&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 8 de febrer&amp;nbsp;de 2022, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;“Resolució d'acceptació en part d'al·legacions de revocació parcial&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar e&lt;/em&gt;&lt;/span&gt;&lt;em&gt;n data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016 (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2.Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ALMENDRAS Y FRUTOS SECOS BONANY, SL, entre d'altres,&amp;nbsp;que figuren en l'annex de la Resolució de concessió, R53 de data 16 de desembre de 2019, (BOIB núm. 8, de 18 de gener de 2020)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;amb les dades i els imports corresponents&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(amb una inversió aprovada de 751.846,90 €).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades,la persona interessada presenta la sol·licitud de pagament com també la documentació exigida, però, una vegada examinada aquesta sol·licitud de pagament, es comprova els punts següents:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factures número V 1900291 i V 2000003 del proveïdor Melchor Mascaró s'han presentat per una obra de la ´línia d'Inversions en transformació i comercialització del Programa de Desenvolupament Rural, no subvencionables per la línia d'Inversions a les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Instal·lacions Es Pla SLU, número A17/48, totes les actuacions són anteriors a la data d'inspecció inicial de 8 de febrer de 2017, segons el punt 3, paràgraf segon, de l'apartat quart, en el cas d'obra civil i instal·lacions fixes només se subvencionaran les inversions realitzades després de la sol·licitud i de la visita prèvia d'inspecció per part de l'òrgan competent, in situ, que acrediti que les inversions no estaven iniciades.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Instal·lacions Es Pla SLU, número A17/69, totes les actuacions són anteriors a la data d'inspecció inicial de 8 de febrer de 2017, segons el punt 3, paràgraf segon, de l'apartat quart, en el cas d'obra civil i instal·lacions fixes nom´és se subvencionaran les inversions realitzades després de la sol·licitud i de la visita prèvia d'inspecció per part de l'òrgan competent, in situ, que acrediti que les inversions no estaven iniciades i a més, estan realitzades dins el terme de Llubí, quan les inversions de l'expedient INEA2017_1/025 són a Petra i Inca.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Factura del proveïdor Instal·lacions Es Pla SLU, número A17/70, part de les actuacions són anteriors a la data d'inspecció inicial de 8 de febrer de 2017, segons el punt 3, paràgraf segon, de l'apartat quart, en el cas d'obra civil i instal·lacions fixes sols se subvencionaran les inversions realitzades després de la sol·licitud i de la visita prèvia d'inspecció per part de l'òrgan competent, in situ, que acrediti que les inversions no estaven iniciades i, segons el punt 7.l de l'apartat quart, totes aquelles que no tenguin la condició de despesa elegible conforme a la normativa vigent, per tant, el gasoil no és subvencionable. Aquesta factura només té un import elegible de 2.560,46 euros.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Instal·lacions Es Pla SLU, número A17/126, les actuacions estan realitzades dins el terme de Llubí, les inversions de l'expedient INEA2017_1/025 són a Petra i Inca.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Instal·lacions Es Pla SLU, número A17/214, part de les actuacions no són elegibles, segons el punt 2.b de l'apartat quart, la compra o arrendament amb opció de compra de nova maquinària i equipament fins al valor de mercat del producte, el lloguer màquina per soldar i reparacions. Aquesta factura només té un import elegible de 1.914,66 euros .&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Projecció Tècnica d'Inversions número 105/2017, de 4 de setembre de 2017, en la descripció posa certificat final d'obra i despeses de visat, quan el certificat de final d'obra és d'1 de setembre de 2018 que correspon a l'expedient INEA2015_2/084.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Projecció Tècnica d'Inversions número 106/2017, de 4 de setembre de 2017, en la descripció posa gestions realitzades per tràmit cèdula habitabilitat, quan el certificat de final d'obra és d'1 de setembre de 2018 que correspon a l'expedient INEA2015_2/084.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;- Factura del proveïdor Projecció Tècnica d'Inversions número 107/2017, de 5 de setembre de 2017, en la descripció posa gestions realitzades al seu favor per l'obtenció de la llicència d'obra de nau de 1.000 m2 que correspon a l'expedient INEA2015_2/084. La inversió de l'expedient INEA2017_1/025 és una ampliació del magatzem agrícola.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Factura del proveïdor Miquel Fiol Moragues, número 46/2017, en la descripció posa treballs tècnics en registre i inscripcions: informe contravaloració Hisenda compra-venda finques Llubí, no elegible, l'expedient INEA2017_1/025 les actuacions són a Petra i Inca; documentació tècnica i registre PRODUCCIÓ INTEGRADA, no es elegible no figura dins el punt 2 de l'apartat quart. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Aquesta factura només té un import elegible de 700,00 euros.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- En la relació de justificants imputats, en què figuren les factures presentades amb la sol·licitud de pagament, dins el capítol de les inversions d'instal·lacions hi figuren factures que l'import subvencionable (sense IVA) (*) s'ha d'indicar únicament l'import d'inversió que sol·licita com a subvencionable, l'import posat és de 0,00 euros. Les factures 1022017, 1032017, 1192018, 17 21, 17 169, 17 136, 17-23/927, A016603, A018903, A019000, A019259, A019518, A/170065, F00149, 38/17, 39/17, 40/17 i 17472 no són elegibles.