![CDATA[Aprovació bases convocatòria borsa tècnics/tècniques superiors Medi Ambient]] CAIB 115792 CAIB 8203 658451 2022-03-08 200 8194 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Expdt. 1255.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mitjançant acord de la Junta de Govern Local del dia 25/02/22, es varen aprovar les bases que han de regir la convocatòria per a la creació d'una borsa de treball de tècnics/tècniques superiors de Medi Ambient, grup A, subgrup A1, de <span style="color:#00000a">l'article 76 del text refós de la Llei de l'estatut bàsic de l'empleat públic, aprovat pel Reial decret legislatiu 5/2015, de 30 d'octubre</span>, pertanyent a l'escala d'administració especial, subescala tècnica, classe superior, mitjançant el sistema de concurs-oposició, per cobrir, interinament o temporalment, les possibles necessitats de provisió urgent de places i llocs de feina que siguin necessaris a l'Ajuntament de Sant Josep de sa Talaia</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A aquest efecte, es publiquen les bases de la convocatòria al BOIB, tot concedint-hi un termini de presentació de sol·licituds de deu dies hàbils, comptats des del dia següent al de la publicació d'aquesta convocatòria en el BOIB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><em><span style="line-height:115%">“Bases que han de regir a la convocatòria per a la constitució d'una borsa de tècnics/iques superiors de Medi Ambient per cobrir interinament o laboralment les possibles necessitats de provisió urgent de places i llocs de feina de l'Ajuntament de Sant Josep de sa Talaia mitjançant el sistema de concurs oposició.</span></em></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">1. Objecte</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Es objecte de la present convocatòria la creació d'una borsa de tècnics/iques superiors de Medi Ambient, grup A, subgrup A1, de <span style="color:#00000a">l'article 76 del text refós de la Llei de l'estatut bàsic de l'empleat públic, aprovat pel Reial decret legislatiu 5/2015, de 30 d'octubre</span>, pertanyent a l'escala d'administració especial, subescala tècnica, classe superior, per cobrir, interinament o laboralment, les possibles necessitats de provisió urgent de places i llocs de feina que siguin necessaris a l'Ajuntament de Sant Josep de sa Talaia.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquesta selecció es regirà pel Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic, en tot el que disposa en referència a l'accés a l'ocupació pública i l'adquisició de la relació de serveis; per les prescripcions contingudes en aquesta convocatòria específica, i pel reglament de funcionament de borsins de personal de l'Ajuntament de Sant Josep de sa Talaia (BOIB 64 de 2016).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">2. Requisits de les persones aspirants</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones aspirants han de complir els requisits següents:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Tenir la nacionalitat espanyola, sense perjudici del que disposa l'article 57 del Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Posseir la capacitat funcional per a l'acompliment de les tasques.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)Tenir 16 anys d'edat complits i no haver arribat a l'edat de jubilació forçosa.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Estar en possessió del títol universitari de graduat/ada o de llicenciat/ada en Biologia o Geografia o Ciències Ambientals &nbsp;o Ciències de la Mar o Enginyeria o titulació equivalent. La titulació s'acreditarà mitjançant l'expedició del títols corresponents per l'autoritat acadèmica competent. En el cas de titulacions obtingudes a l'estranger, s'haurà de tenir la credencial que acrediti la seua homologació.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) <span style="color:#00000a">Estar en possessió d'un certificat de coneixements de llengua catalana corresponent al nivell B2, de conformitat amb el Decret 11/2017, de 24 de març, d'exigència del coneixement de la llengua catalana en els procediments selectius d'accés a la funció pública per ocupar llocs de treball de l'Administració de la Comunitat Autònoma de les Illes Balears. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:#00000a">Els coneixements de llengua catalana s'han d'acreditar mitjançant l'aportació d'un certificat corresponent a un nivell igual o superior al que exigeix el Decret 11/2017, expedit o reconegut com a equivalent o que estigui homologat per la Direcció General de Política Lingüística, o bé expedit per l'Escola Balear d'Administració Pública.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:#00000a">f) Haver satisfet els drets d'examen per accedir a aquesta convocatòria que són de </span>20,00 €<span style="color:#00000a">. El pagament dels drets d'examen es realitzarà exclusivament per Internet, en l'apartat pagament online de tributs (autoliquidacions) de la pàgina web www.santjosep.org dins el termini de presentació de sol·licituds. El pagament dels drets d'examen no suposa en cap cas el tràmit de presentació de la sol·licitud a l'Administració dins el termini establert. No procedirà la devolució de l'import íntegre satisfet en concepte de taxa per drets d'examen, en els supòsits d'exclusió de les proves selectives per causes imputables a les persones interessades. Això no obstant, es procedirà a la devolució de la taxa quan per causes no imputables al subjecte passiu, l'activitat tècnica i/o administrativa que constitueixen el fet imposable de la taxa no es realitzi.