Naturalesa jurídica i règim aplicable</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Les ajudes que es concedeixin tindran el caràcter de subvenció i es regiran per la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS- i el seu reglament de desenvolupament, bases d'execució del pressupost 2022 i document annex, les presents bases, conveni regulador en aquells casos que es consideri i l'acord especifico de concessió.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Les ajudes directes que es concediran directa i nominativament, exclusivament, als beneficiaris relacionats en l'annex de les Bases del Pressupost Municipal i en la base 1 de la present convocatòria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Les ajudes rebudes són compatibles amb la percepció d'altres ajudes procedents de qualsevol altra administració o entre públic o privat, sempre que el seu import se de tal quantitat que aïlladament o en concurrència amb altres subvencions no superi el total de l'activitat subvencionada, d'acord amb el que es preveu en l'article 19.3 de la Llei 38/2003, de 17 de novembre, General de Subvencions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 3. Crèdit pressupostari</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les subvencions previstes en la present convocatòria estan consignades en el pressupost municipal de l'any 2022 per un import total de 195.200,00 euros, amb càrrec a les següents aplicacions:</span></p> <ul> <li>2.000 € a l'aplicació 1720 48900 per a gestió integral de l'aigua</li> <li>37.500 € a l'aplicació 2310 48900 per a assistència social</li> <li>36.500 € a l'aplicació 3260 48900 per a Educació, Apimas i Beques</li> <li>2.400 € a l'aplicació 3321 48900 manteniment Biblioteca</li> <li>10.000 € a l'aplicació 3340 48900 Promoció Cultural, Colles Ball</li> <li>25.000 € a l'aplicació 3380 48900 Comissions de Festes</li> <li>50.600 € a l'aplicació 3410 48900 Esports</li> <li>18.000 € a l'aplicació 4120 48900 Agricultura, ramaderia, pesca</li> <li>6.000 € a l'aplicació 4312 48900 Mercat ambulant</li> <li>600 € a l'aplicació 4310 48900 manteniment Baños</li> <li>6.600 € a l'aplicació 4320 48900 Oficina d'Informació i Turisme</li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En qualsevol cas, la concessió de les subvencions queda condicionada a l'existència de crèdit adequat i suficient en el moment de resolució de la concessió, conforme a l'article 56.2 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, General de Subvencions -RLGS-.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 4. Quantia de les ajudes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'ajuda econòmica ascendirà com a màxim a l'import que figura en l'annex de les Bases d'Execució del pressupost municipal de l'any 2022 i en les presents Bases.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 5.- Destinataris</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Podran sol·licitar les ajudes previstes en aquesta convocatòria les persones físiques, jurídiques, Comissions, Confraries etc. previstes en la Base primera de la convocatòria i per a la subvenció directa i per l'import màxim que figura en aquesta base, en el termini màxim de tres mesos a comptar del de la data d'inserció de les presents Bases en el tauler d'anuncis i en la Seu electrònica de l'Ajuntament de Sant Joan de Labritja.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds hauran d'anar acompanyades de tots els documents previstos en la Base 6.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la sol·licitud es presentés fos de termini no seran tingudes en compte en el present exercici, perdent el dret a la seva recepció.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si a la sol·licitud li faltés algun dels documents relacionats en la base primera o es presentessin incomplets, seran requerits per a l'esmena dels mateixos en un termini màxim de 15 dies. En cas que no s'emplenés correctament el requeriment referit, les sol·licituds no seran tingudes en compte donant lloc a la pèrdua del dret a la percepció de la subvenció prevista en aquesta convocatòria per al beneficiari.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El beneficiari no ha d'estar culpable en alguna de les prohibicions establertes en l'article 13 de la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS-.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 6. Sol·licituds i documentació</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els beneficiaris de subvenció prevists en la base 1 d'aquesta convocatòria podran sol·licitar ajuda econòmica per l'import previst en aquesta, per a foment de les activitats que duguin a terme els beneficiaris dins dels fins previstos en aquestes bases i que tradicionalment es ve subvencionant en exercicis anteriors, havent d'emplenar necessàriament per a la seva tramitació i concessió els annexos I, II, III, IV, V, VI i VII.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.- Annex I.</strong> Model de sol·licitud previst en l'Annex I de les presents Bases que serà emplenada i signada pel beneficiari o el seu legal representant, acompanyat de fotocòpia del DNI de l'interessat o representant del sol·licitant de la subvenció. Si es tracta d'Associació legalment constituïda s'acompanyarà de còpia dels Estatuts i CIF de la Societat.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.- Annex II.</strong> Declaració responsable del representant legal o persona autoritzada de no estar culpable en cap de les prohibicions de l'article 13 de la llei 38/2003, de 17 de novembre, general de subvencions.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.- Annex III</strong>. Memòria d'activitats.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.