    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l'apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28&amp;nbsp;de gener&amp;nbsp;de 2021, per la qual es convoquen ajudes destinades al pagament compensatori en zones de muntanya per a l'any 2021, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresident&amp;nbsp;&amp;nbsp;en Matèria Agrària&amp;nbsp;del FOGAIBA&amp;nbsp;en data 16&lt;/span&gt;&amp;nbsp;&lt;span style="color:#212121"&gt;de febrer&amp;nbsp;de 2022, va signar la següent resolució:&lt;/span&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Fets&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;En data de 30 de gener de 2021 es va publicar, en el BOIB núm. 13, la Resolució de la Presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28 de gener de 2021, per la qual s'aprova la convocatòria per a l'any 2021 de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. De conformitat amb l'apartat sisè de l'esmentada Resolució, i l'Ordre APA 407/2021, de 25 d'abril, per la que es modifiquen , per a l'any 2021, diversos terminis establerts en el Reial Decret 1075/2014, de 19 de desembre, dictat per l'aplicació a Espanya de la Política Agrícola Comú, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/6/2021. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. El Sr. JOAN MARC FIOL SASTRE, amb DNI ***0532**, en data 31/5/2021 &amp;nbsp;registra d'entrada la sol.licitud única, GOIBE214801/2021, a la qual se li assigna el número de expedient 04005430, incloent l'ajuda al pagament compensatori en zones de muntanya. De l'examen de la documentació aportada, el titular compleix amb els requisits per ser beneficiari de l'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;5. El 25/6/2021 des del Servei d'Ajudes Directes de la PAC s'envia una notificació sobre els controls preliminars de les duplicitats dels recintes al Sr. JOAN MARC FIOL SASTRE, amb DNI ***&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;0532**. El 21/10/21 el Sr. Fiol Sastre fa una al.legació a la sol.licitud única en resposta a aquesta notificació, número de registre d'entrada 498052/21.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;6. &lt;p&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;La superfície penalitzable resultant de les duplicitats és de 8,57 has, la superfície determinada resultant dels controls preliminars és de 9,51 has. Aquestes dades suposen una sobredeclaració del 90,12%.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;7. &amp;nbsp;Atés l'article 19.2. del Reglament Delegat (UE) 640/2014 de la Comissió de 11 de març de 2014, si la superfície declarada als efectes dels règims d'ajuda &amp;nbsp;o mesures d'ajuda per superfície sobrepassa la superfície determinada en un 50% no es concedirà cap ajuda per superfície per al grup de cultiu en qüestió. A més a més, el beneficiari estarà subjecte a una sanció addicional igual a l'import de l'ajuda corresponent a la diferència entre la superfície declarada i la superfície determinada atès l'article 18. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