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:#00000a">g) </span>No haver estat separades, mitjançant expedient disciplinari, del servei de cap administració pública, o dels òrgans constitucionals o estatutaris de les comunitats autònomes, ni trobar-se inhabilitades de forma absoluta o especial per a ocupacions o càrrecs públics per resolució judicial, per a l'accés al cos o escala de funcionari, en el cas que haguessin estat separades o inhabilitades. En el cas de nacionals d'un altre estat, no trobar-se inhabilitades o en situació equivalent ni haver estat sotmeses a sanció disciplinària o equivalent que impedeixi, en el seu estat i en els mateixos termes, l'accés a una ocupació pública.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">h) Amb caràcter previ a la formalització del contracte o nomenament, la persona interessada ha de manifestar que no desenvolupa cap lloc de treball o activitat&nbsp; en el sector públic dels que delimita la Llei 53/84, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques, i que no percep pensió de jubilació, retir o orfandat. Si realitza alguna activitat privada, inclosa la de caràcter professional, ho haurà de declarar en el termini de deu dies naturals comptats a partir del dia de la formalització del contracte, per tal que la corporació acordi la declaració de compatibilitat i incompatibilitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">i) Estar en possessió del permís de conducció de la classe B en vigor.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:#00000a">Les persones aspirants han de reunir els requisits establerts en aquestes bases a la finalització del termini de presentació de sol·licituds i mantenir-los durant tot el procés selectiu. En aquest sentit, es podran efectuar les comprovacions oportunes durant tot el procés. Si manquessin d'algun dels requisits exigits, quedaran anul·lades totes les seves actuacions, sense perjudici de la responsabilitat en què hagi pogut incorre per falsedat en la seva sol·licitud de participació.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:#00000a">De conformitat amb el que disposa l'article 22.2 del Reial decret legislatiu 1/2013, de 29 de novembre, que aprova el text refós de la Llei general de drets de les persones amb discapacitat, en l'àmbit de l'ocupació, les condicions bàsiques d'accessibilitat i no discriminació a què es refereix el capítol V seran d'aplicació amb caràcter supletori respecte al que preveu la legislació laboral.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:#00000a">3. Presentació de sol·licituds</span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones aspirants que vulguin prendre part en el procés selectiu hauran de presentar la corresponent sol·licitud normalitzada que consta a l'Annex II d'aquestes bases i es presentarà dins el termini de 10 dies hàbils a partir de l'endemà de la publicació de la convocatòria al <em>Butlletí&nbsp; Oficial de les Illes Balears</em> (BOIB) per les següents vies:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1) Amb certificat digital a través de la seu electrònica:&nbsp; </span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">http://santjosep.sedelectronica.es/ catàleg de tràmits / instància general + pujar fitxer (documents escanejats).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2) Sense certificat digital a través de la resta de formes previstes en l'article 16 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La no presentació de sol·licituds en temps determina la inadmissió de la persona aspirant al procés selectiu.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">A més de les dades de caràcter personal i professional que han de constar al model normalitzat de sol·licitud, les persones aspirants hi hauran d'adjuntar la documentació que s'assenyala a continuació:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Fotocòpia del document nacional d'identitat en vigor o, en cas&nbsp; de no posseir nacionalitat espanyola, conforme a l'article 57 del Reial decret legislatiu 5/2015, fotocòpia del document oficial acreditatiu de la personalitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Fotocòpia del títol exigit o certificat acadèmic que acrediti que té cursats i aprovats els estudis necessaris per a l'obtenció del títol corresponent, juntament amb el document que acrediti que ha abonat els drets per a la seva expedició, si n'és el cas.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Fotocòpia del permís de conducció de la classe B en vigor.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Fotocòpia del certificat del nivell de coneixements de llengua catalana exigit a la lletra e) de la base anterior.