font-size:12px"><span style="line-height:114%">L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a<strong>&nbsp;</strong>les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; En el Pla Empresarial que adjunta manifesta que és titular d'explotació agrària i que es dedicarà a l'agricultura ecològica.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>3. El 19 de setembre de 2019, el vicepresident del FOGAIBA va dictar la Resolució de concessió d'ajudes per a les inversions a les explotacions agràries (R22), publicada en el BOIB núm. 148, de 31 d'octubre de 2019, en la qual s'inclou una concessió a favor de TERRA DE FALANIS SL, amb NIF B57262727, amb un import d'ajuda de 3.047,85 €, amb núm. d'expedient INEA2017_1/279.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>4. L'expedient esmentat ha estat objecte d'una revisió sistemàtica per part d'un superior, d'acord amb el que estableix l'article 3.2 de la Circular de Coordinació 18/2019, per la campanya 2017_1, s'ha detectat que en la concessió es varen produir els errors següents:</em></span></span></em></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>a) Es varen concedir 3.047,85 corresponents a un percentatge d'ajuda del 39% corresponent al 65% de la que correspondria a un agricultor professional segons l'apartat 3.1 del punt cinquè, intensitat i límit de les subvencions, de la convocatòria, amb els increments i màxims corresponents. Aquests increments van ser en concepte prima base un 40, productor d'agricultura ecològica un 5, beneficiaris, titulars d'explotació, que el municipi titular de la qual sigui zona desfavorida un 10 i joves agricultors o que s'hagin establert en els cinc anys</em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>&nbsp;anteriors a la sol·licitud d'ajuda un 10 i amb un màxim desprès de computar els diferents complements del 60%. El complement d'un 10 per joves agricultors o que s'hagin establert </em></span></span></em><em><span style="background-color:#ffffff"><span style="color:#000000"><em>en els cinc anys&nbsp;anteriors a la sol·licitud d'ajuda no li correspon, per tant li pertoca un percentatge d'ajuda del 35,75%, amb un import d'ajuda de 2.793,86€. </em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>5.L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>7. El 30 d'agost de 2021 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació parcial de 25 d'agost de 2021 atès que no li correspon l'increment per joves agricultors o que s'hagin establert en els cinc anys&nbsp;anteriors a la sol·licitud d'ajuda, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorregut els 10 dies hàbils, la persona interessada no ha presentant cap al·legació.</em></span></span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>8.
