![CDATA[<div class="Section0"> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a<strong>&nbsp;</strong>les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185) i en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>2.&nbsp;Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de Pere Seda, SL, entre d'altres,&nbsp;que figuren en l'annex de la Resolució de concessió, R1 de data 10 de setembre de 2020, (BOIB núm. 161, de 17 de setembre de 2020) amb les dades i els imports corresponents&nbsp;(amb un import concedit de 35.416,90 €).</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&nbsp;</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>6. En data 21 de març de 2022, es notifica a la persona interessada, mitjançant la publicació al web, l'Informe proposta provisional de resolució de revocació parcial de 17 de març de 2022, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. El 8 d'abril de 2022 (RGE núm. 210144), el beneficiari presenta escrit en què manifesta que està d'acord amb l'Informe proposta provisional abans esmentat i per tant no presentarà escrit d'</em></span></span>&nbsp;<span style="background-color:#ffffff"><span style="color:#000000"><em>al·legacions.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>7.