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Resguard justificatiu d'haver ingressat íntegrament els drets d'examen. D'acord amb el que preveu l'article 15 de la Llei 14/1998, de 23 de desembre, de diverses mesures tributàries i administratives, resten exemptes del pagament de la taxa de drets d'examen les persones amb discapacitat igual o superior al 33%. En aquest cas s'haurà d'acreditar la discapacitat amb el corresponent certificat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones aspirants que superin la fase d'oposició hauran de presentar per a la fase de mèrits:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Model d'autobaremació recollit a l'Annex III, degudament emplenat. Els mèrits es valoraran amb referència a la data de finalització del termini de presentació de les sol·licituds.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g) Documents justificatius dels mèrits al·legats per al concurs ordenats segons el model d'autobaremació emplenat.&nbsp; L'Òrgan de Selecció no valorarà els mèrits que no es recullin al model d'autobaremació. Bastarà amb còpies simples de la documentació, si bé, la inexactitud o falsedat de les dades o documents aportats comportarà l'exigència de les responsabilitats penals, civils o administratives al fet que pertoqués.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Els mèrits al·legats i no justificats per les persones aspirants en la forma indicada en el apartats f) i g) no seran valorats.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Tota la documentació que es presenti en llengua estrangera ha d'anar acompanyada de la corresponent traducció jurada a la llengua catalana&nbsp; o a la castellana.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La persona aspirant, una vegada proposada per a un lloc de feina, haurà de presentar els originals de la documentació exigida a les bases. En el supòsit que les persones aspirants no presentessin la documentació original o del seu examen es deduís que mancaven d'algun dels requisits exigits, quedaran anul·lades totes les seves actuacions, sense perjudici de la responsabilitat en la qual hagin incorregut en la seva sol·licitud de participació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La presentació de la instància implica, als efectes de la Llei orgànica 15/1999, de 13 de desembre, de protecció de dades de caràcter personal, el consentiment de les persones afectades perquè l'Ajuntament de Sant Josep la utilitzi per a la seua gestió, i és obligatòria la seua formalització. Es disposa, en tot cas, dels drets d'accés, rectificació, cancel·lació i oposició en els termes previstos en la legislació vigent i és responsable del fitxer l'Ajuntament de Sant Josep de sa Talaia.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La participació en aquesta convocatòria comporta l'acceptació de les presents bases.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">4. Admissió d'aspirants</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Finalitzat el període de presentació de sol·licituds, l'autoritat convocant o la que en tingui la delegació, ha de dictar resolució per la qual s'aprova la llista provisional de persones admeses i excloses al procés selectiu. Aquesta relació es publicarà al tauler d'anuncis de la pàgina web municipal (www.santjosep.org), amb expressió del document nacional d'identitat de les persones aspirants admeses i excloses i, si escau, de la causa de la no admissió. La corresponent resolució ha d'indicar el lloc, la data i l'hora d'inici del procés selectiu.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Als efectes de l'establert a la present base, s'entenen com a causes d'exclusió no esmenables:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) La realització del pagament de la taxa fora del termini de presentació d'instàncies.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) La presentació de la sol·licitud fora de termini. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)La falta de compliment de qualsevol requisit de participació el darrer dia del termini de presentació d'instàncies.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Qualsevol altre que resulti de la normativa aplicable o del que prevegin les bases específiques de cada convocatòria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Per esmenar el possible defecte, acompanyar els documents que siguin preceptius, o presentar reclamacions, es disposarà d'un termini de 3 dies hàbils, comptadors des de l'endemà de la publicació de la resolució indicada al tauler d'anuncis de la pàgina web municipal. Aquesta esmena no és aplicable als mèrits al·legats però no aportats. Les persones sol·licitants que dins del termini assenyalat no esmenin els defectes justificant el seu dret a ser admeses, seran definitivament excloses del procés selectiu.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Si es presenten reclamacions, seran estimades o desestimades mitjançant la resolució que aprovi la llista definitiva. Si no es presenten reclamacions, es considerarà elevada a definitiva la llista provisional de persones admeses i excloses, i no caldrà tornar-la a publicar.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Els errors de fet poden ser esmenats en qualsevol moment, d'ofici o a petició de la persona interessada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En la llista provisional es publicarà també la designació de les persones membres titulars i suplents que componguin l'Òrgan de Selecció en els termes prevists a la base següent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">5. Òrgan de Selecció</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'Òrgan de Selecció estarà constituït per un/a president/a i 3 vocals i els seus suplents i la secretària de la corporació, o persona en qui delegui, amb veu i vot.