- Annex IV.</strong> Sol·licitud de transferència bancària per a pagaments.&nbsp;</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.- Annex V.</strong> Declaració responsable de no haver estat sancionat per incompliment de la llei d'igualtat d'home i dones.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.- Annex VI.</strong> Declaració responsable de no ser deutor per una resolució de reintegrament de subvencions.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.- Annex VII. </strong>Autorització per a la consulta de dades AEAT, Administració Tributària Balear i Tresoreria General de la Seguretat Social.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.- Annex VIII.</strong> Declaració responsable sobre la realització del projecte subvencionat i del seu pressupost.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 8. Termini i lloc de presentació de les sol·licituds.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <strong>El termini de presentació de sol·licituds serà de tres mesos</strong> a comptar de l'endemà al de la publicació de les presents Bases en el Tauler d'anuncis i en la Seu electrònica de l'Ajuntament de Sant Joan de Labritja.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Les sol·licituds juntament amb la restant documentació que s'indica en la base anterior, hauran de presentar-se en el Registre General de l'Ajuntament de Sant Joan de Labritja, sense perjudici del que s'estableix en l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques -LPACAP- acompanyada de tota la documentació prevista en la Base 6.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La presentació de sol·licituds a aquesta convocatòria implica l'acceptació de les seves bases.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 9. Procediment i resolució.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tant l'article 22 de la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS- com els articles 7 i 8 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de Subvencions, disposen que el procediment ordinari de concessió de subvencions es tramitarà en règim de concurrència competitiva. A l'efecte d'aquesta llei, tindrà la consideració de concurrència competitiva el procediment mitjançant el qual la concessió de les subvencions es realitza mitjançant la comparació de les sol·licituds presentades, a fi d'establir una prelació entre les mateixes d'acord amb els criteris de valoració prèviament fixats en les bases reguladores i en la convocatòria, i adjudicar, amb el límit fixat en la convocatòria dins del crèdit disponible, aquelles que hagin obtingut major valoració en aplicació dels citats criteris.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstant això, podran concedir-se de manera directa les següents subvencions:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Les previstes nominativament en els Pressupostos Generals de les Entitats Locals, en els termes recollits en els convenis i en la normativa reguladora d'aquestes subvencions.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A l'efecte del que s'estableix en el paràgraf anterior, s'entén per subvenció prevista nominativament en els Pressupostos Generals de l'aquella en què almenys la seva dotació pressupostària i beneficiari apareguin determinats en els estats de despesa del Pressupost. L'objecte d'aquestes subvencions haurà de quedar determinat expressament en el corresponent conveni de col·laboració o resolució de concessió que, en tot cas, haurà de ser congruent amb la classificació funcional i econòmica del corresponent crèdit pressupostari.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Aquelles l'atorgament o la quantia de la qual vingui imposat a l'Administració per una norma de rang legal, que seguiran el procediment de concessió que els resulti d'aplicació d'acord amb la seva pròpia normativa.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Amb caràcter excepcional, aquelles altres subvencions en què s'acreditin raons d'interès públic, social, econòmic o humanitari, o altres degudament justificades que dificultin la seva convocatòria pública.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procediment per a dur a terme l'atorgament de la concessió directa de les subvencions previstes en aquestes bases és el següent:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A.- Una vegada que es formuli la sol·licitud s'emetrà informe d'Intervenció sobre l'existència de consignació pressupostària per a l'atorgament de la corresponent subvenció nominativa, s'emetrà informe-proposta en relació amb l'atorgament de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">B.- Per acord de Junta de Govern Local s'atorgarà la subvenció, de conformitat amb el que s'estableix en aquestes bases o conveni que se subscrigui si escau, quant a termini i forma de justificació.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">C.- Es notificarà l'acord de concessió als interessats, segons el que s'estableix en l'article 40 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Publiques, ajustant-se la pràctica d'aquesta notificació a les disposicions contingudes en l'article 41 de la precitada norma.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- Les sol·licituds presentades seran resoltes per la Junta de Govern Local, així com la necessitat o no de subscriure conveni regulador individualitzat per a cadascuna d'elles.