificada majoritàriament com a ANEI, tot i que alguns dels trams de les diferents rutes es troben damunt sòl qualificat com&lt;/span&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; a Sòl Rústic General (SRG), Àrea de Transició (AT) Harmonització, Àrea &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;R&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;ural d'Inter&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;ès&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; Paisatgístic (ARIP), Àrees de desenvolupament: Sòl Urbà i Urbanitzable, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Àrea &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;N&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;atural d'especial interès d'alt nivell de protecció (AANP) i Àrea d'Interès Agrari (AIA) Extensiva Oliverar. La major par&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;t de la ruta 1 està afectada pel LIC i ZEPA «Muntanyes d'Artà» (ES0000227) i pel Parc Natural de la Península de Llevant (ES530007). L'àmbit d'actuació del projecte se situa majoritàriament dins la Unitat de Paisatge 5 (UP-5) «Península d'Artà».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Totes les rutes projectades es veuen afectades en algun dels seus trams per una o diverses de les àrees de prevenció de riscos (APR) definides al PTIM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;La ruta 1 es troba afectada parcialment per zona de Domini Públic Maritimoterrestre (DPMT). D'altra banda, tant la ruta 1, com les rutes 3 i 4, es troben parcialment afectades per zona de domini públic o zona de protecció de la xarxa ferroviària. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Segons el Servei de Protecció d'Espècies, les espècies que es poden veure més afectades per la concentració d'un nombre elevat de persones a les rutes projectades són la tortuga mediterrània (Testudo hermanni) i l'àguila peixatera (Pandion haliaetus). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. Característiques del potencial impacte: &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;D'acord amb el document ambiental, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;els impactes negatius de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;l'execució del projecte&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; es consideren d'intensitat baixa i de caràcter puntual. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Durant la fase de funcionament, la major part dels impactes negatius es derivaran de conductes inadequades per part dels usuaris de les rutes. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Es preveu&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; minimitzar aquest tipus de conductes &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;amb la implantació de mesures preventives, correctores i compensatòries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Conclusions de l'informe d'impacte ambiental&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Primer: No subjectar a avaluació d'impacte ambiental ordinària el «Proyecto de diseño, ejecución y mantenimiento de rutas senderistas en el municipio de Artà», atès que no &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;es preveu que pugui tenir efectes significatius sobre el medi ambient d'acord amb els criteris de l'annex III de la Llei 21/2013, sempre que es compleixin les mesures proposades en el document ambiental, signat per la Sra. Ana Delgado Núñez, ambientòloga, amb data febrer de 2022, de la consultora GEST AMBIENTAL, i les condicions següents pel que fa a les rutes 1, 2 i 3, si es modifica el traçat &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de les rutes 1 i 3, per tal que no coincideixi amb el del tren d'Artà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. D'acord amb el Servei d'Espais Naturals, en relació amb l&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;es&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;rut&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;es&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; 2 &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3, les quals no travessen espai natural protegit:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'hauran de prendre les mesures necessàries perquè els usuaris no utilitzin camins alternatius (dreceres) a les rutes senyalitzades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- La senyalització vinculada a l'ús públic del LIC i ZEPA, així com a l'àmbit de l'ampliació del Parc Natural de la Península de Llevant, s'haurà d'ajustar a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; les indicacions del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Manual de senyalització dels espais naturals protegits de les Illes Balears, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;havent de substituir e&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;n la franja grisa inferior el logotip del Govern Balear pel logotip corresponent a l'entitat que promogui l'actuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Els manuals de bones pràctiques i fullets de sensibilització ambiental de les rutes hauran d'incorporar els espais protegits de l'ampliació del Parc Natural de la Península de Llevant i de la Xarxa Natura 2000, així com les espècies i hàbitats d'interès comunitari que es localitzen a les rutes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'haurà de realitzar una recollida selectiva dels residus i la zona haurà de quedar en les mateixes condicions en què estava abans de l'activitat, d'acord amb la Llei 8/2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- No es podrà emetre música ni cap sistema de megafonia, altaveu o d'amplificació del so, ni cap altre tipus de font sonora que pugui ocasionar molèsties a la fauna, d'acord amb la Llei 1/2007.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'haurà de conscienciar els treballadors que han de realitzar les tasques de condicionament de les rutes, i als usuaris de les rutes, d'estar dins un espai natural protegit amb valors naturals i culturals, per la qual cosa cal respectar les normes de protecció existents, amb especial referència sobre la protecció de tortuga mediterrània (Testudo hermanni) inclosa a l'annex II de la Directiva Hàbitats i que d'acord amb la Llei 42/2007, de 13 de desembre, del patrimoni natural i de la biodiversitat queda prohibit matar, danyar, molestar o inquietar les espècies animals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. S'hauran d'incorporar fites identificatives de la ubicació exacta a cada una de les rutes 1, 2 i 3, les quals hauran de ser informades als serveis d'emergència per al seu coneixement i anàlisi de les vies d'accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. D'acord amb el Servei de Protecció d'Espècies, la publicitat i la senyalització de les rutes 1,2 i 3 haurà d'incloure informació sobre l'estat de protecció de la tortuga mediterrània (Testudo hermanni), així com sobre la prohibició de la seva tinença i transport, i molèsties intencionades a aquesta espècie. Així mateix, s'haurà d'establir una àrea de tranquil·litat al voltant dels nius d'àguila peixatera de 500 metres entre els mesos de febrer a agost.