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones membres de l'Òrgan de Selecció han de ser funcionaris de carrera i estar en possessió d'una titulació acadèmica de nivell igual o superior al de la categoria de la borsa convocada. La meitat de les persones, com a mínim, de les que són membres de l'Òrgan de Selecció, ha de posseir una titulació corresponent a la mateixa àrea de coneixements que l'exigida a les persones aspirants.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'Òrgan no pot constituir-se ni actuar sense l'assistència de més de la meitat dels seus membres, titulars o suplents indistintament, ni sense president/a ni secretari/a, i les seues decisions s'han d'adoptar per majoria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'Òrgan de Selecció quedarà facultat per interpretar aquestes bases, resoldre els dubtes i incidències que es plantegin i per prendre els acords necessaris per assegurar el correcte desenvolupament de la convocatòria aprovada en tot el no previst en les bases. Abans de la constitució de l'Òrgan s'atribueix a l'Alcaldia la facultat d'interpretar aquestes bases i de resoldre les incidències i recursos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'Òrgan pot disposar la incorporació a les seues tasques d'assessors o especialistes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones membres de l'Òrgan de Selecció han d'abstenir-se d'intervenir, i ho han de notificar a l'autoritat convocant, quan hi concorri alguna de les circumstàncies previstes a l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Així mateix, les persones aspirants poden recusar a les persones membres de l'Òrgan quan es doni alguna de les circumstàncies esmentades al paràgraf anterior, conforme al que preveu l'article 24 de la Llei 40/2015, d'1 d'octubre.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'Òrgan queda classificat, als efectes previstos, segons el Reial decret 462/2002, de 24 de maig, relatiu a indemnitzacions per raó de servei.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">6. Desenvolupament del procés selectiu</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El procediment de selecció és el de concurs oposició, ja que es considera el sistema més adequat atès que permet una millor aplicació dels principis de mèrit i capacitat, així com la valoració de l'experiència laboral, i garanteix a la vegada el principi d'igualtat en la selecció. Les proves de selecció s'inicien amb la fase d'oposició i continuen amb una altra posterior de concurs i entrevista personal. Les puntuació màxima que es podrà obtenir al procés selectiu és de 100 punts.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.1 Fase d'oposició: de caràcter i superació obligatòria, constitueix un 60% de la puntuació total del procés selectiu.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquesta fase consta en la realització d'una prova escrita de caràcter teòric - pràctic (a desenvolupar i/o tipus test), obligatòria i eliminatòria per a totes les persones aspirants, relacionada a les funcions pròpies de la plaça, i en relació amb el programa de temes que figuren a l'annex I de les presents bases. Les preguntes podran plantejar-se en llengua catalana o castellana.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'exercici es valorarà de 0 a 60 punts, i serà necessari obtenir un mínim de 30 punts per superar-lo. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El temps per efectuar aquest exercici serà d'1,5 hores (90 minuts).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Des de l'endemà de la publicació de la llista provisional d'aprovats de la fase d'oposició, les persones aspirants disposen d'un termini de tres dies hàbils, comptadors a partir de l'endemà de la publicació de la llista al tauler d'anuncis de la corporació i al tauler d'anuncis de la pàgina web municipal, per sol·licitar la revisió del seu examen. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Passat aquest termini, l'Òrgan de Selecció publicarà la llista definitiva de les persones aprovades a la fase d'oposició i s'establirà el termini per presentar la documentació relativa a la fase de concurs (model d'autobaremació, Annex III i documents justificatius dels mèrits al·legats). </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.2&nbsp; Concurs de mèrits i entrevista personal: constituirà un 40% de la puntuació total de procés selectiu.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquesta fase únicament serà aplicable a les persones aspirants que superin la fase d'oposició.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.2.1 Concurs de mèrits:&nbsp; Consistirà en la valoració dels mèrits al·legats i acreditats documentalment per les persones aspirants, fins a un màxim de 38 punts, i de conformitat amb l'escala següent:</span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em><span style="line-height:115%">a) Titulacions acadèmiques. Puntuació màxima: 7 punts</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Cursos de formació i perfeccionament impartits per l'Institut Nacional d'Administració Pública (INAP), per l'Escola Balear d'Administració Pública (EBAP –abans Institut Balear d'Administració Pública, IBAP), per la Federació d'Entitats Locals de les Illes Balears (FELIB), per la Universitat, pels col·legis professionals, per l'Administració de l'Estat, autonòmica o local, altres cursos convalidats per l'EBAP, cursos impartits per centres docents homologats, pel Servei d'Ocupació de les Illes Balears (SOIB) i per altres organismes locals, autonòmics o estatals amb competència en matèria de formació ocupacional,&nbsp; amb una duració mínima de 10 hores cadascun. