&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:black"&gt;1. El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES&amp;nbsp;III)&lt;strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/strong&gt;mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2. Les persones o entitats que figuren en l'annex d'aquesta Resolució varen presentar una sol·licitud de subvenció en el marc de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3. Els tècnics de la Direcció General d'Energia i Canvi Climàtic varen examinar les sol·licituds i varen emetre un informe desfavorable sobre les sol·licituds de subvenció descrites en l'annex amb la motivació que figura en aquest annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;4. El 28 de febrer de 2022 es va emetre una proposta de resolució de denegació del director general d'Energia i Canvi Climàtic (BOIB núm.33, de 5 de març de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;5. El 9 de març de 2022 la senyora Francisca Maimó Cabanelles va presentar al·legacions a la proposta de resolució de denegació de l'ajut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;6. L'11 de març de 2022 el senyor Antonio Manuel Medina Pérez va presentar al·legacions a la proposta de resolució de denegació de l'ajut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;7. El 16 de març de 2022 el senyor Pedro Fiol Noguera va presentar al·legacions a la proposta de resolució de denegació de l'ajut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;8. El 21 de març de 2022 el senyor Pedro Barceló Mercadal va presentar al·legacions a la proposta de resolució de denegació de l'ajut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;9. El motiu de denegació de la subvenció dels interessats que varen presentar al·legacions és el mateix:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;“La factura del vehicle no incorpora el descompte obligatori d'almenys 1000&amp;nbsp;€, «Programa Moves III», abans de l'aplicació de l'IVA, per la qual cosa s'incompleixen els apartats 4.2.g).ii. 11.3.1.f).”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;10. En data 25 de març de 2022, un cop valorades les al·legacions presentades&lt;em&gt; ut supra &lt;/em&gt;, s'emet informe tècnic desestimant totes les al·legacions atès que la documentació presentada incompleix els punts 4.2g) i 11.3.1f) de la convocatòria pública de referència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;El punt 4.2.g) de la convocatòria estableix que, &lt;em&gt;«ii. Els vehicles M1 i N1, que s'acullin al programa d'incentius, han de comptar amb un descompte d'almenys 1.000 euros en la factura de venda per part del fabricant/importador o punt de venda del vehicle adquirit, que s'ha de traslladar al beneficiari de l'ajut. »&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;I el punt 11.3.1.f), &lt;em&gt;«En la factura hi ha de constar la matrícula o el número de bastidor, la marca, el model i la versió del vehicle adquirit, i un descompte per part del fabricant/importador o punt de venda d'almenys 1.000 euros per a l'adquisició de vehicles de categories M1 i N1, que haurà de reflectir-se abans de l'aplicació de l'IVA. »&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;11. S'ha esgotat el termini de deu dies hàbils que es concedia per presentar al·legacions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1. El Decret legislatiu&amp;nbsp;2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm.&amp;nbsp;196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2. El Decret&amp;nbsp;75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm.&amp;nbsp;122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3. L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm.&amp;nbsp;72, de 24 de maig de 2008).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;4. El Reial Decret&amp;nbsp;266/2021, de 13 d'abril, pel qual s'aprova la concessió directa d'ajuts a les comunitats autònomes i a les ciutats de Ceuta i Melilla per a l'execució de programes d'incentius lligats a la mobilitat elèctrica (MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu. (BOE núm.&amp;nbsp;89, de 14 d'abril de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;5. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021 per la qual s'aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES&amp;nbsp;III) en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm.&amp;nbsp;88, de 3 de juliol de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1. Denegar la concessió d'una subvenció als beneficiaris que figuren en l'annex, d'acord amb el motiu que figura en l'annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2. Declarar conclòs el procediment i, per tant, arxivar els expedients indicats en l'annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Transició Energètica, Sectors Productius i Memòria Democràtica en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles&amp;nbsp;123 i 124 de la Llei&amp;nbsp;39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article&amp;nbsp;57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació de la resolució, d'acord amb l'article&amp;nbsp;46 de la Llei&amp;nbsp;29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
