Javier González Granado el 28 de març de 2019, que es promouen pel Sr. VICENTE TUR MAYANS amb la finalitat de: </span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El present estudi detall es redacta en compliment del previst en l'Article 8 i 79 del Text Refós de les Normes Subsidiàries de Formentera publicades en el BOIB núm.122 de 03-09-2013, així com l'establert per l'art. 91 de la vigent Llei del Sòl (RDL 2/2008) i l'art. 65 i concordants del RPU (RD 2159/1978), per fixar amb precisió els límits de la Unitat d'Actuació i de les alineacions i límits de qualificació, així com per modificar l'ordenació establerta per les NNSS quant al volum màxim de cada edifici, segons recull el punt 2 de l'art. 79 de les NNSS, respectant les altres disposicions establertes pel Planejament.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La forma triangular de la parcel·la resultant i el seu tamany ajustat justifica la modificació de la volumetria proposada, que a pretén una millora de la qualitat arquitectònica i urbanística, i l'optimització dels recursos constructius afavorint una major eficiència, sostenibilitat i respecte mediambiental.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tot això, sense un increment de l'edificabilitat, ni de l'altura màxima, ni de la superfície i volums totals edificables, ni un increment de densitat de població ni l'alteració dels usos previstos ni de la tipologia edificatòria, i respectant la resta de determinacions del planejament. Ni tampoc que aquestes modificacions volumètriques suposin un impacte negatiu en la trama urbana, ni ocasionin perjudici ni alterin les condicions d'ordenació dels terrenys propers o adjacents, ni modifiquin les distàncies de separació entre edificis ja veïns, ni redueixin la superfície d'espais lliures públics o l'amplària de vials.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.2<strong> </strong>MEMÒRIA DESCRIPTIVA</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.2.1<strong> </strong>ÀMBIT DE L'ACTUACIÓ.</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La zona objecte de l'estudi de detall es correspon una part de la parcel·la amb referència cadastral nº nº 07024A009004950000PR, amb dates registrals: Llibre 40, foli 61 i llibre 122, foli 150, finca 3665.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La superfície total de l'àmbit segons el planejament és de 1.770 m2, que corresponen a una part de la parcel·la esmentada.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'àmbit de l'actuació limita al Nord amb la part de la finca nº 3665 qualificada com a sol rústic o es situa la finca Can Vicent Damià i no afectada per la UA-SFR07, al Sud amb la part de la finca nº 3665 qualificada com sol urbà i no afectada per la UA-SFR07, a l'Est pel carrer Guillem de Montgrí i rotonda que forma part de la variant Sant Ferran Nord i a l'Oest per camí i variant Sant Ferran Nord.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'àmbit té una forma irregular aproximadament trapezoidal.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No conté edificacions ni està afectar per infraestructures visibles</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El planejament general vigent en el terme municipal ho conformen el Pla Territorial Insular d'Eivissa i Formentera de 21 de març de 2005, la Llei 2/2014 de 25 de març d'Ordenació i Ús del Sòl de les Illes Balears, i el Text Refós de les Normes Subsidiàries (NNSS) de planejament del municipi de Formentera publicades en el BOIB núm.122 de 03 de setembre de 2013.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les parcel·les estan qualificades com a sòl urbà extensiva unifamiliar (EU-SFR) regulada en l'article 120 de les NNSS, i en el punt 4 de l'annex I del Nucli de Sant Ferran d'aquestes Normes, amb el següent quadre annexo de resum de paràmetres urbanístics:</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es arquitecte redactor del present Estudi de Detall, Sr. David Tent Alvarez, col·legiat nº 950330 al Col·legi Oficial d'Arquitectes de les Illes Balears i amb despatx professional a l'avinguda L'Alcúdia nº39 baix esq. de Benissa, 03720 Alacant. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.2.3.3.<strong> </strong>ESTRUCTURA DE PROPIETAT</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els terrenys de la UA SFR-07 tenen com a únic propietari al Sr. Vicente Tur Mayans, segons els títols d'herència, declaració d'obra nova i extinció d'usdefruits vigents en el Registre de la Propietat d'Eivissa nº4. Correspon a la finca amb referència cadastral nº 07024A009004950000PR, amb dates registrals: Llibre 40, foli 61 i llibre 122, foli 150, finca 3665, que es veu parcialment afectada per la UA SFR-07.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 13 de setembre de 2012 es va signar conveni de cessió anticipada de terrenys per a la construcció de la Variant de Sant Ferran Oest, cedint-se anticipadament 699,53 m² de superfície destinats a la construcció per execució directa dels sistemes generals de viari i aparcament.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquests terrenys estan gravats per les servituds de pas, que es citen en la inscripció 2ª i resulten de la1ª. Tal i com es reflexa en el conveni de cessió anticipada, els titulars del drets reials de les servituds esmentades no veuran eliminats el gaudir del seu dret de pas donat que la cessió a favor del Consell Insular de part de terreny de les finques servents es el que s'ha destinat a la construcció de SSGG viari i aparcaments. En tot cas, la carrega romandrà a la finca matriu.