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Els crèdits d'aprofitament suposen els d'assistència, per la qual cosa no seran acumulatius l'assistència i l'aprofitament.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tots els casos es valorarà un sol cop les accions formatives relatives a una mateixa qüestió o a un mateix programa, encara que s'hi hagi participat més d'una vegada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em><span style="line-height:115%">b.1) Cursos específics relacionats amb el perfil de la borsa que es convoca</span></em><span style="line-height:115%">. font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el cas que l'aspirant hagi desenvolupat simultàniament dues o més modalitats professionals anteriors, només se'n computarà una a efecte de valoració, que serà la que atorgui una puntuació més alta.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El temps treballat a una administració pública s'acreditarà amb un certificat de serveis prestats expedit per l'Administració pública corresponent acompanyat d'un certificat de vida laboral emès per la Seguretat Social. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En el cas que els serveis s'haguessin prestat en l'Ajuntament de Sant Josep, el temps treballat es podrà acreditar mitjançant una declaració responsable de la persona aspirant.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El temps treballat en empresa privada o règim d'autònom s'acreditarà amb còpies dels contractes de treball o certificat d'empresa, acompanyats obligatòriament del certificat de vida laboral emès per la Seguretat Social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.2.2 Entrevista personal: Màxim 2 punts.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Una vegada revisats els mèrits presentats per les persones aspirants, el Tribunal Qualificador convocarà les persones aspirants per al desenvolupament d'una entrevista personal de caràcter curricular, destinada a concretar i aclarir aspectes relacionats amb els mèrits declarats, amb la finalitat de valorar la major adequació del perfil professional acreditat per les persones aspirants a les funcions a desenvolupar.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Per a l'atorgament de la puntuació es tindrà en compte la major o menor similitud de les funcions que acrediti haver desenvolupat la persona aspirant, en relació amb les que corresponen al lloc de feina convocat, així com el grau d'autonomia en l'acompliment o altres dades objectives sobre la experiència acreditada, que serveixin per a valorar l'adequació de la persona aspirant a les funcions del lloc de feina convocat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tot cas, el tribunal haurà de deixar constància d'aquesta entrevista mitjançant l'acta en la què s'expressin els punts assignats, a més dels criteris i motius de la puntuació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En cap cas l'entrevista tindrà caràcter eliminatori, encara que la no compareixença per part de l'aspirant s'entendrà com una renúncia a seguir en el procés.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">7. Publicació de les valoracions</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Conclosa la valoració del procés selectiu, l'Òrgan de Selecció ha de fer públic al tauler d'anuncis de l'Ajuntament i al tauler d'anuncis de la pàgina web municipal una llista provisional de les puntuacions obtingudes per les persones aspirants amb indicació del número del document nacional d'identitat, tenint en compte que la puntuació obtinguda a la fase d'oposició representarà un 60% de la puntuació assolible al procés selectiu i la fase de concurs i entrevista representa un 40% del total de la puntuació assolible al procés selectiu. Hi figurarà la puntuació obtinguda a la fase d'oposició, a la fase de concurs, la puntuació obtinguda a l'entrevista personal i el resultat de la suma de les puntuacions. Aquesta s'ha de publicar per ordre de major a menor puntuació total. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Ordre de prelació. En cas d'empat, s'ha de resoldre tenint en compte, successivament, els criteris establerts a l'article 4.4 del Reglament de funcionament de borsins de personal de l'Ajuntament de Sant Josep de sa Talaia (BOIB 64 de 2016).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les persones aspirants disposen d'un termini de tres dies hàbils, comptadors a partir de l'endemà de la publicació de la llista al tauler d' anuncis municipal i al de la pàgina web, per al·legar les rectificacions pertinents sobre la valoració provisional del procés selectiu. En cas contrari, s'entendrà elevada a definitiva. L'Òrgan de Selecció ha d'elevar la llista definitiva a la Presidència de la corporació per a la constitució mitjançant decret de la borsa de treball.