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La secretaria i la intervenció revisaran les sol·licituds presentades i comprovaran que reuneixen els requisits assenyalats en les bases de la convocatòria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- S'emetrà informe d'Intervenció sobre l'existència de consignació pressupostària per a l'atorgament de la corresponent subvenció nominada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- A proposta de la Regidoria de Cultura s'elaborarà llista provisional d'admesos i ajudes que se'ls assignen, així com dels exclosos i les seves causes proposant la seva aprovació a la Junta de Govern Local.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La Junta de Govern Local acordarà aprovar provisionalment la llista anterior amb especificació de la causa d'exclusió, en cas de no reunir els requisits previstos en la llei, pressupost municipal de 2022 o en aquestes Bases, que serà notificada als interessats, concedint-los un termini d'esmena de 15 dies, si escau, conforme a l'article 68 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques -LPACAP-.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- Rebudes i analitzades les esmenes, s'elaborarà la llista definitiva dels beneficiaris de les ajudes i l'import de les ajudes a atorgar, així com dels exclosos que serà remesa, a proposta de la regidoria de cultura, a la Junta de Govern Local per a la seva aprovació definitiva.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.- El termini màxim per a notificar la resolució del procediment serà de dos mesos, comptats a partir de l'endemà a la finalització del termini de presentació de sol·licituds.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si transcorregut aquest termini no s'hagués dictat resolució expressa, les sol·licituds presentades s'entendran desestimades.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>CONTINGUT DELS CONVENIS:</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb l'article 65.3 del Reial decret 887/2006, de 21 de juliol, estableix que la resolució o, si escau, acord o conveni hauran d'incloure els següents extrems:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a.- Determinació de l'objecte de la subvenció i dels seus beneficiaris, d'acord amb l'assignació pressupostària.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b.- Crèdit pressupostari al qual s'imputa la despesa i quantia de la subvenció, individualitzada per a cada beneficiari si fossin varis.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c.- Compatibilitat o incompatibilitat amb altres subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, nacionals, de la Unió Europea o d'Organismes Internacionals.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d.- Terminis i mètodes de pagament de la subvenció, possibilitat d'efectuar pagaments anticipats i abonaments en compte, així com el règim de garanties que hauran d'aportar els beneficiaris.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e.- Termini i forma de justificació per part del beneficiari del compliment de la finalitat per a la qual es va concedir la subvenció i de l'aplicació dels fons percebuts.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 10. Obligacions dels beneficiaris.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els beneficiaris de les ajudes concedides hauran de complir les següents obligacions:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a.- Complir l'objectiu, executar el projecte, realitzar l'activitat o adoptar el compromís i obligacions que fonamenta la concessió de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b.- Justificar davant l'òrgan concedent o l'Entitat col·laboradora, en el seu cas, el compliment dels requisits i condicions, així com la realització de l'activitat i el compliment de la finalitat que determinin la concessió o gaudi de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c.- Sotmetre's a les actuacions de comprovació, a efectuar per l'òrgan concedent o, així com qualssevol altres de comprovació i control financer que puguin realitzar els òrgans de control competents, tant nacionals com comunitaris, aportant quanta informació li sigui requerida en l'exercici de les actuacions anteriors.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d.- Comunicar a l'òrgan concedent l'obtenció d'altres subvencions, ajudes, ingressos o recursos que financin les activitats subvencionades.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e.- Acreditar, amb anterioritat a dictar-se la proposta de resolució, que es troba al corrent en el compliment de les seves obligacions tributàries i enfront de la Seguretat Social, en tot cas, es podrà autoritzar l'Ajuntament a obtenir aquestes dades.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f.- Disposar dels llibres comptables, registres diligenciats i altres documents degudament auditats, en els termes exigits per la Legislació mercantil i sectorial, aplicable al beneficiari en cada cas.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g.- Conservar els documents justificatius de l'aplicació dels fons rebuts, inclosos els documents electrònics, en tant puguin ser objecte de les actuacions de comprovació i control.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h.- Donar l'adequada publicitat de caràcter públic del finançament de programes, activitats, inversions o actuacions de qualsevol tipus que siguin objecte de subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">i.