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;Les factures o part de les factures abans esmentades incompleixen les actuacions exigides per ser una actuació subvencionable, d'acord amb el que estableixen els punts 2, 3 i 7 de l'apartat quart de la resolució esmentada. Per una banda, algunes factures no s'ha fet la inversió en els termes de Petra i Inca (terme on s'havia concedit l'ajuda), i per altra, hi ha factures que també les han presentades amb la sol·licitud d'altres línies d'ajuda per la mateixa inversió, o bé, amb d'altres convocatòries de la línia d'inversions a les explotacions agrícoles.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. El 6 de setembre de 2021 es publica al web del FOGAIBA notificació de deficiències i es requereix al beneficiari perquè en el termini de 10 dies hàbils presenti la documentació que falta. En data 20 de setembre de 2021, amb número de registre GOIBE428937/2021 aporta tota la documentació requerida.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. &lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) De les factures V19000291 i V2000003, del Melchor Mascaró, que una part de la nau es destina a emmagatzemament d'ametlla, la porció de la nau és d'un 43% de la superfície. Demana la porció.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) De les factures A17/48, A17/69, A17/70 i A17/126, d'Instal·lacions Es Pla SLU, aporta una explicació del representant de l'empresa en què explica que les dates i dades que hi figuren són errors a l'hora d'introduir-les, i que varen fer amb posterioritat a la data d'inspecció prèvia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c) La relació de factures que figuren en la relació de justificants amb un import 0,00 com a subvencionable, ho varen posar així per indicació del tècnic de l'agència comarcal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d) Dels altres punts que figuren en l'informe/proposta provisional de resolució de revocació parcial de de 10 de novembre de 2021, no fan cap al·legació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10. Respecte a la lletra a) no se admeten les al·legacions fetes a les factures &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;V19000291 i V2000003&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;del proveïdor Melchor Mascaró, ja que aquestes factures s'han presentat amb la sol·licitud d'ajuda de la línia d'Inversions en Transformació i Comercialització de la línia &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;del Programa de Desenvolupament Rural&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;concedida en el BOIB número 153, de 5 de setembre de 2020, expedient ITC2019_1/006, i per tant, no es poden present&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;r amb una altre sol·licitud d'ajuda. A&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;més, d'acord amb la sol·licitud de pagament de la línia d'ajudes d'Inversions a les explotacions agràries (INEA2017_1/025), presentada el 22 de febrer de 2021, número de registre L95E6749, el beneficiari, declara en el punt 7, «que &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;NO té sol·licitades i/o concedies altres ajudes i/o subvencions relacionades amb aquesta inversió. En el cas afirmatiu, especificar l'entitat a qui s'ha sol·licitat i quantia». Per tant, que no són factures auxiliables ja que el punt catorzè de la resolució de la convocatòria d'Inversions a les explotacions agràries estableix que les ajudes objecte d'aquesta convocatòria són incompatibles amb les ajudes que per a les mateixes actuacions concretes pugui rebre el beneficiari de qualsevol administració pública o d'una altra entitat pública o privada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;11. Respecte a la lletra b) no se admeten les al·legacions fetes a les factures A17/48, A17/69 i A17/70 d'Instal·lacions Es Pla, SLU, en què figuraven dades errònies, ja que no aporten les factures rectificatives corresponents que estableix el punt 15 del Reial Decret 1619/2012, de 30 de novembre, pel que s'aprova el Reglament pel qual es regulen les obligacions de facturació, específica quan han de ser emeses.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;12. Respecte a la lletra c) no se admeten les al·legacions a les factures 1022017, 1032017, 1192018, 17 21, 17 169, 17 136, 17-23/927, A016603, A018903, A019000, A019259, A019518, A/170065, F00149, 38/17, 39/17, 40/17 i 17472 que en la relació de justificants imputats l'import posat és de 0,00 euros. Telefònicament, des dels Serveis Centrals, es varen posar en contacte amb el representat de l'entitat beneficiària, que es va personar a les dependències i oralment se'l va informa que podia corregir la relació de justificants imputats i incloure els imports de totes les factures presentades amb la sol·licitud de pagament, perquè aquestes factures podien ser elegibles. Però el beneficiari no ha presentat la correcció de la relació de justificants imputats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;13. Respecte a la lletra d) s'admeten les al·legacions de la factura A17/126 d'Instal·lacions Es Pla, SLU, que corresponen al terme d'Inca. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Revocar parcialment la resolució d'ajuda concedida al beneficiari per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença amb ALMENDRAS Y FRUTOS SECOS BONANY, SL&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; i acaba amb &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ALMENDRAS Y FRUTOS SECOS BONANY, SL, que suma un import total de 53.236,60€, relativa a la línia d'ajuda “Inversions en les explotacions agràries”, ja que l'import elegible de la despesa és inferior a l'aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