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4. D'acord amb el Servei de Gestió Forestal i Protecció del Sòl, en relació amb les rutes 1,2 i 3:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Els cartells de senyalització tipus placa o similar, hauran d'incorporar informació relativa a l'elevat risc d'incendi forestal existent, especialment a les rutes que discorren dins terreny forestal. Altrament, es recomana que tant a les marquesines o panells informatius així com als punts d'informació, s'expliqui que es tracta d'una àrea d'elevada recurrència d'incendis forestals, així com d'Alt Risc d'Incendi Forestal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- En la mesura del possible, el projecte de creació de les rutes senderistes no haurà de condicionar les tasques de manteniment, reparació o restauració que calgui fer a les pistes forestals d'accés a la península de Llevant pel trànsit rodat, especialment pel que fa als vehicles d'emergència per incendi forestal i gestió territorial de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Durant la realització de les obres, caldrà complir el Decret 125/2007, de 5 d'octubre, pel qual es dicten normes sobre l'ús del foc i es regula l'exercici de determinades activitats susceptibles d'incrementar el risc d'incendi forestal, especialment pel que fa a mesures de prevenció durant l'època de perill d'incendi forestal i les accions conjunturals de prevenció (art. 8.2.c).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5. D'acord amb el Servei d'Estudis i Planificació, de la DG de Recursos Hídrics:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- En aquelles àrees afectades per APR d'esllavissades s'haurà de senyalitzar l'existència d'aquest risc (ruta 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- En cas que s'editin elements d'informació (punts d'informació, plànols i fulletons) aquests hauran de fer especial esment a què quan les condicions meteorològiques són adverses (sobretot per pluges intenses, forts vents i gelades) el risc és major. Per tant, han de remarcar que no és recomanable transitar per la ruta en aquestes condicions, i que és necessari consultar les previsions meteorològiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6. Respecte al Pla de Vigilància Ambiental:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'han d'incloure uns indicadors clars i específics per fer el seguiment periòdic i objectiu de l'efectivitat de les mesures correctores i preventives a cada una de les fases del projecte. A més, d'incloure les actuacions que es duran a terme en el cas que les mesures no obtinguin el resultat desitjat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'han d'incloure els terminis de realització dels informes ordinaris de seguiment ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'ha de trametre a la CMAIB el Pla de Vigilància Ambiental una vegada esmenat amb les indicacions dels punts anteriors, en un termini de tres mesos des de la publicació de la resolució de l'expedient, per a la seva revisió i abans de l'inici de les obres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;D'altra banda, es recomana la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;coordina&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;ció d'aquestes rutes senderistes amb la ruta dels fars del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7. En cas d'un eventual desmantellament de la senyalització de les rutes, s'haurà de procedir a la restauració del terreny afectat al seu estat original, i a la recollida i entrega a un gestor autoritzat dels residus generats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Així mateix, es recorda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- Atès que alguns trams&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; de les rutes projectades afecten DPMT, s'haurà de disposar, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;si s'escau,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; de les autoritzacions pertinents.&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'ha de dona&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;r compliment a les previsions de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; l&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;a Llei 13/2018, de 28 de desembre, de camins públics i rutes senderistes de Mallorca i Menorca, que siguin d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- S'haurà de complir amb les prohibicions genèriques de l'article 57 de la Llei 42/2007.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;- D'acord amb la Direcció Insular d'Urbanisme, s'hauran d'aportar els plànols a Escala 1/10.000 i 1/50.000, de l'Annex I, indicats dins l'apartat 2.- Cartografia, de la memòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Segon. Subjectar&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;la ruta 4 a avaluació d'impacte ambiental ordinària, tot això, sense perjudici que es pugui mantenir i publicitar com a via verda mentre no recuperi la seva funció ferroviària. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Tercer. Es publicarà el present informe ambiental al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 47.3 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#1a1718"&gt;&lt;span style="background-color:null"&gt;Quart. L'informe d'impacte ambiental perdrà la seva vigència i cessarà en la producció dels efectes que li són propis si, una vegada publicat en el BOIB, no s&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;'hagués procedit a l'aprovació del projecte en el termini màxim de quatre anys des de la publicació, d'acord amb el que disposa l'article 47.4 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Cinquè. L'informe d'impacte ambiental no ha de ser objecte de cap recurs, sense perjudici dels que, si s'escau, siguin procedents en la via administrativa o judicial davant de l'acte, si s'escau, d'autorització del projecte, d'acord amb el que disposa l'article 47.&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5 de la Llei 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sisè. Aquesta resolució s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