</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.3<strong> </strong>MEMÒRIA JUSTIFICATIVA</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.3.1<strong> </strong>JUSTIFICACIÓ DE SOL·LUCIÓ ADOPTADA</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Estudi de Detall és l'instrument mitjançant el qual és possible establir alineacions i rasants completant, adaptant o reajustant les fixades pel Planejament i Normes, Generals i Derivades, així com ordenar els volums i completar la xarxa de comunicacions d'acord a les especificacions d'aquests.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest cas, s'ajusten les alineacions i els límits de qualificació de la realitat existent mitjançant l'alçament topogràfic i es modifica la volumetria segons s'estableix en els articles 8 i 79 de les NNSS amb les justificacions següents:</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La UA-SFR07 afecta parcialment a la finca registral 3665, partint la zona qualificada con a EU-SFR en 2 subzones: la primera que queda fora de la UA-SFR07 i que té una superfície segons mesurament topogràfic recent de 382,52 m2 i per lo tant, per baix de la superfície de parcel·la mínima i la segona que està afectada per la UA-SFR07 i que te una superfície neta segons mesurament recent de 589,70 m2.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La parcel·la resultant qualificada com a EU-SFR i anomenada com a parcel·la 1,<span style="color:#ff0000"> </span>té una superfície total de 972,22 m2.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aplicació de la normativa vigent, per a esgotar l'edificabilitat, seria necessari distribuir els 5 habitatges permesos en 3 edificacions aïllades separades entre si per una distància mínima de 6 metres.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La geometria i grandària de la zona delimitada com EU-SFR (extensiva unifamiliar), combinat amb la resta de paràmetres d'ordenació de l'edificació constrenyen fortament les possibilitats de disseny, dificultant una bona implantació dels edificis i generant espais residuals entorn d'aquests.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per harmonitzar els aspectes ressenyats és necessari modificar, l'ocupació màxima i volum màxim per edifici.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es proposa una volumetria que manté la tipologia aïllada en edificis de grandària controlada, però que permet una agrupació de 2 unitats residencials unifamiliars i un altra de 3 unitats residencials unifamiliars. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El conjunt resultant, de 2 edificis en lloc dels 3 necessaris per esgotar l'edificabilitat d'acord a la normativa vigent, evita l'excessiva fragmentació tant de l'edificació com de l'espai lliure privat i la pròpia dificultat tècnica d'encaixar els edificis en el solar respectant les separacions mínimes entre ells, afavorint la funcionalitat i eficiència del conjunt. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A més d'açò, donat que el terreny natural d'implantació de l'edificació està aproximadament 1,2 metres per davall de la cota d'accés des del carrer Guillem Montgrí i, per tal de minimitzar l'impacte visual de les edificacions, es proposa augmentar la superfície d'ocupació fins al 40% en cada planta, de manera que es pugui reduir la superfície construïda en planta pis, augmentant en compensació la superfície construïda en planta baixa alta, sense augmentar la edificabilitat màxima que marca el planejament. Això es fa sota les premisses de qualitat arquitectònica, sostenibilitat i integració en l'entorn exposades, permetent emprar tipologies edificatòries amb més espais lliures i formes amb menys impacte visual, més compactes i amb millor comportament energètic, que produeix l'optimització dels recursos constructius, alhora que millorem la privadesa i el confort evitant interferències visuals i afavorint el assolellament i la ventilació.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.3.2<strong> </strong>JUSTIFICACIÓ DE TRAMITACIÓ SEGONS MARC LEGAL </strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La figura de l'estudi de detall està prevista en la legislació general a l'apartat 2 de l'article 40 del Reial decret 1346/1976, de 9 d'abril, pel qual s'aprova el text refós de la Llei sobre Règim del sòl i Ordenació urbana i en l'article 66 del Reial decret 2159/1978, de 23 de juny, pel qual s'aprova el Reglament de planejament per al desenvolupament i aplicació de la Llei sobre règim del sòl i Ordenació urbana.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'acord a l'article 66 esmentat s'aporta la documentació prevista i s'incorpora la present memòria justificant les solucions adoptades.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La present definició de límits i alineacions, i reordenació de volums per donar compliment als objectius i per les motivacions exposades en aquest document suposa un increment del volum màxim per edifici i l'ocupació màxima.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De les necessitats de l'edifici que agrupa a 3 unitats residencials, per ser el de majors dificultats i d'aquesta s'extreuen els límits màxims de l'àmbit per al volum per edifici (1.200m³), per a l'ocupació màxima en PB i P1 (40%). </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A continuació s'aporta un quadre comparatiu de cadascun dels paràmetres urbanístics entre les NNSS i l'Estudi de Detall.</span></span></p>