- Si s'estigués en curs d'alguna de les causes de reintegrament, s'haurà de procedir al reintegrament de la quantia rebuda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 11. Pagament de les ajudes concedides. Justificació de les ajudes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb el que es disposa en Llei 38/2003, General de Subvencions -LGS-, per a la justificació de les ajudes es requerirà una altra documentació que l'acreditativa del requisit per a obtenir la condició de beneficiari prevista en l'article 6 d'aquesta convocatòria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DOCUMENTACIÓ PER A LA JUSTIFICACIÓ SUBVENCIÓ:</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tots els beneficiaris de les ajudes previstes en aquesta convocatòria hauran de presentar el compte justificatiu de la subvenció concedida</strong>, emplenant degudament els <strong>annexos VIII i IX</strong> <strong>d'aquestes bases</strong>, <strong>abans del 30 de novembre de 2022</strong>, excepte les ajudes dirigides a les ApimasiCEIPs, que subvencionen activitats dutes a terme en el curs escolar 2022 – 2023, que hauran de presentar la justificació abans del 30 de juny de 2023.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a la justificació de les subvencions previstes en aquesta convocatòria els beneficiaris hauran d'emplenar el <strong>compte justificatiu</strong> de la mateixa amb els següents<strong> documents</strong>:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- <strong>Annex VIII. Declaració responsable</strong> sobre la realització del projecte subvencionat i del seu pressupost (aquest annex s'emplenarà amb el compte justificatiu de la subvenció)</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- <strong>ANNEX IX</strong>. Compte justificatiu de la subvenció o una <strong>memòria justificativa</strong> acreditativa que s'ha complert la finalitat per a la qual es va atorgar la subvenció, indicant les activitats realitzades, els costos i els resultats obtinguts, que contindrà:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- <strong>Relació de despeses i ingressos</strong> de l'activitat subvencionada identificant creditor i document, el seu import, data d'emissió i de pagament.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- <strong>Factures</strong> o documents de valor probatori, incorporats en la relació anterior així com els seus <strong>justificants de pagament</strong>.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Detall d'<strong>altres ingressos o subvencions que hagi finançat l'activitat</strong> subvencionada amb indicació del seu import i procedència.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El beneficiari estarà obligat a adjuntar en el compte justificatiu informe de l'AEAT i de la Tresoreria General de la Seguretat Social d'estar al corrent de les obligacions tributàries i de la seguretat social, o bé a autoritzar l'Ajuntament de Sant Joan de Labritja per a la consulta de dades en matèria tributària.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>​​​​​​​</strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 12. Compatibilitat de les ajudes.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les ajudes regulades per la present convocatòria seran compatibles amb altres de la mateixa finalitat, qualsevol que sigui l'Administració o Entitat que les concedeixi.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 13. Control i reintegrament.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Procedirà el reintegrament de les quantitats percebudes i l'exigència de l'interès de demora des del moment del pagament de la subvenció fins avui en què s'acordi la procedència del reintegrament, i en la quantia fixada en l'article 38.2 de la Llei General de Subvencions, en els següents casos:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Obtenció de la subvenció falsejant les condicions requerides per a això o ocultant aquelles que ho haguessin impedit.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Incompliment total o parcial de l'objectiu, de l'activitat, del projecte o la no adopció del comportament que fonamenten la concessió de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Incompliment de l'obligació de justificació o la justificació insuficient, en els termes establerts en l'article 30 de la Llei 38/2003, i en el seu cas, en les Normes reguladores de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Incompliment de l'obligació d'adoptar les mesures de difusió contingudes en l'apartat 4 de l'article 18 de la citada Llei 38/2003.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Resistència, excusa, obstrucció o negativa a les actuacions de comprovació i control financer previstes en els articles 14 i 15 de la Llei 38/2003, així com l'incompliment de les obligacions comptables, registrals o de conservació de documents quan d'això es derivi la impossibilitat de verificar l'ocupació donada als fons percebuts, el compliment de l'objectiu, la realitat i regularitat de les activitats subvencionades, o la concurrència de subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, Nacionals, de la Unió Europea o d'Organismes Internacionals.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Incompliment de les obligacions imposades per l'Administració a les Entitats col·laboradores i beneficiaris, així com dels compromisos per aquests assumits, amb motiu de la concessió de la subvenció, sempre que afectin o es refereixin a la manera en què s'han d'aconseguir els objectius, realitzar l'activitat, executar el projecte o adoptar el comportament que fonamenta la concessió de la subvenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) Incompliment de les obligacions imposades per l'Administració a les Entitats col·laboradores i beneficiaris, així com dels compromisos per aquests assumits, amb motiu de la concessió de la subvenció, diferents dels anteriors, quan d'això es derivi la impossibilitat de verificar l'ocupació donada als fons percebuts, el compliment de l'objectiu, la realitat i regularitat de les activitats subvencionades, o la concurrència de subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, Nacionals, de la Unió Europea o d'Organismes Internacionals.</span></p> <p style="margin-bottom:0px;
